WITNESSETH: WHEREAS, the District was formed through Resolution Number 2011-2263 on August 17, 2011, nunc-pro-tunc, June 29, 2011, and WHEREAS, the District Board approved a Service Plan for the District, which the BOCC has approved on October 25, 2011 (the "Service Plan"), which allows the District to"distribute, on an annual basis, all of the funding that the District receives from DOLA, except such funds as expended or reserved for administrative expenses, as permitted by C.R.S. § 30-20-1307 (1)(b),to areas within the unincorporated areas of Weld County that are socially or economically impacted by the development, processing, or energy conversion of fuels and minerals leased under the Federal "Mineral Lands Leasing Act" of February 25, 1920, as amended," and WHEREAS, District has received from the Weld County Department of Public Health and Environment a proposal for funding of a Gas Chromatograph Mass Spectrometry (GC-MS) instrument, a copy of which is attached hereto and referred to herein as "Exhibit A,"and WHEREAS, the District and the County intend this IGA to set forth the terms and conditions under which the District shall pay to County funding the District receives from DOLA, as allowed by the District Service Plan,to pay for the GC-MS instrument. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein,the parties hereto agree as follows: 1. District agrees to pay to County the sum of$150,000 over the course of three (3) years, being payments of$50,000 per year in 2012, 2013, and 2014, as funding for the GC-MS instrument. A GC-MS instrument would allow the WCDPHE laboratory to analyze ground water contaminates of concern that have the potential to originate from oil and gas activities. Contaminated ground water wells could have considerable economic impacts for unincorporated Weld County residents and possibly affect the overall health of those residents. As a result of increased oil and gas explorations in Weld County, WCDPHE has received numerous phone calls of concern from residents requesting baseline water quality testing. Common themes to the requests include the establishment of water quality prior to drilling activities and peace of mind to those that rely on groundwater for drinking, cooking, and bathing. This proposal is constructed to assist unincorporated Weld County residents in identifying impacts to their water, from the development and exploration of the oil and gas industry in Weld County. The possibility of contamination potentially exists because the drilling of a well directly maneuvers through the formations or aquifers that contain ground water supplies. As the number of permitted wells increases the potential for ground water contamination also amplifies. Besides drilling, other potential modes of contamination from the oil and gas industry include accidental releases of production fluids, faulty injection well casing construction, poor pit construction, maintenance, leakage from on-site storage, subsurface discharge, and transportation accidents (EPA, 2011). The number of oil and gas wells within Weld County has grown significantly during the past decade [Figures 1 (2000) and 2 (2011)]. In fact, it has been reported that Weld County leads the nation in the number of wells in its'jurisdictional boundary (COGA, 2011). With the discovery of the Niobrara oil shale formation and the advent of directional drilling, present growth is predicted to increase beyond historical forecasts. During the first 90 days, the Jake 2-01H site drilled in the Julesburg area in Northern Colorado produced 50,000 barrels of crude oil (EOG Resources, 2010). This success has spurred an oil and gas rush in the Niobrara oil shale formation in the area of Weld County. It is actually anticipated that the Niobrara oil shale formation is to become one of the largest domestic onshore producing formations in the lower-48 by 2012 (EOG Resources, 2010). The increased permit activity seen in Weld County recently supports the EOG Resources' statement. Presently Weld County has 3,962 approved oil and Application Letter for Funding Request Page 1 gas permits, 245 pending permits, amid 1,524 approved site locations and 123 pending site locations (OGCC, 2011). Eventually, the northeast quadrant of the county may resemble the number of oil and gas wells that currently reside in the southwest quadrant of the county similarly to the growth seen in the last decade (Figure 2). Currently there are 21,229 permitted ground water wells in Weld County as shown in figure 3; including drinking water wells, commercial wells, industrial wells, monitoring wells, irrigation wells, municipal water well supplies, stock wells, wildlife wells, injection wells, etc. (Division of Water Resources, 2011). Nationally 47% of the population utilizes ground water as their primary consumptive water source (Wellowner.org, 2011). From the UpState Colorado 2010 Demographic profile, Weld County has an estimated 2008 population of 251,220 and an unincorporated estimated population of 46,524 which would be more at risk for oil and gas activity impacts due to locality (Upstate et al., 2010). Presently Weld County has a population 27,562 residents that use ground water as their consumptive water source withdrawing 2.5MGD for various uses (NGWA, 2011). Accordingly, the percentage of Weld County unincorporated residents relying on ground water for their primary water source is above the national average. This population total includes 34 state classified public water systems within unincorporated Weld County, including rural schools, churches, restaurants, and small businesses making the public health risk transient(Willard, 2011). The public health risk lies with unknowingly consuming contaminates associated with oil and gas activity, some of which are carcinogenic. The immense volume of the exploration of petroleum products dwarfs all other chemicals of environmental and health concern in our time (CDC, 2011). Oil and gas activity contaminating a water supply can have serious economic consequences. New well water supplies can cost upwards of$35,000, and in worst-case scenarios, contaminated water supplies could severely impact