RESOLUTION
RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 55 - LLOYD &
MARGARET ELDER.
WHEREAS, the Board of County Commissioners of Weld County,
c-) Colorado, pursuant to Colorado statute and the Weld County Home
N Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and

WHEREAS, the Board of County Commissioners of Weld County,

h Colorado, has reviewed the request of Lloyd and Margaret
Elder for an exemption from the definition of "subdivision"
and "subdivided land" in Section 30-28-101 (10) , CRS 1973, as
i � amended, and Section 2-1 of the Weld County Subdivision
= Regulations, and
WHEREAS, the Board of County Commissioners finds that
Mr. & Mrs . Elder are the owners of a parcel of land lying in
Part of the NEa of Section 31, Township 4 North, Range 68
West of the 6th P.M. , Weld County, Colorado. Mr. & Mrs. Elder
desire to gain approval to combine a four acre parcel with
an existing one acre parcel and house into one legal lot of
approximately five total acres. The legal descriptions for
the four acre tract, one acre tract and combined five acre
tract are set forth on Exhibit "A" being attached hereto and
incorporated herein by reference, and
WHEREAS, the Board of County Commissioners has considered
the recommendations of the Department of Planning Services on
this matter and has reviewed information submitted by the
applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the aforementioned
tracts of land owned by the applicant , be , and hereby are,
declared to be exempt from the definition of "subdivision" and
"subdivided land" as set forth in Section 30-28-101 (10) , CRS 1973 ,
as amended, and in Section 2-1 of the Weld County Subdivision
Regulations, and further finds that said tract shall be con-
sidered a single lot.
BE IT FURTHER RESOLVED by the Board that the remaining 62 acre
tract of land owned by the applicants, Lloyd and Margaret Elder,
be, and hereby is, declared to be exempt from the definition of

"subdivision" and "subdivided land" as set forth in Section 30-28-

and seconded, adopted by the following vote on the 15th day of

This letter is being written to request a subdivision
exemption on our farm located southeast of Berthoud, CO. We
presently have two parcels of ground, a one acre parcel and a
sixty-six acre parcel . We are requesting that the property
lines on the one acre be extended to a five acre parcel, thus
reducing the sixty-six acre parcel to a sixty-two acre parcel .
We are aware that this is a lot line adjustment and will
not create an additional parcel . Your consideration of this
request would be appreciated.
