The following are the Town of Grover's comments: The Town of Grover has received several referrals over the past year including the one mentioned above. Since we are responding to each one individually, we want to be fair to each case and convey the same concerns in order to look at the situation as a whole. Since the larger facilities are not up and running, and we do not know how many more facilities could possibly be developed in the area, it is difficult to know exactly what impact all of the facilities could have on the Town. Our main concern has been the water supply for the Town of Grover, and we have realized that there are differences in each facility including different distances from our wells, different aquifers, and differences in acre feet permitted through the State, and we are uncertain how each of these factors will affect the water table in the area. The Town of Grover has been monitoring the water table, and based on the historical data from the past two years, with our own water usage, the Everitt well in the area, and this well owned by Duggan, the water table has not been affected, but as larger facilities come in, we want to make sure the water table stays in check. We are also concerned about traffic and dust, and the size of each facility will affect this as well. Duggan, USR12-0047 Part NW4 of Section 4, T10N, R61W, 6th P.M.; Lot B RECX11-0035 Water Division 8, Water District 1 Dear Mr. Parko: This referral does not appear to qualify as a "subdivision" as defined in Section 30- 28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. According to the submitted information, the proposal is for a commercial water facility on Lot B of RECX11-0035. The proposed commercial water facility would supply groundwater to oil and gas companies via truck hauling. According to our records, a replacement of an existing well with permit no. 69713-F was approved June 14, 2012 and the approved location is within the NE1/4 of the NW1/4 of Section 4, Township 10 North, Range 61 West of the 6'" P.M. This office does not have evidence that the replacement well, permit no. 69713-FR, has been constructed. Well permit no. 69713-FR is permitted to withdraw 33 acre-feet per year from the Laramie aquifer based on the overlying 136-acre land area. The use of water under this permit is limited to commercial use in Weld County via truck hauling and is consistent with the applicant's proposed uses. According to our records the well has not been constructed, and the permit expiration date has been extended to August 9, 2012. Well permit no. 74396-F is permitted to withdraw 200 acre-feet per year from the White River aquifer based on the overlying 136 acres. The use of water under this permit is limited to commercial use in Weld County via truck hauling. Any new well permit applications would be evaluated pursuant to the applicable statutes and rules at the time they are submitted to this office.
