HomeMy WebLinkAbout20120138 • Exhibit H Deed and/or Ownership Information See the attached documentation. • • 2012-0138 EASEMENT FOR COMMUNICATIONS TOWER SYSTEM STATE OF COLORADO § COUNTY OF WELD § KNOW ALL MEN BY THESE PRESENTS: That the undersigned,the owner(whether one or more) of the legal and equitable title to the following described real estate situated In Weld County, State of Colorado, for and in consideration of the sum of TEN and NO/100 Dollars ($10.00) in hand paid by DCP Midstream, LP, and other good and valuable consideration, the receipt of which is hereby acknowledged, do(es) hereby grant and convey unto the said DCP Midstream, LP., whose address is 3026 4th Avenue, Greeley, CO 80631, an easement over, upon and across the following described real estate situated in Weld County, State of Colorado,to-wit: A tract of land located In the NW/4NW/4 of Section 21,Township 6 North,Range 62 West,6s' P.M.,as more particularly described In EXHIBIT"A"attached hereto and made a part hereof. with the right of ingress and egress to and from the same, for the purpose of constructing, inspecting, operating, maintaining and removing a communications tower system consisting of communications towers, poles, radios, antennas, wires, cables, guy wires, anchors, brace-poles, and other equipment and appurtenances, over, under, through and across said land and premises, and for the purpose of cutting, trimming and otherwise controlling the growth of trees and shrubbery that may interfere with or threaten to • endanger the operation and maintenance of said communications tower system. The undersigned hereby covenant and agree to grant and convey an easement and right-of-way to, and in a form satisfactory to Rural Electric Authority, an electrical company, authorized to provide service to said facilities. Grantee shall indemnify Grantor and hold Grantor harmless against any claim of liability or loss from personal injury or property damage, not due to the negligence or willful misconduct of Grantor or Grantor's agents,which may arise out of Grantee's lease of the Leased Premises and its operations thereon(including, without limitation, any liability arising under any federal, state or local 'environmental laws, rules or regulations), excepting, however, such claims or damages as may be due to or caused in whole or part by the acts of Grantor, or its agents and servants. In the event of Grantor's negligence or willful misconduct, Grantor shall so indemnify Grantee. In order to construct and operate the communications tower system, Grantee needs to obtain a subdivision exemption and use by special review permit ("USR") from Weld County. Grantor agrees to reasonably cooperate, at no cost to Grantor, in the preparation and submission of the applications for the subdivision exemption and USR (collectively referred to as the"Land Use Applications"). In the event either or both of the Applications is denied, this Easement Agreement shall terminate and all sums paid hereunder shall be returned to Grantee. IN THE EVENT that said communications tower system herein specified shall be abandoned, the easement granted shall terminate and Grantee will furnish a written release hereof. By "abandonment" is meant non-use of such communication tower system or other associated communication systems for more than twelve (12) consecutive months, provided that non-use by war, acts of God, rules or regulations promulgated by any Governmental body, Federal or State, having jurisdiction hereof, shall not constitute "abandonment'. • • TO HAVE AND TO HOLD such easement and right-of-way unto the said DCP Midstream, LP., its successors and assigns,forever.
