Conway, Chair Commissioner William F. Garcia, Pro-Tern Commissioner Barbara Kirkmeyer- EXCUSED Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Chris Gathman The following business was transacted: El I hereby certify that pursuant to a notice dated July 20, 2012, and duly published July 25, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0040, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (an amendment to 2nd AMUSR-468 to add an intermediate pressure system — two (2) IP compressors, three (3) IP Separators, and four (4) IP Slug Catchers with piping along with a new electrical building and additional equipment) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. El Chair Conway advised the applicant's representative, Vince Harris, that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Kirkmeyer will listen to the record and make the determining vote. Mr. Harris indicated he would like to proceed today. IR Chris Gathman, Department of Planning Services, presented a brief summary of the second amendment proposal and described the location of the site and surrounding land uses. He also reviewed the referral responses, entered the favorable recommendation of the Planning Commission into the record as written, and displayed maps and photographs of the site and surrounding area. El Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, Dust Abatement and Waste Handling Plans, and noise limitations. FM Mr. Harris displayed a PowerPoint presentation, marked Exhibit D, and reviewed the site layout and intended operations, and confirmed the applicant did do community outreach. I] No public testimony was offered concerning this matter. In response to Chair Conway, Mr. Harris stated the applicant is in agreement with the Conditions of Approval and Development Standards, as proposed. He addressed questions regarding the number of employees and requested no increase. In response to Chair Conway, Mr. Harris stated he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as proposed. FM Commissioner Long moved to approve the request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0040, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (an amendment to 2nd AMUSR-468 to add an intermediate pressure system — two (2) IP compressors, three (3) IP Separators, and four (4) IP Slug Catchers with piping along with a new electrical building and additional equipment) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Rademacher, and it carried unanimously. There being no further discussion, the hearing was completed at 11:36 a.m. This Certification was approved on the 27th day of August, 2012.
