SUBJECT: USR12-0048 Angus Compressor Station
(Bear Tracker Energy)
The Weld County Public Works Department reviewed the submitted application for critical items,
including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils
Report, and Flood Hazard Development Permit. A detailed review of these items was not completed at
this step in the process. Comments made during this stage of the review process will not be all
inclusive; as revised materials are submitted, other concerns or issues may arise. All issues of concern
and critical issues during further review must be resolved with the Public Works Department.
COMMENTS:
Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011)
CR 130 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a
60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK
in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way
line.
Public Works Department has no average daily traffic count at this location.
Section Line Access: CR 71 (right-of-way)
The applicant shall complete a Nonexclusive License Agreement for the Upgrade and Maintenance of
Weld County Right-of-Way. The applicant shall finalize the Nonexclusive License Agreement by
providing an original signature to the Public Works Department so it can be processed with the Weld
County Board of County Commissioner to provide access utilizing the County Section line access
(right-of-way) to the facility.
REQUIREMENTS:
Traffic Study:
The applicant has supplied a narrative indicating the number of people utilizing the site would be three
to four people, proposed to be employed at the site. This will be an unmanned site with a 3/4 ton pickup
typically accessing this site one or two times a day.
Stormwater Drainage:
The applicant has supplied a narrative. Weld County Public Works Department is requiring a water
quality capture feature to be located on site. The area can be an existing on site low point that will
capture the storm water and hold any contamination onsite or it can be a shallow (one foot to two foot)
depression dug downstream of the parking lot and compressor station areas.

Grading Permit:
If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction.
The grading permit application must contain: an erosion and sediment control plan, a grading plan,
installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to
be utilized, and a copy of the approved CDPHE stormwater permit.
Show the approved access on the plat and label it with the approved access permit number(AP#).
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the applicant/landowner shall
be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be
maintained at a maximum height of 12 inches until the area is completely developed.
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA). (Lot A, but a portion of Lot B directly west of the proposed site IS within
a SFHA.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility for natural gas products. As there will be no permanent employees
located at the site, permanent water and sewer is not required. A portable toilet is
acceptable in accordance with Environmental Health Policy 2.2.K.
On site dust will be controlled by watering if necessary and the road into the site will be
graveled.
The waste handling section states that dumpsters will be provided for trash and will be
emptied on a weekly basis.
Noise may be regulated by the Colorado Oil and Gas Conservation Commission. The
use of berms, sound walls and enclosing equipment in a sound proof building could be
utilized to limit noise impacts if necessary.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1 . The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment to Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. Alternately, the applicant can provide evidence from the APCD that
they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
development standards.
1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions. The
applicant shall operate in accordance with the approved "waste handling plan", at
all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
5. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. Portable toilets and bottled
water are allowed for employees or contractors that are on-site for less than two
(2) consecutive hours per day.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code, or
with all applicable State noise statutes and/or regulations.
7. The operation shall comply with all applicable rules and policies regulated by the
Colorado Oil and Gas Conservation Commission.
8. All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
9. The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
10.The applicant shall obtain a Colorado Discharge Permit System or CDPS permit
from the Colorado Department of Public Health and Environment (CDPH&E),
Water Quality Control Division, as applicable.
The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

After reviewing the application and documents submitted the Building Department has the following comments:
A building permit will be required for the 3 compressors and associated buildings and equipment.
A building permit application must be completed and two complete sets of engineered plans including
engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must
be submitted for review.
A geotechnical engineering report performed by a registered State of Colorado engineer shall be required
or a open hole inspection.
Buildings, equipment and structures shall conform to the requirements of the various codes adopted at
the time of permit application. Currently the following has been adopted by Weld County: 2006
International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code:
2006 International Energy Code; 2006 International Fuel Gas Code; 2011 National Electrical Code; 2003
ANSI 117.1 Accessibility Code and Chapter 29 of the Weld County Code. Surgery center shall conform to
Section 422 of the 2006 International Plumbing Code.
A plan review shall be approved and a permit must be issued prior to the start of construction.
