Nothing will be parked there.We will take care of trash and weeds.This is a small ag. Community.There is no small business in this area it is all big land owners but it is still very much a farming community.We have talked to the trucking company's about speeds and,farm machinery bring moved.We really believe in the right to farm and would do nothing to cause problems for all of our farming neighbors.We try very hard to get along with the neighbors.The closest neighbor house is one and one half miles. 3) It is zoned agriculture and will stay agriculture and there will be no impact except the trucks on the road and this is not a daily thing.We work hard on dust control.The water would be used to irrigate the fields or sold.So I see no impact. 4) A. People on this site are usually one or two at a time.Truckers who fill up there trucks and leave quickly. B. There will be no employees. C. The hours of operation will be twenty four hours and seven days a week. D.There will be no structures erected. E.There will be no animals on this site. Irrigation and Commercial well permit#69175 F I.There is no proposed septic.The truckers are not there very long and then they go to the oil well site where there are bathrooms.This is not an everyday operation.They come when they need water and sometimes they don't come for months as last summer from July until Nov.no one hauled one load of water. Recently we went three weeks selling no water and then on May 15th we sold five loads on the 16th two loads,four loads on the 17th,seven loads on the 18th, two loads on the 19ths.and then we missed several days. J No storage or warehouse. 5) The landscaping is gravel road into the site where there is a turn around.The weeds will be controlled. 6) This is not applicatably because it will continue to be ag land.The irrigation well will still be there so there would no change 7) There is no drainage problems.The only reason there would be water there is rain.The area is very flat and the water would soak away quickly.We have never had a rain big enough to cause water to set there. 8) No more construction. There will be no stockpile or storage of waste.A trash bin with a lid will be placed there and will be emptyed regularly. Traffic report: There should be no issues with the traffic because Weld County Road 136 dead ends there and Weld County Road 129 goes up to our pasture and Leonard's Grandfathers house that no one has lived in for at least twenty five years. It is not in good enough shape to live in. I went through the paper work and found one month that we had averaged ten loads per day most were three or four loads and them between July 2011 and October 24"'2011 there was no loads hauled at all. In May 2012 we had three weeks where we never sold one load of water and then I looked at the next week and seven was the maximum. If there was no oil wells drilled in the area there would be no water sold.There is only one way to access the property that is road 136. There is plenty of room to park semi trucks if there would happen to be more than one on the site at one time.They would not be on the county's road. Dust Abatement Plan We will have the water company's water the roads down,including the entrance and when they go past the two residences in the area they will water those areas down too.We have already been doing this. So anytime the wind is blowing and there is dust blowing toward the houses there will be water put on the roads.The first truck of the day will water if the wind is in the right direction and when the wind changes the trucks will water as needed.The trucks go by at 10 miles per hour.The neighbors have been pleased with speeds the trucks drive.Trucks have been asked to reduce speeds and watch for farm machinery. Waste Handling Plan We Have bought a large trash can with a lid and wired the trash can to the tank so it cannot blow away. It is secured to the property and we will remove the trash bags daily,or as needed. It is taken to our house where the trash company picks it up along with our trash. If there is trash on the ground we will pick it up and keep the area clean.We have secured the lid with a tarp strap so it will not blow off or the trash blow out. No vehicles or equipment will be washed on this site Regarding a motor vehicles or equipment oil leak,standard operating procedures are to dig up the contaminated soil and ship it to the Ault Waste Management Facility PRE11-0020 then tests and analyzes the remaining soil to be sure it is of contaminates.Once that is completed, PRE11-0020 back fills the previously contaminated area. No waste will be generated on the site. No chemicals will be stored on site.This site is only for loading water. W ITNESSETH: WHEREAS, Property Owner is the owner of, the following described property in the County of Weld, Colorado: Lot A of RECX12-0008 being part of the S '/ of Section 26, Township 12 North, Range 58 West of the 6th P.M., Weld County, Colorado and hereinafter referred to as "the Property," and WHEREAS, Property Owner has applied for a land use permit for a Water Hauling Facility, on approximately 2.5 acres on the above described real property, and the County is currently in the process of considering an Use-by-Special Review for the Property (USR12- 0044), and WHEREAS, the Property Owner acknowledges that the issuance of USR12-0044 is conditional upon approval by the Board of County Commissioners and upon Property Owner's performance of the on-site and off-site improvements which will be described in an Improvements Agreement and depicted on the Plat Map and the set of accepted Construction Plans provided by Property Owner, and WHEREAS, Property Owner acknowledges that it is currently engaged in business activities described in USRI2-0044 application without having been issued the appropriate permits, and that such action constitutes a violation of the Weld county Zoning Code,and WHEREAS, Property Owner agrees that upon the issuance of the USR Permit which it now seeks the Board of County Commissioners will require said owner enter into a permanent Road Maintenance and Improvements Agreement, which will supersede this Interim Agreement to perform road improvements and maintenance, and WHEREAS, Property Owner acknowledges that the trucking activities associated with it water hauling have caused and continue to cause damage to the roads used. Temporary Required Off-Site Road Maintenance 1.0 Off-Site Dust Control/Abatement Until such time as the USRI2-0044 permit is \L!PLAPJNING-nl?VPLOI'MIfNT RLVIPAVA-301?Planning Referral's AUSRI?VUSIt I?