RESOLUTION
RE: VACATION„ ABANDONMENT AND CLOSING OF A PORTION OF COUNTY
ROAD NO. 394 LOCATED IN AND. TRAVERSING ACROSS THE WEST
HALF OF SECTION 9, TOWNSHIP 4 NORTH, RANGE 66 WEST OF THE ,
6th' P.M. , WELD COUNTY, COLORADO.
WHEREAS, a Petition has been presented to the Board of
County Commissioners, Weld County, Colorado by Monfort of
Colorado, the Union Ditch Company, and Mr. Lloyd Rumsey,
requesting that a portion of County Road No. 394, located in
and traversing across the West Half of Section 9, Township 4
North, Range 66 West of the 6th P.M. , Weld County, Colorado,
be vacated, abandoned and closed, the center line of said
County Road No. 394 being more particularly described as follows:
Considering the north line NEy said Section 9
to bear N. 90000' 00" E. , and all other bearings
being relative thereto:
Beginning at a point on the north right-of-way
line of existing county road number 46 whence
the SW Corner said 'Section 9 bears S. 01020 ' 50"
W. , 30.00 feet; thence along said road centerline,
N. 01020 ' 50" E. , 1917. 31 feet; thence,
N. 26°31 ' 05" E. , 330. 92 feet; thence,
N. 50°07 ' 56" E. , 242. 36 feet; thence,
N. 32°50 ' 37" E. , 1212. 03 feet; thence,
N. 58°48 ' 17" E. , 996.62 feet; thence,
N. 07°09 ' 36" E. , 820 . 39 feet; thence,
N. 29°18 ' 00" E. , 657. 26 feet to a point of
intersection with the north line NW4 said
Section 9 whence the N4 Corner said Section 9
bears N. 90°00 ' 00" E. , 114.00 feet. ?
The above described centerline of county road
number 394 affects 6176. 89 linear feet.
WHEREAS, the Board, after investigation of all the facts
and circumstances surrounding the petition, has determinded
that the public necessity no longer requires that the above-
described portion of County Road No.: 394 should remain open,
and
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, believes it to be in the best interest of the public
safety and welfare of the citizens of Weld County, to approve
said petition.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners, Weld County, Colorado that the above-described
portion of County Road No. 394 be, and hereby is, declared
abandoned, vacated and closed, in accordance with the submitted
petition.

made and seconded, adopted by the following vote on the _irh

With regard to your request of July. 27 , 1976 , concerning the
possibility of closing a portion of county road number 394 •
as per a road vacation petition submitted by your office,
the Weld County Engineer will need a more complete legal
description before we can proceed with further consideration
of the petition.

The undersigned hereby state that they are the sole owners • '
of real property situated on both sides of that portion of county
road described as follows:
That portion of County Road number 394 located in
' Section 9, Tevmship. 4 North, Range 66 1'iest of the •
6th P.11. i more particularly described as follows: beginning
at the SW corner of said Section'9 and proceeding in a
northeasterly direction along said County Road, number
394 to the intersection point of said County Road number
394 with the North boundary of said Section 9, said
point being located approximately 2900 feet West of the
NE corner of said Section 9, the portion of road being
approximately 6300 feet in length and designated in red
on Exhibit A attached hereto.
The undersigned further respectfully represent that they

knowledge of the character and use of said road, do hereby indicate
that it is rarely used and difficult to maintain -and,• therefore,
