A Use by Special Review permit for a water storage and hauling site
The Weld County Public Works Department received today the "Traffic Study for the Noble
Energy Carpio Water Depot" submitted by Baseline Engineering. The submitted study does not
meet the requirements of the Traffic Impact Study checklist and is incomplete; additional
information is required before Public Works can make any recommendation regarding this Use
by Special Review project. The staff comments below may not be all-inclusive, as other issues
may arise following re-submittal of an adequate traffic study.
COMMENTS:
1. The applicant was provided a copy of the County's Traffic Impact Study checklist along
• with the Public Works referral dated December 13, 2011. The Traffic study submitted by
the applicant is incomplete and does not include information requested in the checklist
and required for all traffic studies.
2. Preliminary documentation by the applicant proposed 800 water haul truck trips (400
roundtrips) per day on Weld County Road 57, a local gravel road with less than 200
vehicles per day. However this important total proposed traffic information was omitted
from the submitted study. The Traffic Impact Study needs to include the proposed truck
volumes that will impact the currently unpaved WCR 57. 800 water haul truck trips per
day is one of the most significant impacts of this project and must be described and
mitigation proposed. The Traffic Study needs to include the total truck traffic volumes
and specify that paving and maintenance will be provided.
3. The applicant has proposed two accesses to WCR 57, an entrance and an exit. These
are not mentioned in the submitted report. The Traffic Study should discuss these and a
sight distance analysis of these accesses should be included in the Traffic Impact Study.
4. In subsequent discussion with Baseline Engineering, the potential for trucks to exit the
site and travel southbound on WCR 57 was proposed. Mitigation for impacts to the
unpaved WCR 57 would be needed. Discussion of this option was not included in the
January 2012 Traffic Study, clarification is requested.
5. CDOT has been provided a copy of the January 2012 Traffic Study; they will provide
comment and their requirements regarding the need for acceleration/deceleration lanes
on the State Highway. Any revisions to the Traffic Study would be subject to CDOT
review and additional comments.
6. The proposed water depot must be assumed to be a permanent use with truck traffic
and other activities at the proposed maximums. The characterizations in the submitted
• report describe potential limited activities, possible reduced hours, and other potential
operating conditions, however, these were not formal proposals. Limits on the hours of
operation, hauling directions, and other restrictions should be formally documented in

the traffic study and set as Conditions of Approval in the USR Resolution considered for

SUBJECT: USR11-0026, Noble Water Site - Carpio
A Use by Special Review permit for a water storage and hauling site.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 57 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
There is 60 feet of unmaintained County Right-of-Way along the northern border of the site on the CR 66
section line (30' either side). This Right-of-Way shall be shown and labeled on the Plat.
The business has proposed two accesses for the site, an entrance and an exit. Appropriate signage is
required for these accesses. Large radiuses (65') are required at the access points to allow for large
• trucks turning into the site. Please show the approved accesses on the Plat and label them with the
Access Permit number(will be provided).
A vehicle tracking pad will be required for this site to prevent tracking of mud and debris onto the County
roadway. Our standard tracking pad consists of either 100 feet of pavement and a double cattle guard at
the exit of the site OR 300 feet of pavement.
The traffic proposed for this project is very high therefore a full engineered traffic study is required for this
project. The existing traffic on CR 57 was 102 vehicles/day in August 2006. The applicant is proposing
800 trips (400 roundtrips) per day. Public Works needs to know the breakdown of where this traffic is
going and coming from as these numbers will likely push any gravel roadways used for hauling over the
requirement for paving. The applicant will be required to enter into an Improvements and Road
Maintenance Agreement and pave their haul route from this site. CDOT will be provided a copy of the
traffic study as improvements on Hwy 392 will likely be required if that is the haul route.
There are 6 filling stations and an expected 17 trucks/hour filling at the site. How long does it take to fill a
truck? Please show and label enough staging areas for trucks waiting to be filled. No staging can take
place on the County roadway.
No truck parking or equipment storage is shown on this site therefore additional water quality measures
are not required.
One or more acres will be disturbed during the construction and development of this site therefore, the
applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the
Colorado Department of Public Health and Environment.
More than one acre will be disturbed therefore, a grading permit will be required prior to the start of
construction. The grading permit application must contain: an erosion and sediment control plan, a
• grading plan, installation details of all BMPs to be utilized, typical installation and maintenance notes for
all BMPs to be utilized, and a copy of the approved CDPHE stormwater permit.

