RE: ACTION OF THE BOARD CONCERNING FINAL DETERMINATION HEARING TO
RESCIND RESOLUTION #2000-3110, DATED JANUARY 3, 2001, AND DENY
APPLICATION FOR USE BY SPECIAL REVIEW PERMIT #1297 - BRADLEY AND
HEIDI WINDELL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on January 3, 2001, the Board approved the application of Bradley and
Heidi Windell, 11044 County Road 22.5, Fort Lupton, Colorado 80621, for a Site Specific
Development Plan and Use by Special Review Permit#1297 for a Single Family Dwelling Unit,
other than those permitted in the A (Agricultural) Zone District under Section 23-3-20.A of the
Weld County Code, on the following described real estate, being more particularly described as
follows:
Part 1A, Lupton Meadows Subdivision; being part
of the S1/2 of Section 12, Township 2 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Department of Planning Services notified the applicant of outstanding
Conditions of Approval and items to be completed prior to recording the plat, by letters dated
October 22, 2001, August 5, 2003, May 3, 2006, April 25, 2007, June 29, 2009, August 23,
2010, and September 21, October 16, and December 12, 2011, and
WHEREAS, on the 25th day of January, 2012, an Initial Hearing was held before the
Board to consider granting additional time to meet all of the conditions/requirements of approval
and record the plat, or set a Final Determination Hearing to Rescind approval of Use by Special
Review Permit#1297 and Deny the application, and
WHEREAS, at said hearing, Bradley and Heidi Windell were not present, and
WHEREAS, after hearing all testimony presented, the Board deemed it advisable to set
a Final Determination Hearing for March 26, 2012, to consider Rescission of approval of Use by
Special Review Permit#1297 and Denial of the application.
WHEREAS, on March 26, 2012, the Board of County Commissioners heard all of the
testimony and statements of those present, and all of the exhibits and evidence presented in
this matter, and having been fully informed, deems it advisable to refer the matter back to
Planning Services staff for processing.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the applicant has demonstrated a willingness and ability to
complete the process and record the place and the matter be, and hereby is, referred back to
Planning Services staff for processing.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 26th day of March, A.D., 2012.

There are two conditions of approval for this case:
1)The applicant shall improve the eastern access road, with the addition of gravel and grade to provide all-
weather access to the parcel. — The applicant indicates that this has been completed(though it has been a
number of years since the improvements were made).
2) Finalize the plat and submit for recording. — The applicant is making changes to the plat and requests 30-
days to finalize.
Staff Recommendation:
The applicant is requesting 30-days to complete this USR. Given that the only remaining items are
completing the plat(which we have met with the applicant about) and verification of the road
improvements—staff is in support of this request.

Thank you again for your time and concise explanation of the minor alterations needed to complete the

My notes from our meeting indicate the following needs.
1. County Commissioners title block without signatures (Plat Certificate)
2. Reduced location map showing local area
3. Revised right to farm code

Subject: 3rd Letter - Outstanding Conditions of Approval and Items to be Completed Prior to Recording
the Plat for Use by Special Review, USR-1297,
Dear Applicant:
The Planning Department is working through our historical case files in an effort to resolve unrecorded
and outstanding land use permits. You are receiving this letter because you have applied for a Use by
Special Review (USR) permit with Weld County but have never followed through the steps to complete
the process. You should have received letters from me in September and October concerning the same
topic.
On January 3, 2001, your application for a Use by Special Review was approved by the Weld County
Board of County Commissioners with specific Conditions of Approval. At this time the conditions of
approval have not been satisfied and a Mylar Plat has not been recorded with Weld County Clerk and
Recorder.
One of the required Conditions of Approval in the Board of County Commissioners resolution grants the
applicants thirty (30) days to submit a Mylar Plat, and provide written evidence that all conditions outlined
in the resolution have been completed. Should you choose not to complete the Use by Special Review
process and provide the required Mylar Plat, the Department of Planning Services requests written
notification of your decision to withdraw the application and that the use is not active on the property.
If you are unable to meet the Conditions of Approval and record the plat by January 25, 2012 an initial
hearing is scheduled with the Board of County Commissioners. The hearing will take place at the Weld
County Administration Building, located at 1150 O Street, at 9:00 am on January 25, 2012. It is strongly
encouraged that you attend this hearing. At this hearing the Board of County Commissioners has the
authority to grant additional time to meet all the conditions/requirements of approval and record the plat or
schedule a final determination hearing to rescind approval of Use by Special Review, USR- ,CS and

