BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
NOVEMBER 19, 2012
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Administration Building, Greeley, Colorado, November 19, 2012, at the hour of 9:00 a.m.
IE ROLL CALL: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Sean P. Conway, Chair
Commissioner William F. Garcia, Pro-Tem
Commissioner Barbara Kirkmeyer
Commissioner David E. Long
Commissioner Douglas Rademacher
Also present:
County Attorney, Bruce T. Barker
Acting Clerk to the Board, Tammy Waters/ Esther Gesick
Director of Finance and Administration, Monica Mika
IR MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County
Commissioners meeting of November 14, 2012, as printed. Commissioner Long seconded the motion,
and it carried unanimously.
IU CERTIFICATION OF HEARINGS: Commissioner Garcia moved to approve the Certification of
Hearings conducted on November 14, 2012, as follows: 1) USR12-0038, Wells Ranch, LLLP,
2) USR12-0053, Francisco Ramirez, and 3) USR12-0046, Nelson Ranches, Inc. Commissioner
Rademacher seconded the motion, which carried unanimously.
e AMENDMENTS TO AGENDA: There were no amendments to the agenda.
▪ PUBLIC INPUT: Doug Meyer, County resident and representative of American Stewards of
Liberty, referenced the use of Coordination in protecting personal property rights, and submitted
articles, marked Exhibit A.
El CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as
printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously.
PROCLAMATIONS:
P1 1) ALZHEIMER'S DISEASE AWARENESS MONTH - NOVEMBER, 2012: Chair Conway read
the certificate proclaiming November, 2012, as Alzheimer's Disease Awareness Month. Marcia
Schaeffer was present to accept the proclamation and shared statistics and resources available
through the Alzheimer's Association.

BIDS:
e 1) APPROVE BID #61200159, DFO/NINHYDRIN DEVELOPMENT CHAMBER-QTY 1 -
SHERIFF'S OFFICE/REGIONAL FORENSIC LAB: Monica Mika, Director of Finance and
Administration, reviewed staff's recommendation and answered questions from the Board regarding the
life expectancy of the fingerprinting equipment, as well as how equipment will be purchased in the
future once the Regional Crime Lab is in place. Commissioner Rademacher moved to approve the low
bid from Air Science USR, LLC, as recommended by staff. Commissioner Long seconded the motion,
which carried unanimously.
NEW BUSINESS:
E 1) CONSIDER MEMORANDUM OF UNDERSTANDING FOR THE ASSIGNMENT OF A
MEDICAID INTAKE SPECIALIST TO CENTENNIAL ELEMENTARY SCHOOL AND AUTHORIZE
CHAIR TO SIGN - SCHOOL DISTRICT 6: Judy Griego, Director, Department of Human Services,
reviewed the terms of the memorandum of understanding. Commissioner Long moved to approve said
memorandum of understanding and authorize the Chair to sign. The motion was seconded by
Commissioner Garcia, and it carried unanimously.
▪ 2) CONSIDER CHILD PROTECTION AGREEMENT FOR SERVICES AND OFFICE LEASE
AND AUTHORIZE CHAIR TO SIGN - PAID IN FULL, INC.: Ms. Griego reviewed the terms of the
agreement. Commissioner Rademacher moved to approve said agreement and authorize the Chair to
sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously.
El 3) CONSIDER STATEMENT OF WORK FOR PERTUSSIS RESPONSE IMMUNIZATION
FUNDING AND AUTHORIZE CHAIR TO SIGN: Dr. Mark Wallace, Director, Department of Public
Health and Environment, reviewed the terms of the statement of work and answered questions from the
Board concerning school and daycare center outreach programs. Commissioner Garcia moved to
approve said statement of work and authorize the Chair to sign. The motion, which was seconded by
Commissioner Long, carried unanimously.
E 4) CONSIDER TASK ORDER AMENDMENT #1 FOR THE CORE SERVICE IMMUNIZATION
PROGRAM AND AUTHORIZE CHAIR TO SIGN: Dr. Wallace gave a brief overview of the amended
immunization program. Commissioner Garcia moved to approve the task order amendment and
authorize the Chair to sign. Commissioner Long seconded the motion, which carried unanimously.
e 5) CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES - FREDERICK WEST
RV STORAGE, LLC: Christopher Woodruff, Assessor, presented staff's recommendation for the 2010
and 2011 tax years and answered questions from the Board. Chair Conway confirmed a representative
of the petitioner was not present. Mr. Woodruff responded to further questions from the Board
concerning the comparable data. Commissioner Rademacher moved to deny the petition, as
recommended by staff. Commissioner Garcia seconded the motion, which carried unanimously.
6) CONSIDER TEMPORARY CLOSURE OF CR 46 BETWEEN 1-25 SERVICE ROAD AND
CR 13: Janet Carter, Department of Public Works, reviewed the provisions of the closure and
answered questions from the Board. Commissioner Rademacher moved to approve said temporary
closure. Seconded by Commissioner Garcia, the motion carried unanimously.

