Mark also communicated to David that he would be notifying CDPHE of the existence of the south RV Park as a public Drinking water system . CDPHE sent out a information request letter dated June 29, 2011 in which Greeley RV park staff failed to respond by the deadline ( 14days ) or by any means . Mark also notified Planning staff of the issue on June 28, 2011 . March 9, 2012 : Site visit by Mark Thomas and Mary Evett, Environmental Health Services to investigate noncompliance of the Greeley RV Campground public water supply and method of wastewater disposal for the RV campground . March 10, 2012 : Mark Thomas and Mary Evett met with Doug Camrud and Bret Icenogle, WQCD of CDPHE, at site to investigate noncompliance of the campground 's water system and the sewage discharge ; Matthew Ness present . March 12, 2012 : Mark Thomas, Mary Evett — Department of Public Health & Environment, Heidi Hansen — Department of Public Works, Wendell Heyen — Weld County Building Official & Chris Gathman — Department of Planning Services conducted a site visit of the USR - 1431 property. Timeline ( Cont ) : March 12, 2012 Mary Evett contacted the City of Greeley regarding sewer availability. According to the City of Greeley Water and Sewer Department, the residence on the property is connected to sewer. There is a 36" trunk line that is located on the property at 830 E 28th St . Greeley Sewer emailed a map of the sewer line location . Ken Starman , Front Range Septic, 970-381- 2438, contacted Mary Evett to inform that his company was hired to pump the sewage from the 2 tanks at the Greeley RV Campground South . The sewage will be disposed of either at Fort Collins wastewater treatment plant or McDonald Farms facility. Mr. Starman will provide copies of the pump receipts to WCEHS . March 13, 2012 Chris Gathman e- mailed a pre-application request form was e - mailed along with a copy of the USR- 1431 plat . March 14, 2012 Mary Evett contacted Doris Biehl , City of Greeley Water and Sewer Services Coordinator regarding the City's ability to provide sewer and water service for the campground ; Ms . Biehl informed staff that the Greeley is able to provide sewer service, but the property will require annexation . March 15, 2012 Probable Cause Hearing Letter notice drafted and hand delivered to Mary Ness — Greeley RV Park Office Manager By Mary Evett . A copy of a pre -application request form was also delivered to Ms . Ness . Mary Evett verified the capping of the septic system and pumping activities . Timeline ( Cont : ) March 19, 2012 Mark Thomas met with CDPHE staff (Jon Erickson and Thomas Valenta ) at the site for a Sanitary survey of the Drinking water system . During the survey mainly administrative violations were noted , ie . Permitting, design review, monitoring plan, sampling plan, cross connection control plan , etc; ; CDPHE 's report is in process; March 20, 2012 Matthew Ness submitted a pre- application meeting request application to the Department of Planning Services . March 21, 2012 A pre-application meeting was held with Mr. Ness and attended by Ms . Hansen, Ms . Evett, Mr. Thomas, Mr. Gathman , and Frank Piacentino — Weld County Building Inspection . The alleged noncompliance issues were discussed and actions required to come into compliance . Stockpiles of materials will need to be removed from the floodplain , building permits are required for the " man camp" facilities; The RVs and " man camp" facilities are located within 400-feet of a City of Greeley sewer line and would require connection to the sewer line unless the City of Greeley provides written evidence that they cannot or will not provide sewer service to the site . Additionally the property is located entirely within the 208 boundary for the City of Greeley. Mr. Ness was encouraged to contact the City of Greeley Water & Sewer Departments and Planning Departments regarding this matter. March 22, 2012 Mr. Gathman e- mailed Brad Mueller & Darrell Gesick — City of Greeley Planning Department informing them that Mr. Ness may be visiting with them about sewer service & annexation . Timeline ( Cont : ) March 26, 2012 Probable Cause Hearing — Board of County Commissioners Determined that probable cause was demonstrated that the applicant was not in compliance with USR- 1431 development standards 3, 6, 7, 8, 12, 14, 15 , 16, 20, 27 and 28 and scheduled a Show Cause hearing for May 1, 2012 . April 13, 2012 Application form for Drinking Water Construction Approval submitted to the Colorado Department of Public Health & Environment . April 25, 2012 A draft Minor USR Amendment application submitted to the Department of Planning Services for review. April 27, 2012 Chris Gathman spoke with Brad Mueller — Planning Director, City of Greeley about potential for annexation of the USR - 1431 property. April 30, 2012 Mary Evett visited and took pictures of the USR- 1431 site . April 30, 2012 Trevor