Regarding: Completion and Recording of Use by Special Review# 1297
Dear Mr. Kim Ogle,
Bradley T. Windell and Heidi G. Hynes-Windell and Trusts are interested in completing and recording the
above captioned Use by Special Review#1297.
I have been out of state specifically Port Townsend Washington only returning late last week. I had
asked that your certified letter be picked up from the post office not less than a week ago.
A review of our Use by Special Review file indicates that we have exchanged information regarding this
matter with Monica Michaels, Robert Anderson, Roger Peer, Roger Caruso, and yourself, all staff of the
Weld County Planning Department. Concurrently, while working with the individuals above our
surveyor Curt Acklam passed away and a replacement surveyor Joe Crow retired from surveying.
Additionally,we have employed two attorneys in this matter one who has passed away,Tom Houtchins
and another John Dent.
While working with the county and the small army of individuals above,we have also attempted to
complete this mater at three different Weld County Planning office locations. Specifically,the location
near the court house in down town Greeley, another on the north side of Greeley and the Delcomino
location on Interstate 125.
Likewise, we have exchanged information and attempted completion over a period of time spanned
nearly 10 years. During this 10 year period 20 letters have been written by Brad and Heidi with a
common theme. This specific theme has in more recent years been a request to meet and discuss the
matter by requesting a meeting between yourself and us (letter 2011).
While, we are not sure that we can complete this matter in your 60 day time frame we are very
interested in completing this permit without further delay. In order to complete this matter without
further delay we would like to have you call us at 303-442-4766 extension 102 with specific times when

you are available. Or, in the alternative, please contact us by mail with your office hours so that we
might set up a meeting with you.
We are not interested in meeting with any other staff and ask that you bring to our meeting the Weld
County Planning file given each person named above has changed, altered, and modified various
aspects of this permit application in ways that we do not agree, but are interested in discussing with
you.

Dear Applicant:

My husband, Brad Windell has been out of town on a project regarding Chevelon Creek
in Winslow Arizona. He will return on Tuesday, July 22 we believe in the afternoon. He

I have reviewed some parts of your plat. As of now there needs to be 7 changes.
1) Show 60' (30 ' each side) as Right-of-Way for CR 25.
2) I can not see your screening / landscape plan. Please provide a 24" x 36" plat for
review.
3) Are there oil and gas facilities on-site? If so please show setbacks per Weld County
Code Section 23-2-50.E.
4) Please add the Weld County Right to Farm statement per Appendix 22-E.
5) Add development Standards 1-12.
6) Show a scale for the vicinity map with a north arrow
7) Change the request to read "A Site Specific Development Plan and a Special Review
Permit for a Single Family Dwelling Unit, Other than Those Permitted under Section 31.2.1
in the Agricultural Zone District. "
Once these are complete please submit the required paper plat (two copies) to the
Department of Planning Services attn: Roger Caruso.
I will then check that over and if approved you may make a Mylar after that time for
recording.
I will also need verification through written response that item 2.A (improve the eastern
accces) has been completed. A site inspection will occur before recording of your plat.

Dear Kim Ogle
Please forgive us for having been unable to complete the above referenced USR Plat. As a brief reflection on what
happen please recall the following. The USR was approved and sometime after a plat commissioned with Acklam
Engineering. Thereafter Mr. Kurt Acklam passed away. More recently, we were contacted by the county and learned that
the plat was not completed. Later we submitted what paper work remained and that paper work was also incomplete and
unacceptable.
Soon after learning that the plat was incomplete and having learned that Mr. Acklam had passed away we followed up with
a group known as Flatirons Surveying whom was known to have some of the materials that Mr. Acklam had worked on.
After and exhaustive review of Flatirons documents from Acklam they were not found.
Nevertheless, rather than starting over we have contacted Joe Crow a local surveyor whom has worked on the property
over the years. Yesterday, we reviewed the work in his files and shared with him that information from Acklam. It is our
hope that Mr. Crow will be able to complete the USR in a timely manor.
We will visit with him again before weeks end in an attempt to put together a time line and answer any further questions
related to the matter.
Nevertheless, the purpose is to request an additional extension of time for the filing of the plat. While we realize that an
additional 60 days can be granted bt may need some additional time given the unique circumstances of this situation. We
will keep you breast of the activities as we proceed.
