(FORMERLY HUWA ENTERPRISES), C/O ANN CHRISTEN A public hearing was conducted on January 18, 2012, at 10:00 a.m., with the following present: Commissioner Sean P. Conway, Chair Commissioner William F. Garcia, Pro-Tern Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Heidi Hansen Health Department representative, Mary Evett The following business was transacted: I hereby certify that pursuant to a notice dated November 18, 2012, and duly published November 23, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of Huwa Enterprises, c/o Ann Christen, for a Site Specific Development Plan and Use by Special Review Permit, USR11-0022, for a Public and Quasi-Public Building, including administrative offices or meeting halls for agricultural organizations (Homestead Grange, Inc.), in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record and indicated the applicant has submitted evidence of a Quit Claim Deed transferring the property from Huwa Enterprises to Homestead Grange #215 Hall, Inc. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written, and provided a brief description of the location of the site. He stated the property is not within three miles of any municipality; however, there are seven property owners within 500 feet of the subject site, but staff did not receive any correspondence from the area residents. He further stated eight referral agencies reviewed the proposal, three offered comments which have been addressed in the Conditions of Approval and Development Standards, and he displayed an aerial map and photographs of the site and surrounding area. Heidi Hansen, Department of Public Works, stated Highway 52 is under the jurisdiction of the Colorado Department of Transportation (CDOT), which has granted an access permit. She further stated the applicant has designated a water quality depression area for stormwater runoff and all of the Department's requirements have been met. Pt, PuA) i, H ` 2012-0196 I- Q5 l0 PL2146 HEARING CERTIFICATION - HOMESTEAD GRANGE #215 HALL, INC., (FORMERLY HUWA ENTERPRISES), CIO ANN CHRISTEN (USR11-0022) PAGE 2 Mary Evett, Department of Public Health and Environment, stated the site will be served by a commercial well and an engineer-designed septic system. She stated the applicant has submitted a Waste Handling Plan and a Dust Abatement Plan, which includes surfacing the drive areas with recycled asphalt and maintaining the open areas with native grasses. In response to Commissioner Kirkmeyer, Ms. Evett stated Condition of Approval #4.B refers to a Class V Injection Well, which simply requires submittal of an inventory form to the Environmental Protection Agency for a septic system serving more than 25 persons per day (the subject site is designed for 500 persons and is more than adequate). Ann Christen represented the applicant and stated this project was started because the original homestead grange was located on land the organization did not own. She stated it was not financially feasible to move the building, so they decided to relocate to the subject site, which will serve the community well. No public testimony was offered concerning this matter. In response to Commissioner Kirkmeyer, Mr. Yatabe stated Homestead Grange #215 Hall, Inc., needs to be reflected in the Resolution for purposes of signing the plat. In response to Chair Conway, Ms. Christen stated they have reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as proposed and modified. Responding to Commissioner Kirkmeyer, Ms. Christen requested 180 days to finalize the remaining requirements and record the plat. Commissioner Kirkmeyer moved to approve the request of Homestead Grange #215 Hall, Inc., (formerly Huwa Enterprises), c/o Ann Christen, for a Site Specific Development Plan and Use by Special Review Permit, USR11-0022, for a Public and Quasi-Public Building, including administrative offices or meeting halls for agricultural organizations, in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. Her motion included modifying Conditions of Approval #5 and #7 to extend the recording deadline from 60 days to 180 days, amending the applicant's name throughout the Resolution, and deleting Development Standards #25 and #26, which are duplicates of #22. The motion was seconded by Commissioner Rademacher, and it carried unanimously.