Jiricek - Director — Environmental Health & Planning Services, Heidi Hansen, Mary Evett & Chris Gathman met with Marlin & Matthew Ness to discuss the Minor USR Amendment request, remaining steps to address compliance of USR- 1431, options to address compliance of USR- 1431 and the applicants plans to address USR- 1431 . April 30, 2012 Chris Gathman visited and took pictures of the USR - 1431 site . Timeline ( Cont . ) May 2, 2012 E - mail response from City of Greeley indicating providing sewer to the facility is not feasible . May 2, 2012 Show Cause Hearing — Show Cause hearing continued until October 3 , 2012 to allow the applicant time to proceed with minor amendment or submit an amendment application for " Man Camp" units; May 3, 2012 Mary Evett & Chris Gathman met with Matt Ness to discuss the remaining items to be submitted for the Minor USR Amendment application . June 26, 2012 Drinking water system approved by the Colorado Department of Public Health & Environment . July 23, 2012 MUSR12 - 0012 - Minor Amendment to USR- 1431 applied for : "! August 29, 2012 Site Inspection/Septic Inspection by Mary Evett . September 21, 2012 MUSR12 - 0012 - Minor Amendment to USR- 1431 — "! Minor ! mendment to a Site Specific Development Plan and Use by Special Review Permit USR- 1431 ( an RV Park and Storage and Recreation Area ) in the A (Agricultural ) Zone District to remove the development standards # 14 (All campers and recreation vehicles ( RV) using the facility must be full self- contained in regard to water and sewage ) and #15 (There shall be no disposal of sewage or any waste at this facility) to allow RVs to be connected to septic systems and a water system and to allow a future club meeting area/ restroom area ;" Conditionally approved by the Department of Planning Services . September 25, 2012 Request for a Pre -Application meeting submitted to amend USR - 1431 to allow row cabins along with indoor and outdoor storage . Development Standards ( Continued ) : Standard 14 All campers and recreation vehicles ( RV) using the facility must be fully self- contained in regard to water and sewage . Standard 15 There shall be no disposal of sewage or any waste water at this facility. Standard 16 Any future structures shall be served by an individual sewage disposal system that meets the minimum requirements of the County Code and a community water system . The facility shall obtain water and sewer service from the City of Greeley in the event that it is available . Standard 19 No development shall occur within the floodway of the South Platte River as delineated on the Federal Emergency Management Agency ( FEMA) National Flood Insurance Program Floodway Map Community Panel Number 080266 - 0010 dated September 28, 1990 . Standard 27 The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations . Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted . Any other changes shall be filed in the office of the Department of Planning Services . Standard 28 The property owner or operator shall be responsible for complying with all of the foregoing development standards . Noncompliance with any of the foregoing development standards may be reason for revocation of the permit by the Board of County Commissioners . EVIDENCE OF NON -COMPLIANCE WITH THE FOLLOWING DEVELOPMENT STANDARDS : ( 5/2/ 2012 Show Cause Hearing ) Standard 6 The historical flow patterns and run - off amounts will maintained on site in such a manner that will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run -off rate and velocity increases, diversions, concentration and /or unplanned ponding of stormwater run -off. Standard 7 All liquid and solid wastes, as defined in the Solid Wastes Disposal Sites and Facilities Act, 30- 20- 100 . 5, C . R . S . , shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination . Standard 8 No permanent disposal of wastes shall be permitted at this site . Standard 6 The historical flow patterns and run -off amounts will maintained on site in such a manner that will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run -off rate and velocity increases, diversions, concentration and/or unplanned ponding of stormwater run -off. Standard 7 All liquid and solid wastes, as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100. 5, C. R . S., shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination . Standard 8 No permanent disposal of wastes shall be permitted at this site . This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100. 