-0Wa Harms Water Dcpot?IHurms(USRL-004- ) PI NAI.Interim Road Agreement dots issued allowing Property Owner to conduct the Water Hauling Business, the Property Owner is required to provide or cause dust abatement along affected County Roadways as needed, as determined by the County. IF the Water Hauling Business USR application is approved, Property Owner shall be required to enter into The amount and extent of dust control will be determined by site-specific conditions at the time, as determined exclusively by County personnel. Property may use, but shall not be required to use more than 10.0% of the water sold at Property Owner's commercial water depot to prevent dust impacts from Property Owner's water sales and hauling activities. The Property Owner is required to contract with a private Water Spraying Service or other provider to spray impacted roadways on an as-needed basis, as determined by County personnel. B. Haul Routes: 1.0 Established Haul Routes: 1.1 Exiting or entering the site: Haul trucks shall enter or exit the site at the approved accesses onto CR 136. Haul trucks will travel: 1.1.1 west on CR 136 to CR 125 and then north to the County line or south on CR 125/124/127 to 110 to 111 for further dispersal east or west 1.1.2 CR 136 to CR 134 east to CR 135 to CR 132 to Hwy 71 for further dispersal north or south 1.1.3 or on other Haul Routes including any gravel County roads used by trucks utilizing proposed USR12-0044 facilities on a routine basis, as determined solely by County personnel. 1.2 No haul truck utilizing Property Owner's facilities may exceed CDOT required specifications for pounds per axle. 2.0 No Deviation from Permitted Haul Routes: No deviation in the use of any roads other than those specifically authorized for use in this Agreement is permitted without the prior written amendment of this Agreement. C. Road Maintenance Requirements: 1.0 Obligation to Maintain Current Haul Routes: Property Owner will be financially responsible for the excavation, repair, and patching of any damage on current haul route roads, which in the sole opinion of County has been created by hauling to and from the Property. Should Property Owner's site activities and/or should Property Owner's truck circulation patterns change in the future so that County approves an alternate haul route, and all or a significant portion of Property Owner's sourced traffic no longer utilizes the above-described haul route and instead utilizes other portions of County roads, Property Owner shall cooperate with County in maintenance of said roads which are included within the new haul route. The type and method of repair will be determined by the County Engineer or his representative. Repairs shall commence within 48 hours of notification by the County for any roadway damage that exposes the driving public to adverse or unsafe driving conditions. All other repairs shall commence within thirty (30) days of receipt of Weld County's written notice. 2 M:\PLANNING-DEVELOPMENT REVIEW\-2012 Planning Referrals\USR I2\USR12-0044 Harms Water Depot2Viazms(USRI2-0044) FINAL Interim Road Agreement.docx Need for Immediate Repairs: In the event of damage to an Approved Haul Route by Project traffic that causes an immediate threat to public health and safety or renders the road impassible ("Significant Damage"), County shall, after inspection, notify Applicant of such Significant Damage. Applicant shall identify the repair required and shall consult with County on the extent, type, timing, materials and quality of repair (i.e. temporary versus permanent) within twenty-four (24) hours after receipt of such notice and shall commence such repair within forty-eight (48) hours after receipt of such notice. If such repair is not commenced within such forty- eight (48) hour period, County shall have the right to draw on theCollateral and use such funds to perform such repair. If Applicant identifies Significant Damage prior to receiving notice thereof from County, Applicant may commence repair of such Significant Damage and shall concurrently notify County of the extent, type, timing, materials and quality of repair(i.e. temporary versus permanent). 2.0 Violation of Terms of Agreement: If Property Owner does not perform as outlined in this Agreement and Exhibits A and B such non-performance will constitute a violation of Property Owner's land use permits in review by County, and County will take whatever remedial measures it deems necessary, against Property Owner. In addition to any other remedy available to the County in law or equity, a failure to comply with this Agreement shall be considered grounds for a cease and decist order stopping the commercial business operating at the Property and/or possible denial of the Use By Special Review at the discretion of the Board of County Commissioners. D. Termination of Agreement: 1.0 Termination Event: This Agreement shall terminate upon the earliest of the following events: 1.1 Cessation of all Permit Related Activities. Termination of this Agreement shall occur upon Operator's complete cessation of all business activities at the property. A partial cessation of activities shall not constitute a Termination of this Agreement. Operator shall provide written notice to Property Owner and County of said cessation of activity,which County shall then verify. 1.2 Execution of "Improvements Agreement According to Policy Regarding Collateral for Improvements — USR12-0044" after USR12-0044 has been approved by the Board of County Commissioners. 2.0 Consequence of Termination by Cessation of Permit Related Activities: Following County's confirmation that Property Owner and/or Operator has/have ceased all permit related activities and has/have completed previously uncompleted Improvements and or completed any required road maintenance, County shall release Property Owner and/or Operator from all further obligations under this Agreement. E. Governmental Immunity: No term or condition of this agreement shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections or other provisions, of the Colorado Governmental Immunity Act §§24-10-101 et seq., as applicable now or hereafter amended. F. No Third Party Beneficiary Enforcement: It is expressly understood and agreed that the enforcement of the terms and conditions of this Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties, and nothing contained in this Agreement shall give or allow any claim or right of action whatsoever by any other person or entity not included in this Agreement. It is the express intention of the undersigned parties that any person or entity, other than the undersigned parties, receiving services or benefits under this Agreement shall be an incidental beneficiary only. G. Authority to Sign: Each person signing this Agreement, and associated Exhibits, represents and warrants that he or she is duly authorized and has legal capacity to execute and deliver this Agreement.
