It is required that FAA Form 7460-2, Notice of Actual Construction or Alteration, be completed and returned to this office any time the project is abandoned or: At least 10 days prior to start of construction (7460-2, Part I) X Within 5 days after the construction reaches its greatest height (7460-2, Part I1) This determination expires on 02/15/2013 unless: (a) extended, revised or terminated by the issuing office. (b) the construction is subject to the licensing authority of the Federal Communications Commission (FCC)and an application for a construction permit has been filed, as required by the FCC, within 6 months of the date of this determination. In such case,the determination expires on the date prescribed by the FCC for completion of construction, or the date the FCC denies the application. NOTE: REQUEST FOR EXTENSION OF THE EFFECTIVE PERIOD OF THIS DETERMINATION MUST BE E-FILED AT LEAST 15 DAYS PRIOR TO THE EXPIRATION DATE. Any future construction or alteration , including increase to heights, power, or the addition of other transmitters, requires separate notice to the FAA. This determination does include temporary construction equipment such as cranes, derricks, etc., which may be used during actual construction of the structure. However, this equipment shall not exceed the overall heights as indicated above. Equipment which has a height greater than the studied structure requires separate notice to the FAA. This determination concerns the effect of this structure on the safe and efficient use of navigable airspace by aircraft and does not relieve the sponsor of compliance responsibilities relating to any law, ordinance, or regulation of any Federal, State, or local government body. Any failure or malfunction that lasts more than thirty (30) minutes and affects a top light or flashing obstruction light, regardless of its position, should be reported immediately to (877) 487-6867 so a Notice to Airmen (NOTAM) can be issued. As soon as the normal operation is restored, notify the same number. A copy of this determination will be forwarded to the Federal Communications Commission(FCC) because the structure is subject to their licensing authority. SE N TING VERIZON WIRELESS August 22,2011 Weld County Department of Planning Services Michelle Martin 1555 North 17rh Avenue Greeley, CO 80631 RE: SPECIAL REVIEW PERMIT #1777 — DEWAIN SHAPELY TRUST, c/o VERIZON WIRELESS, LLC Dear Ms. Martin, In response to the Resolution for USR1777 received July 20, 2011 I attach three sets of 24x36 Plat and three sets of 24x36 Drawings for your review Questions/issues raised by the Resolution arc addressed below and on the Plat and Drawings. 1.Prior to recording the plat: A.The plat shall be amended to delineate the following: 1) All pages of plat shall be labeled USR-1777.Verizon Wireless has added USR-1777 to each page of the Plat. 2) County Road 112 is designated as a Section Line road,which requires sixty (60) feet of right-of- way at full buildout.The applicant shall verify and delineate on the plat, the existing right-of-way and the documents creating the right-of-way. All setbacks shall be measured from the edge of future right-of-way.If the right-of-way cannot be verified, it shall he dedicated.This road is not maintained by Weld County. Page Two of the Plat specifies the 60' ROW. Please also see the Colorado Land Survey Monument Record containing the supporting documentation. 3) The applicant shall increase the size of the access easement to twenty (20) feet or provide documentation that the proposed fifteen (15) foot access width requirement has been cleared with the New Raymer Fire Protection District and Emergency Services, in regard to the width and weight capacity of the access lane to ensure it is adequate for emergency purposes. The proposed access easement has been increased to 20' —please see Sheet Two of the Plat and Sheets C2.0 and A2.0 of the drawings. 4)The applicant shall contact the Colorado Department of Transportation (CDOT) regarding the existing and future right-of-way for State Highway 71. The applicant shall verify with CDO'1', and delineate on the plat, die existing right-of-way and the documents creating the right-of-way. All setbacks shall be measured from the edge of future right-of-way. We spoke with CDOT and requested any future design modifications to the State Highway 71 ROW. CDOT indicated the existing 60' ROW has no plans for expansion. CDOT plans to maintain the 60' ROW as permanent. 5) The plat shall he prepared in accordance with Section 23-2-260.D of the Weld County Code. VZW has followed Section 23-2-260D in preparing the Plat. -2— August22,2011 6)The Use by Special Review (USR) boundary should include the 250-foot tower fall zone and access easement,or the applicant shall submit, to the Department of Planning Services, evidence of a recorded casement granted by the underlying property owner,which allows for the fall of the tower onto the burdened property and thereby meet the setback requirements of Section 23-4-83O.1).3.a. Sheet A2.O of the drawing set delineates the 250' fall zone. A Tower Fall Zone Easement was also executed by Dewain L. and Nancy E. Shapley and is included with this submittal.