5, C. R .S . Standard 12 Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. Standard 14 All campers and recreation vehicles ( RV) using the facility must be fully self-contained in regard to water and sewage . Standard 15 There shall be no disposal of sewage or any waste water at this facility. Standard 16 Any future structures shall be served by an individual sewage disposal system that meets the minimum requirements of the County Code and a community water system . The facility shall obtain water and sewer service from the City of Greeley in the event that it is available . Standard 19 No development shall occur within the floodway of the South Platte River as delineated on the Federal Emergency Management Agency ( FEMA) National Flood Insurance Program Floodway Map Community Panel Number 080266-0010 dated September 28, 1990. Standard 27 The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations . Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted . Any other changes shall be filed in the office of the Department of Planning Services. Standard 28 The property owner or operator shall be responsible for complying with all of the foregoing development standards. Noncompliance with any of the foregoing development standards may be reason for revocation of the permit by the Board of County Commissioners . STATUS UPDATE - 10 / 2 / 2012 • The applicant has made considerable progress toward compliance . The Applicant has installed septic systems to the satisfaction of the Weld County Health Department and the Water system has been approved by the Colorado Department of Public Health and Environment . The applicant has also been conditionally ( staff approved ) for a Minor Amendment to his USR to allow on site septic disposal and water systems . The piles of asphalt and vehicles have been removed from the floodplain/floodway. Six ( 6 ) Modular " man camp" units have been removed from the site; The Two Outstanding Items are : 1 ) Five ( 5 ) modular " man camp" units are still located on the site; 2 ) The USR Minor Amendment conditions need to be finalized and the Minor USR Amendment plat needs to be submitted for recording ( applicant has 120 days from 9/21/2012 to get this done ) . If it is determined that fecal contamination exists within the source, he system may he required to meet the above conditions on a continuous basis until the source of contamination can be identified and removed if the system continues to use the source. USR-1431 was approved for a total of 200 recreational vehicle (RV) pad sites for camping and up to 20 RV's/boats for onsite storage. Per the development standards of USR-1431 (Development Standards#14 and #15) all campers and RVs must be self contained in regards to water and sewage and there shall be no onsite disposal of sewage or waste at this facility. The applicant is proposing to have a sewage disposal system on the property along with a water system connected to a well and is requesting that Development Standards#14 and#15 be removed. Additionally the applicant is proposing an additional building to be used as a dub/rneeting room. It should be noted that the existing well permit on the property (permit # 67901-F) is permitted for up to 48 RVs and would require re- permitting if the applicant intends to add additional RVs. Staff has attached a development standard to address this item. THE DEPARTMENT OF PLANNING SERVICES' DIRECTOR RECOMMENDS APPROVAL OF THIS APPLICATION FOR THE FOLLOWING REASONS: 1. The proposed change(s) will be compatible with existing and allowed uses in the surrounding area and be in harmony with the neighborhood. The proposed change will not change the use • (with the exception of the septic system connections and the water system) substantially from MUSR12-0012-Ness,PAGE 3 • what was originally approved under USR-1431. The number of campers and RVs allowed to this site will not change under this proposed minor amendment. 2. The proposed change(s) is consistent with the County Comprehensive Plan pursuant to Chapter 22 of the Weld County Code. Section 22-2-10 2.&Policy 7.2. of the Weld County Code states: "Conversion of agricultural land to nonurban residential, commercial and industrial uses should be accommodated when the subject site is in an area that can support such development,and should attempt to be compatible with the region." The site is already approved for up to 200 RV sites and 20 storage sites. The number of RVs allowed under this minor amendment will not change from what was approved under USR-1431. The impacts of this minor amendment on the existing use will be minimal. 3. The proposed change(s) will not result in a substantial adverse impact on the other property in the vicinity of the subject property. No phone calls, letters or correspondence have been received from property owners in regards to this case. The impacts to the surrounding properties in the area will not change and/or increase beyond the existing USR. 4. The recommendations of the referral agencies have been considered. Recommendations from referral agencies have been attached as conditions of approval and/or development standards. All referral agencies have either indicated no conflict/concems or have recommended approval with conditions. 5. The proposed change is not deemed to be a major change.