e 7) CONSIDER NONEXCLUSIVE LICENSE AGREEMENT CONCERNING INSTALLATION OF
IRRIGATION PIPE AND AUTHORIZE CHAIR TO SIGN - JARRED SATER: Ms. Carter reviewed the
terms of the agreement and answered questions from the Board concerning right-of-way widths.
Commissioner Rademacher moved to approve said agreement and authorize the Chair to sign. The
motion, which was seconded by Commissioner Kirkmeyer, carried unanimously.
8) CONSIDER SMALL TRACT OIL AND GAS LEASE AND AUTHORIZE CHAIR TO SIGN -
SYNERGY RESOURCES CORPORATION (S2, T4N, R68W - 1.0 ACRE): Bruce Barker, County
Attorney, reviewed the terms of the small tract lease. Commissioner Garcia moved to approve said
lease and authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it
carried unanimously.
9) CONSIDER SMALL TRACT OIL AND GAS LEASE AND AUTHORIZE CHAIR TO SIGN -
SYNERGY RESOURCES CORPORATION (S2, T4N, R68W - 3.015 ACRES): Mr. Barker gave a brief
summary of the lease terms. Commissioner Long moved to approve said small tract lease and
authorize the Chair to sign. Commissioner Garcia seconded the motion, and it carried unanimously.
e 10) CONSIDER SMALL TRACT OIL AND GAS LEASE AND AUTHORIZE CHAIR TO SIGN -
AED GROUP, LLC (S1/2, S24, T8N, R62): Mr. Barker reviewed the terms of the lease. Commissioner
Rademacher moved to approve said small tract lease and authorize the Chair to sign. The motion,
which was seconded by Commissioner Kirkmeyer, carried unanimously.
El 11) CONSIDER SUBMISSION OF PETITION FOR DESIGNATION OF HAZARDOUS
MATERIALS ROUTE TO COLORADO STATE PATROL AND AUTHORIZE CHAIR TO SIGN:
Mr. Barker stated the intent of the petition is to allow the transport of crude oil on CR 49 from
U.S. Highway 34 to U.S. Highway 76 without the use of placards and alternate routes. Ms. Carter
answered questions from the Board regarding the requirement for continuous sections of roadway.
Commissioner Rademacher moved to approve the petition and authorize the Chair to sign.
Commissioner Kirkmeyer seconded the motion. Chair Conway expressed his disappointment with the
lack of response from the Colorado State Patrol in regard to this matter. There being no further
discussion, the motion carried unanimously.
El 12) CONSIDER VETERANS SERVICE OFFICERS MONTHLY REPORT AND CERTIFICATION
OF PAY FOR OCTOBER, 2012, AND AUTHORIZE CHAIR TO SIGN: Ms. Mika reviewed the monthly
Veterans report, commended the work of the staff, and recommended approval. Commissioner Garcia
moved to approve the report and certification and authorize the Chair to sign. Seconded by
Commissioner Kirkmeyer, the motion carried unanimously.
e 13) SECOND READING OF CODE ORDINANCE #2012-11, IN THE MATTER OF REPEALING
AND RE-ENACTING, WITH AMENDMENTS, CHAPTER 3 HUMAN RESOURCES, OF THE WELD
COUNTY CODE: Commissioner Rademacher moved to read Code Ordinance #2012-11 by title only.
Commissioner Garcia seconded the motion, which carried unanimously. Patti Russell, Director,
Department of Human Resources, confirmed there have been no changes since the first reading and
she answered questions from the Board. No public testimony was offered concerning this matter.
Commissioner Garcia moved to approve Code Ordinance #2012-11 on second reading. The motion
was seconded by Commissioner Kirkmeyer and it carried unanimously.

PLANNING:
e 1) SECOND READING OF CODE ORDINANCE #2012-7, IN THE MATTER OF REPEALING
AND RE-ENACTING, WITH AMENDMENTS, CHAPTER 29 BUILDING REGULATIONS, OF THE
WELD COUNTY CODE: Commissioner Garcia moved to read Code Ordinance #2012-7 by title only.
Commissioner Kirkmeyer seconded the motion, which carried unanimously. Wendell Heyen, Building
Official, stated there have been no changes since first reading. No public testimony was offered
concerning this matter. Commissioner Kirkmeyer moved to approve Code Ordinance #2012-7 on
second reading. The motion was seconded by Commissioner Long and it carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinances #2012-7 and #2012-11 were approved on second reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 9:50 a.m.

added to the endangered species list. Not only did we stop it,we removed it from the candidate list
that it had been on since 1993.

This fight has been described as the next Spotted Owl. It's that serious and widespread. If we
don't stop this listing, we will lose two key natural resource industries—livestock grazing and oil
and gas production-in 11 states!
Fortunately, we have been quietly working with Garfield County, Colorado, which has engaged the
federal agencies through coordination, but now, we have to take this to another level.
Whether you are in the cross hairs of this species listing or not, you will be affected and we need
your help. It is the potential endangered listing of the greater sage-grouse.