• This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Provide a Traffic Study signed and stamped by a Professional Engineer licensed to practice in the
State of Colorado following the checklist available on the Public Works website.
2. Show the approved access points on the Plat and label them with the Access Permit number(will
be provided).
3. Show and label appropriate access signage for the entrance and exit as well as truck turning
radiuses.
4. Show and label the truck staging area and address questions as to how many trucks may be
staged to fill at any one time.
5. A vehicle tracking pad consisting of 300 feet of pavement or 100 feet of pavement plus a double
cattle guard is required at the exit from the site.
6. An Improvements and Road Maintenance Agreement including paving of the haul route is
required. Any haul route improvements along with possible improvements required at Hwy 392
will be determined after the traffic study has been received and reviewed.
7. The applicant shall obtain a stormwater discharge permit from the Water Quality Control Division
of the Colorado Department of Public Health and Environment.
• 8. A grading permit will be required prior to the start of construction. The grading permit application
must contain: an erosion and sediment control plan, a grading plan, installation details of all
BMPs to be utilized, typical installation and maintenance notes for all BMPs to be utilized, and a
copy of the approved CDPHE stormwater permit.
9. Add the following notes to the plat:
a. There shall be no parking or staging of vehicles on County roads.
b. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
c. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.

COLORADO DATE: DECEMBER 19, 2011
Environmental Health Services has reviewed this proposal for the construction of a 4
acre water storage pond for oil and gas support and service. At peak demand, up to
396 truck tanker loads per day could occur. Employees accessing the site will be water
contractor drivers and occasionally Noble Energy employees or sub-contractors to
perform maintenance on the pond or pump.
The site is served by an existing 1-1/2" domestic water tap by North Weld County Water
District. The applicant is working with the District to upgrade the existing tap to 4" for
filling the pond. The applicant provided an "able to serve" letter from the District, dated
• 9/27/11.
There is an office building proposed for this site; however, it is not anticipated to be
constructed with the initial development. The applicant is proposing to use portable
toilets in lieu of providing permanent water and sewage disposal for drinking and
sanitary purposes. Permanent drinking water and sewage disposal facilities are
required for employees accessing the site. An engineered designed septic system is
required.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
Policy 2.2.K Use of Portable Toilets
Purpose: To define when Portable Toilets may be used in lieu of a vault or
septic system.
Policy: Portable toilets may be utilized on sites for temporary and seasonal use
for up to six months as part of the Temporary Seasonal Permits issued by Weld
County Planning for situations such as fireworks stands, Christmas tree stands,
seasonal recreational facilities, etc.
•
As noted above, it is the policy of this department that portable toilets are allowed when
the use is temporary or seasonal for a time period of six months or less. As the
business is conducted year round, the use of portable toilets is not allowed as the
facility is not a seasonal use.
The applicant submitted a dust abatement plan and was found to be adequate. Access
drive will be covered in gravel. On-site speed will be controlled to less than 10 mph and
speed limit signs will be posted. Water will be applied to mitigate dust when necessary.
The applicant submitted a waste handling plan describing procedures for clean up and
disposal of contaminated soil from motor vehicle oil leaks. The applicant needs to
provide the waste handler and disposal site for removal of any trash and garbage
generated at the site. No chemicals will be stored or used at the site.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado •
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum the waste handler
and facility where trash and garbage will be disposed (including the facility name,
address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. The applicant shall submit evidence of a Colorado Discharge Permit System or
CDPS permit from the Colorado Department of Public Health and Environment
(CDPH&E), Water Quality Control Division, to cover stormwater discharges from
construction sites (5 CCR-1002-61). Alternately, the applicant can provide
evidence from CDPH&E that they are not subject to the CDPS requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and •

• Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust
abatement plan", at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in
the Commercial Zone as delineated in Section 14-9-30 of the Weld County
• Code.
7. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and contractors of the facility, at all times.
8. Any septic system located on the property must comply with all provisions of
the Weld County Code, pertaining to Individual Sewage Disposal Systems.
9. A permanent, adequate water supply shall be provided for drinking and
sanitary purposes (North Weld County Water District).
10.Adequate toilet facilities (portable toilets) and hand washing units shall be
provided during the construction of the facility.
11.Bottled water shall be utilized for drinking during construction of the project.
12.The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

feet deep and will be lined. Upon completion of the pond but prior to lining, the applicant should contact the

Hello
