Pursuant to Colorado Revised Statutes 24-10-109 , the
following notice is given and presented :
1 . The claimant is 0 . A. Banek , 2120 East 18th Street ,
Greeley , Colorado 80631 .
2 . The claimant ' s attorney is William E . Bohlender ,
1327 10th Avenue , Greeley , Colorado 80631 .
3 . The basis of the claim is that on the Fourteenth
day of December , 1978 , at approximately 11 : 00 p .m. , on the
private property of the claimant at 2120 East 18th Street ,
City of Greeley , County of Weld , State of Colorado said
0 . A. Banek was assaulted by two deputies of the Weld County
Sheriffs Department and that the assault caused injuries
including an anterior dislocation of the right shoulder ;
that the claimant was taken without authority (a false
arrest without warrant) against his desires to the Weld
County Jail ; that the claimant repeatedly requested medical
assistance and no medical assistance was provided as needed
and required by law but instead the claimant was fingerprinted
with a dislocated , swollen and discolored arm; that upon his
release from said jail the claimant proceeded to the Weld
County Hospital where he received the necessary medical
treatment and is presently under medical care .
4 . That the names of the public employees involved and
supervisor known at the present time are :

3 . Sheriff Don Bower
4 . Others unknown in office

5 . The nature and extent of injuries were lacerations ,
bruises , anterior dislocation of arm and resulting internal
damage , resulting in loss of ability to work , medical and other
related expenses , loss of time , employment and permanent
injuries .
6 . The amount of monetary damages being requested is
$250 , 000 . 00 .
