SUBJECT: USR12-0040, Kerr-McGee
An Amendment to a Use by Special Review permit to add equipment to an existing oil and gas
facility (compressors, etc.).
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 10 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
The access is from unmaintained CR 10 section line right-of-way. There is 60 feet of unmaintained
County right-of-way (30 feet either side of the section line) along the CR 10 section line. It appears that
the access roadway is within this right-of-way. The applicant will need to enter into a Non-Exclusive
License Agreement with the County to utilize this right-of-way for access. The Non-Exclusive License
Agreement states that the County will not maintain or upgrade the access and that the applicant is aware
that their use is not exclusive.
Traffic is minimal and the applicant will utilize the existing accesses.
If over an acre of land will be disturbed a Weld County Grading Permit and State Stormwater
Management Plan will be required.
A Drainage Letter was included with the application and discussed the water quality design. The
calculations and drainage design is acceptable to Public Works.
REQUIREMENTS:
1. Add the following conditions of approval to the plat:
a. Show and label the unmaintained CR 10 section line right-of-way.
b. A Nonexclusive License Agreement is required for use of the unmaintained County Right-
of-Way along the CR 10 section line.
2. Add the following development standards to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent

property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
c. Weld County is not responsible for the maintenance of drainage related features.

After reviewing the application and documents submitted the Building Department has the following comments:
A building permit will be required for any new construction, alteration, or addition to any buildings and or equipment
on the property. All buildings required that a code analysis be done on the project by a design professional with
experience in this area. A building permit application must be completed and two complete sets of engineered plans
including engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be
submitted for review. A geotechnical engineering report performed by a registered State of Colorado engineer shall
be required or a open hole inspection..
Buildings, equipment and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006
International Mechanical Code; 2006 International Plumbing Code: 2006 International Energy Code; 2006
International Fuel Gas Code; 2011 National Electrical Code; 2003 ANSI 117.1 Accessibility Code and Chapter 29 of
the Weld County Code.Surgery center shall conform to Section 422 of the 2006 International Plumbing Code.
A plan review shall be approved and a permit must be issued prior to the start of construction.