agricultural and cattle operations as well as property values. Contaminated water supplies can force residents to purchase hauled potable water supplies, purchase tap fees for municipal water supplies and construct conveyance systems, or re-drill a permitted potable water source. For the Weld County Laboratory to have the means to test for these contaminates the lab is in need of a Gas Chromatography Mass Spectrometry (GC-MS) instrument. GC-MS is capable of testing for Volatile Organic Compounds (VOCs) and Hydrocarbon compounds including petroleum products. This testing is critical, since water quality in private wells is not regulated by federal, state, or local government agencies. In the best interest of public health, the EPA has set the public health goal of many of the VOCs contaminates at zero (EPA, 2011). As a result, the rationale behind testing for VOCs by GC-MS is as follows; "organic chemicals including thickeners are added to hydraulic fracturing fluid to make water viscous so it can hold sand particles, petroleum distillates, such as diesel, that many be added to help make water"slick;" biocides must be added to kill bacteria and other microorganisms that can grow and clog pipes; and organic compounds that may be released from shale along with natural gas" (Community Science Institute, 2011, p. 1). Thus, the National Ground Water Association (NGWA) (2011) states, "It is important to collect a sample before oil and gas drilling in your area to establish the baseline conditions of your groundwater supply" (pg. 3). Sensibly, baseline testing should be followed up by retesting ones water quality after hydraulic fracturing has taken place within six months (National Ground Water Association, 2011). It must also be realized that the VOCs screened for include both natural and manmade contaminates used during the drilling process such as surfactants, detergents, oil, grease, benzene, and toluene (Pennsylvania State University, 2010). The addition of a GC-MS will allow the Weld County laboratory to fully provide residents with baseline and post drilling water quality testing aligned with the recommendations from the NGWA and CDPHE. Those parameters performed by the laboratory would include: Application Letter for Funding Request Page 2 • VOCs • Total Hardness • Sulfate • Nitrate/Nitrite Screening • Total Dissolved • Arsenic • Iron 54 organic Solids • Chromium • Sulfates parameters • Chloride • Sodium • Selenium and/or • Fluoride • Calcium • Total Identification • pH • Alkalinity • Magnesium Coliform/e.Coli For the above identified baseline water quality tests WCDPHE plans to offer the GC-MS VOCs screen free of charge, and charge for the other parameters according to our fee schedule. Rightfully so, the laboratory would start GC-MS analysis focusing on serving the public's interest first, then phase in compliance sampling for industry and other interested parties. It is anticipated that the laboratory will be able to absorb the cost of operational and sampling consumables such as, sampling vials, gases, solvents, waste disposal, and operator time. Suggested consumables cost per year is roughly $2,000; the lab can operate the GC-MS project as a full cost recovery program. Utilizing the GC-MS for testing state permitted drinking water and wastewater containments for public treatment works and non-community public ground water facilities such as, schools, restaurants, bars, gas stations, and other small businesses is a viable option. Once the instrument is onsite-training starts immediately and the instrument begins the validation process for state certification for drinking waters. Training, instrument validation, and the state certification process if aggressively sought, could be completed within four months. As soon as the instrument gains certification the laboratory could start providing baseline and post water quality testing for residents. The WCDPHE laboratory currently holds drinking water certifications through the state health department for analyzing lead, copper, nitrate, nitrite, fluoride, and total coliforms and e.coli, maintaining those certifications for 20plus years. Other parameters listed within the proposed baseline testing parameters list (above) do not require state certification. In the realm of public health, measureable outcomes can be difficult to gauge. Although short term results can be measured in this case by the sheer numbers of patrons using the analytical service, long term outcomes are much more difficult to evaluate. The measureable long term goal of this project is to assess the water quality of unincorporated private wells, assuring that analyzed contaminate values are at or below the EPA recommended maximum contamination level. This project aligns with the Health Departments vision statement; "Together, we are working to make Weld County a healthy place to live, learn, work and play" (Weld County, 2011). Hence, long-term measurable outcomes may be determined from the overall health and quality of life of our county residents. Another, intangible long term benefit for the health department is that this project provides important public exposure for the department; by upholding our social responsibility as a governmental service organization we can foster a positive public image of our department and county as well as the oil and gas industry. Included within Appendix A of this application letter is the quote from Agilent Technologies outlining the total cost(s) of the GC-MS including a five-year maintenance agreement (item#SYS-GM-5975T). Other competitive quotes for comparison have been reviewed for consideration. Above the costs of the quote, we would like to request an additional $2,000 for travel expenses for an offsite-advanced-training-course. The cost of the actual training course (item#H4043A) is included in the purchase; however, the expenses of travel are not. Other anticipated costs included the state fee for certification, proficiency test samples to demonstrate competence and capability, and miscellaneous start up supplies including sampling kits and vials. Illustrated below in Table 1 is a detailed summary of the budgetary request.
