RE: APPROVE REQUEST FOR RENEWAL OF LAW ENFORCEMENT SERVICE
AGREEMENT -TOWN OF HUDSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with a Request to Renew the Law Enforcement
Service Agreement between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Weld County Sheriffs Office, and the Town
of Hudson, commencing January 1, 2013, and ending December 31, 2013, with further terms and
conditions being as stated in said letter of request, and
WHEREAS,after review,the Board deems it advisable to approve the request to renew said
agreement, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the Request to Renew the Law Enforcement Service Agreement between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, on behalf of the Weld County Sheriffs Office, and the Town of Hudson be, and hereby is,
approved.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 3rd day of December, A.D., 2012.

RE: Rate Increase for Law Enforcement Duty Agreements
Dear Mr. Racine,
Over the past years,the Weld County Sheriff's Office has entered into law enforcement duty
agreements to provide law enforcement services to small incorporated municipalities. It has always
been the practice of the Weld County Sheriff's Office to enter into these agreements to help
municipalities provide statutorily required law enforcement services to their communities at a cost that
is reasonable and fair to all parties involved. The Weld County Sheriff's Office does not view law
enforcement duty agreements as profit generating. The agreement hourly rate has and will continue to
be a way of mitigating direct costs associated with providing law enforcement services to the
contracting town or entity.
Over the last couple of years, the Weld County Sheriffs Office has tried to keep the hourly rate charged
for law enforcement coverage to a minimum. For this reason our agency absorbed some of the cost
associated with providing law enforcement services without increasing the agreement rate. Overtime,
the gap between costs and the agreement rate has continued to increase. Since January 2010, the rate
for law enforcement service has remained unchanged at $51.00 per hour.
A recent review of all law enforcement agreements maintained by the Weld County Sheriff's Office
indicated that the hourly rate charged for law enforcement services is inadequate for covering the costs
associated with providing those services. Therefore, starting in 2013, the new rate for all municipal and
special event agreements will be $ 53.00 per service hour. The goal of the rate increase in the
agreement rate is to mitigate the direct costs associated with providing the particular service, not to

generate revenue for the Weld County Sheriff's Office. This rate remains below the true cost of
providing contractual services to the municipalities and special events. As a value added service to the
community, our agency will continue to absorb some of the cost it incurs in training and equipping the
deputies that service the agreements. In the coming years we hope to be able to recuperate additional
costs by implementing reasonable rate increases as needed.
The current law enforcement agreement is renewed automatically on a year-by-year basis unless sooner
terminated by either party in writing served upon the other party no later than sixty(60) days prior to
the expected date of termination. Per Section C3 of the current agreement any future renewals are
subject to changes in the hourly rate schedule as provided by the Sheriffs Office which is set forth in
Schedule D. Also, notifications of changes in said rate should be made at least ninety(90) days prior to
the annual renewal date and served as amendment to Schedule D without the requirement of further
formal action.Therefore, this letter is to serve as formal notice by the Sheriffs Office that the hourly
rate charged for law enforcement services beginning with the renewed agreement beginning January 1,
2013,will be$53.00 per hour and the agreement will be automatically amended accordingly.
At this time, the Weld County Sheriffs Office is asking that you determine the total dollar amount of law
enforcement services you will request for the upcoming year. Once this determination has been made,
we request that such information be entered into Schedule D of the agreement. Please return Schedule
D to the Weld County Sheriffs Office as soon as practical but no later than the 2nd of November, 2012.
Please be sure to fill in any pertinent information related to contact information for the town's
agreement monitor on Schedule C. The Weld County Sheriff's Office thanks you for your prompt
attention to this matter.

SCHEDULE D
The hourly rate comprising the contract amount of this fiscal agreement during the initial
term of the Agreement, and until further notice as set forth in the Agreement, shall be
$53.00 per hour per Deputy, for both direct and indirect services performed.
2. The maximum amount to be billed to the Town by the Sheriff for direct and indirect
services shall be $ i3 7 VL for the fiscal year 2013. If the maximum amount is
billed prior to the expiration of the term of this Agreement, unless an amendment to this
Agreement authorizing an additional amount for the payment of the services described
herein is entered into by both parties, the Sheriff shall no longer be obligated to provide
such services. In that case, the Sheriff would then provide only such services to the
Town which the Sheriff would normally otherwise provide in the enforcement of
Colorado statutes.
