HomeMy WebLinkAbout20120539.tiff HEARING CERTIFICATION DOCKET NO. 2012-13 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR11-0025, FOR A VETERINARY CLINIC (AN EXAMINATION/EQUINE SURGERY ROOM, AS WELL AS A LAB AREA) IN THE A (AGRICULTURAL) ZONE DISTRICT - DOUG JERGENS A public hearing was conducted on February 29, 2012, at 10:00 a.m., with the following present: Commissioner Sean P. Conway, Chair Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer Commissioner David E. Long - EXCUSED Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Chris Gathman Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated January 20, 2012, and duly published January 25, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of Doug Jergens for a Site Specific Development Plan and Use by Special Review Permit, USR11-0025, for a Veterinary Clinic (an examination/equine surgery room, as well as a lab area) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Chair Conway advised Doug Jergens, applicant, that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Long will listen to the record and make the determining vote. Mr. Jergens indicated he would like to proceed today. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written, and gave a brief description of the location of the site. He explained the applicant intends to convert the existing barn into an equine examination and surgery room, with five recovery stalls, and there will be a total of four employees, including the two owners. He stated eight referral agencies reviewed the proposal, and seven offered comments which have been addressed in the Conditions of Approval and Development Standards. He further stated the site is not within the three-mile referral area, or Intergovernmental Agreement area, for any municipality, and staff received no correspondence from surrounding property owners. He displayed an aerial map and photographs of the site and surrounding area. 2012-0539 PL2151 HEARING CERTIFICATION - DOUG JERGENS (USR11-0025) PAGE 2 Don Carroll, Department of Public Works, stated the site will be accessed from County Road (CR) 70, which is a local gravel road with an average daily traffic count of 66 vehicles per day. He stated staff is requesting the applicant submit a Traffic Study narrative, surface the existing access drive with gravel, and control noxious weeks. Lauren Light, Department of Public Health and Environment, stated the site will be served by the North Weld County Water District, and the applicant will be installing a new septic system. She stated the Dust Abatement and Waste Handling Plans have been submitted and approved, and Development Standards #4 through #15 are standard requirements for this type of facility. Doug Jergens, applicant, stated his wife, Amy Jergens, is an equine surgeon. Ms. Jergens explained she has been commuting to Littleton, Colorado, and renting a surgery suite; however, a local facility will be more convenient for her, the clients, and the animals involved. No public testimony was offered concerning this matter. In response to Commissioner Rademacher, Mr. Jergens indicated they are sizing the septic system to serve up to eight people and he agreed to modifying Development Standard #3 to not exceed eight (8) employees, including themselves. Responding to Commissioner Conway, Mr. Jergens stated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as proposed and modified. Commissioner Rademacher moved to approve the request of Doug Jergens for a Site Specific Development Plan and Use by Special Review Permit, USR11-0025, for a Veterinary Clinic (an examination/equine surgery room, as well as a lab area) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also modified Development Standard #3 to not exceed eight (8) employees, including the applicants. The motion was seconded by Commissioner Garcia, and it carried unanimously.
