HomeMy WebLinkAbout20121513.tiff HEARING CERTIFICATION DOCKET NO. 2012-36 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR12-0009, FOR A MAJOR FACILITY OF A PUBLIC UTILITY (TWO MILES OF SINGLE CIRUIT 115-KILOVOLT (kV) ELECTRIC TRANSMISSION LINE, TO CONNECT INTO THE LASALLE GAS PLANT [USR-1792] SUBSTATION FACILITY, AND ONE (1) SWITCHING STATION AT POINT OF INTERCONNECTION FROM THE WESTERN AREA POWER ADMINISTRATION [WAPA] TRANSMISSION LINE) IN THE A (AGRICULTURAL) ZONE DISTRICT - TRI-STATE GENERATION AND TRANSMISSION ASSOCIATION A public hearing was conducted on June 20, 2012, at 10:00 a.m., with the following present: Commissioner Sean P. Conway, Chair Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer Commissioner David E. Long - EXCUSED Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Heidi Hansen Health Department representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated April 27, 2012, and duly published May 2, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of Tri-State Generation and Transmission Association, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0009, for a Major Facility of a Public Utility (two miles of single circuit 115-Kilovolt (kV) electric transmission line, to connect into the LaSalle Gas Plant [USR-1792] Substation Facility, and one (1) switching station at point of interconnection from the Western Area Power Administration [WAPA] transmission line) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. ID Chair Conway advised Steve Gray, applicant's representative, that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Long will listen to the record and make the determining vote. Mr. Gray indicated he would like to proceed today. e Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He reviewed the alternatives to address the need of the project, as well as the three routes. He stated Alternative Route A is the preferred route and the Town of Kersey had no Cam . Mr. Ogle stated 16 referral agencies reviewed the proposal, five offered comments which have been addressed in the Conditions of Approval and Development Standards, staff has received no correspondence from surrounding property owners, and he displayed photographs of the site and surrounding area. El Heidi Hansen, Department of Public Works, reviewed the various permits necessary for the project and stated staff has no issues with the proposal. ID Lauren Light, Department of Public Health and Environment, stated the facility will utilize portable toilets, water will be trucked in for dust control, and waste will be kept in enclosed containers and hauled to a disposal facility. Mr. Gray explained the purpose of this project is to construct a transmission line from an existing facility to a new facility. He stated the applicant did obtain feedback from the community to determine the best route and they are working with the landowners to obtain the necessary easements. He also addressed questions from the Board regarding the access permit, air quality emissions, and dust control. ID No public testimony was offered concerning this matter. In response to Chair Conway, Mr. Gray stated he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as proposed. El Commissioner Kirkmeyer moved to approve the request of Tri-State Generation and Transmission Association for a Site Specific Development Plan and Use by Special Review Permit, USR12-0009, for a Major Facility of a Public Utility (two miles of single circuit 115- Kilovolt (kV) electric transmission line, to connect into the LaSalle Gas Plant [USR-1792] Substation Facility, and one (1) switching station at point of interconnection from the Western Area Power Administration [WAPA] transmission line) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Garcia, and it carried unanimously.
