HomeMy WebLinkAbout20123296.tiff HEARING CERTIFICATION DOCKET NO. 2012-92 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR12-0051, FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, INCLUDING AN OIL AND GAS SUPPORT AND SERVICE FACILITY (WATER SUPPLY AND STORAGE), IN THE A (AGRICULTURAL) ZONE -ANADARKO E & P COMPANY, LP A public hearing was conducted on November 28, 2012, at 10:00 a.m., with the following present: Commissioner Sean P. Conway, Chair Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer- EXCUSED Commissioner David E. Long- EXCUSED Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: ID I hereby certify that pursuant to a notice dated October 19, 2012, and duly published October 24, 2012, in the Greeley Tribune, a public hearing was conducted to consider the request of Anadarko E & P Company, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0051, for a Mineral Resource Development Facility, including Oil and Gas Support and Service Facility (water supply and storage) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. ID Chair Conway advised the applicant's representative, Nathan Keiser, that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or the matter will be deemed denied. Mr. Keiser indicated he would like to proceed today. El Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, surrounding land uses, and referral responses. He entered the favorable recommendation of the Planning Commission into the record as written and displayed maps and photographs of the site and surrounding area. Don Carroll, Department of Public Works, provided a brief overview of the transportation plans, access, roadway conditions, traffic counts, improvements requirements, stormwater/drainage improvements, and traffic impacts. He responded to questions from the Board regarding the surrounding roadways. Pot) 2012-3296 3 PL1183 HEARING CERTIFICATION -ANADARKO E & P COMPANY, LP (USR12-0051) PAGE 2 El Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, as well as the Dust Abatement and Waste Handling Plans. El Mr. Keiser reiterated the purpose of the project is to reduce the number of truck trips in the area related to oil and gas operations. He reviewed the work being completed to mitigate the deteriorated condition of the property, as well as the site layout. e In response to questions from the Board, Kim Cooke, applicant representative, stated they will continue to work with the City of Fort Lupton regarding annexation; however, it is not anticipated in the near future. Mr. Ogle explained Condition of Approval #5.G and Development Standard #30 were included by the Department of Building Inspection, which gives notice to the local fire protection district in the event of demolition/removal of structures, and the Board requested the language be clarified. ID No public testimony was offered concerning this matter. In response to Chair Conway, Mr. Keiser stated the applicant is agreeable to the Conditions of Approval and Development Standards, as proposed. Mr. Ogle proposed Condition of Approval #5.G and Development Standard #30 be modified to state, "A letter is required from the Fort Lupton Fire Protection District as to whether a fire permit will be required or the burning/demolition of the turkey sheds.", and the Board and applicant concurred. In response to Chair Conway, Mr. Keiser stated he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as proposed and modified. El Commissioner Garcia moved to approve the request of Anadarko E & P Company, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0051, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (water supply and storage) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included accepting the change to Development Standard #10 as recommended by the Planning Commission, and amending Condition of Approval #5.G and Development Standard #30 to state, "A letter is required from the Fort Lupton Fire Protection District as to whether a fire permit will be required or the burning/demolition of the turkey sheds." The motion was seconded by Commissioner Rademacher.
