Mr.Conway,
I read about Weld County's dilemma with federal regulations restricting property owners rights to use
water for their agricultural use.Forgive this intrusion,but I have just learned of a method of addressing
your problem without the extraordinary legal expenses usually associated with federal regulations.
This method requires a local governmental policy-making body(e.g.,Weld County Commission)to
declare its own policy regarding water use/availability/regulation for agricultural purposes.Basically,
that's all there is to it.
Oh,yes.Then you notify the U.S.Department of Justice that the(fill in the federal agencies involved in
the restrictions)have violated the National Environmental Policy Act of 1970(NEPA).This act requires
all federal agencies to"coordinate"their policies in these matters with local governmental agencies,and
prevents them from implementing their own plans once a local agency invokes this protection.The key
here is the definition given to"coordinate"under federal law.
Since the"local government"is the victim here,your situation appears ideal for this type of approach,
usually used by environmental activists.What they don't know is-this law is designed to make the
"human environment"paramount among the requirements for an environmental impact study.
