Long Chair, Weld County Federal Mineral Lease District Budget Message Service: The Weld County Federal Mineral Lease Act District (the "District") was established on August 17, 2011, nunc-pro-tunc, June 29, 2011, by the Board of County Commissioners of Weld County. The District Board shall distribute, on an annual basis, all of the funding that the District receives from Colorado Department of Local Affairs (DOLA), except such funds as expended or reserved for administrative expenses, as permitted by C.R.S. § 30-20-1307 (I)(b), to areas within the unincorporated areas of Weld County that are socially or economically impacted by the development, processing, or energy conversion of fuels and minerals leased under the Federal "Mineral Lands Leasing Act" of February 25, 1920, as amended. The term, "impact," as referred to herein, shall be limited to the impact (creating a need for improvements and/or maintenance) to Weld County Roads caused by such development, processing, or energy conversion of fuels and minerals leased under the Leasing Act. In doing so, the District Board may review any reports or studies made, or may seek any additional reports or studies it deems necessary, regarding the distribution of funding in the District. The term, "on an annual basis", as referred herein, shall mean within one year from the date the funds are actually received from DOLA. After the annual receipt of Federal Mineral lease funds, the District Board shall solicit projects to fund from eligible entities which fit the above criteria. The District Board may cooperate or contract with any individuals or entities, and any governmental entity, and any other district formed under the Act,through the intergovernmental agreement("IGA") process authorized by C.R.S. § 29-1-201 et seq., and the Colorado Constitution to provide any function or service, including without limitation, administrative or treasury functions lawfully authorized to each of the cooperating or contracting districts, including the sharing of costs, as long as the cooperation or contracts are authorized by each district with the approval of each districts board of directors. Any such contract shall set forth fully the purposes, powers, rights, obligations, and responsibilities, financial or otherwise, of the contracting parties. Where other provisions of law provide requirements for special types of intergovernmental contracting or cooperation, those special provisions shall control. The Weld County Federal Mineral Lease District is a separate legal entity responsible for the administration of all of the funding that the District receives from Colorado Department of Local Affairs for the purpose distributing the funds to areas within the unincorporated areas of Weld County that are socially or economically impacted by the development, processing, or energy conversion of fuels and minerals leased under the Federal "Mineral Lands Leasing Act" of February 25, 1920, as amended ("the Leasing Act"). The primary funding resource for the District is the funds it receives from the Colorado Department of Local Affairs from the Federal "Mineral Lands Leasing Act" of February 25, 1920, as amended. Per the Colorado Department of Local Affairs since all the revenue for the District is from a federal source the District is not subject to TABOR revenue or property tax limitations. Therefore, no three- percent TABOR reserve is required since the TABOR revenue amount to calculate the reserve is zero. Budgetary Accounting Basis: The Basis of Accounting refers to when revenue and expenditures or expenses are recognized in the accounts and reported in financial statements. The Basis for Accounting relates to the timing of the measurements made regardless of the measurement focus applied. Revenue and expenditures or expenses are accounted for using a modified accrual method. This method recognizes revenue in the year in which it becomes both measurable and available as net current assets or,when revenue is of a material amount, planned for but not yet received. Revenue in the modified accrual method primarily consists of the funds it receives from the Colorado Department of Local Affairs from the Federal"Mineral Lands Leasing Act"of February 25, 1920, as amended. Expenditures are generally recorded when the related fund liability is incurred. Lease-Purchase Agreements: The following supplemental data regarding lease purchase agreements involving real property pursuant to Section 29-1-104(2)(d), C.R.S., 1973, as amended: $ 0 A. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF THE WELD COUNTY FEDERAL MINERAL LEASE DISTRICT AND: Section 1. That estimated expenditures for the fund are as follows: Weld County Federal Mineral Lease District General Fund $ 845,882 Section 2. That estimated revenues for the fund are as follows: From unappropriated surplus $ -4,118 From sources other than general property tax 850,000 From general property tax levy 0 TOTAL REVENUES $ 845,882 Section 3. That the budget, as submitted, amended, and summarized above by fund, hereby is approved and adopted as the budget of the Weld County Federal Mineral Lease District for the year stated above. Section 4. That the budget hereby approved and adopted shall be signed by the Chairman of the District Board and made a part of the public records of the District. A copy of the proposed budget has been filed in the Weld County Office of the Clerk to the Board, located at 1150 O Street, Greeley, Colorado, where same is open for public inspection. The proposed budget will be considered at a regular meeting of the District Board to be held in the Pawnee Conference Room, located within the Weld County Administration Building, 1150 O Street, Greeley, Colorado 80631, on November 14, 2011, at 3:00 p.m. Any interested citizen within such Weld County Federal Mineral Lease District, which includes all of unincorporated Weld County, may inspect the proposed budget and file or register any objections thereto at any time prior to the final adoption of the budget.
