Dear Commissioner Conway:
The Department of Local Affairs has completed its review of your application for Community
Development Block Grant (CDBG) funds for the above referenced project. Although I am not able to
fund your entire request, I am pleased to offer a grant award in the amount of $275,000 to assist the
County with their revitalization efforts for Espanola Subdivision. This offer is contingent on the state
receiving its 2012 CDBG allocation from HUD and the county achieving the following by August 15 ,
2012:
• The project is Categorically Excluded Subject to 24 CFR 58 .5 requiring the completion and
submission of the Statutory Checklist. Exhibit IV-C of the CDBG Guidebook available at
http://Bola.colorado.gov/dlg/fa/cdbg/index .html); and
• Completing and submitting the remaining CDBG application requirements (available at
www .dola.state.co.us/d1g/fa/cdbg/index.html#application) including conducting a public
hearing.
Upon completion of the above requirements, a final award letter will be issued and you can begin the
contracting process with the department. These funds may not be obligated before a grant contract is
fully executed. Expenditures made prior to the full execution of the contract cannot be reimbursed by
the state. Additionally, federal regulations prohibit obligating or expending CDBG funds until an
environmental review has been completed and funds formally released by the state.

I know you needed this information in August, and it is my responsibility for not delivering this to you in a timely
manner. You may or may not know, my direct Supervisor passed away in mid-July. Since then,the Public Works
Department has been reorganized and I find myself in a new role. I know excuses do not help you do your job, I just

Re: Spanish Colony Floodplain
The Spanish Colony (aka Espanola) neighborhood covers approximately 9.5 acres lying north of the
Cache La Poudre River. The neighborhood is located on FEMA's Flood Insurance Rating Map (FIRM
panel) #0802660628C issued September 28, 1982. As can be seen on the attached Firmette taken from
FEMA's website, the majority of the neighborhood lies in FEMA Zone C(outside the 100-year
floodplain). The intersection of M Street with 26th Avenue, lying at the southwestern most corner of the
Spanish Colony lies, in FEMA floodplain Zone B (the 500-year floodplain).
The property adjacent to the south of the Spanish Colony neighborhood is known as 'the park' (parcel
#080536100012) and is shown as lying in the "Current Effective" 100-year floodplain of the Cache La
Poudre River on FEMA's Flood Insurance Rating Map (FIRM)# 0802660628C. The park parcel
contains no permanent structures and is not proposed for improvements other than drainage.
Please sec the attached pdf of the floodplain taken from the more recent U.S. Army Corps of Engineers
mapping of the Cache La Poudre River floodplain in the area of the Spanish Colony. That newer map,
created based on 2003 survey and mapping, shows the limits of the Cache La Poudre River floodway
(dark blue), the 100-year floodplain (light blue) and the 500-year floodplain (yellow). The floodway
area (dark blue) on the U.S. Army Corps of Engineers' map can be seen to encroach into the lower
(southern) portion of the park parcel(parcel #080536100012).
It is FEMA guidance(44 CFR 60.3(b)(4)) and FEMA's Floodplain Management Bulletin 1-98, to use
the most recent floodplain mapping as "Best Available" information for development decisions in
floodplain areas. The U.S. Army Corps of Engineers mapping of the Cache La Poudre River is that
data.
Step 3 —Alternatives Analysis
a) The proposed Spanish Colony project consists of re-paving of existing streets and installation of
storm water drainage pipes and inlets. No building structures are proposed. As shown on the
attached Exhibits, the majority of new paving lies outside the 100-year floodplain except for the
intersection corner of M Street with 26th Avenue, lying at the southwestern most corner of the
Spanish Colony. The proposed paving and drainage improvements within that small area of
floodplain will be at or below the existing ground surface and so will not cause any additional
flooding risk on adjacent properties or on the Spanish Colony. The No-Action Alternative,
meaning no new paving and no drainage improvements, has the same result and also will not
cause any additional flooding risk on adjacent properties or on the Spanish Colony.

b) The project objective is to upgrade the existing pavement and provide drainage where there is no
facilities now. Feasible alternatives to the proposed project would be to remove the existing
pavement and re-pave without adding drainage improvements thereby risking that even moderate
intensity rainstorms would cause flooding into the existing homes. There is no way to provide
the project objective elsewhere.
c) The proposed project does not increase the risk to lives and property due of flooding. The
project will need to obtain a Weld County Flood Hazard Development Permit that demonstrates
that the proposed construction is compliant with State and FEMA floodplain regulations and
does not cause an increase in flood water elevation.
Step 4—Impacts of Floodplain occupation
a) The project objective is to upgrade the existing pavement and provide drainage improvements.
The construction will not raise the land surface and so the improvements will have no impact to
that small portion of the paving project lying within the floodplain. There are no wetlands in the
project area.
b) The construction will not modify the existing land surface elevations and so the improvements
will have no impact(negative or positive) to that small portion of the paving project lying within
the floodplain. There are no wetlands in the project area.
c) The project does not involve any wetlands.
Step 5 —Floodplain and Wetland Mitigation
a) Less than one-quarter acre of the project area lies within the 100-year floodplain. Because the
paving will be replacing existing deteriorated street payment, the project will not have negative
impacts to the floodplain. There are no wetlands in the project area.
b) The project preserves the existing floodplain condition. There are no wetlands in the project
area.
Step 6—Alternatives Evaluation
a) It is not possible to re-locate the project—there are 44 homes with deteriorated streets and no
drainage infrastructure. The project objective is to upgrade the existing pavement and provide
drainage improvements.

drainage improvements. This project does not include the acquisition of any land or homes.
The main goals of this grass roots project are to 1) remove heavily deteriorated existing road asphalt, 2)
install drainage improvements to safely convey storm water to the existing system;and 3) construct concrete
paved inverted crown road cross sections within the existing 30'subdivision rights-of-way.
The grant request requires us to notify all State divisions, which oversee the implementation of federal
regulations. Therefore, if you can respond by Monday, December 17'h letting me know you reviewed our
request and whether you have any concerns or concur with our assessment that no additional impacts will be
created by this project, I would greatly appreciate it!
I'm looking for feedback on page 2, section 3, more specifically, the items below. In addition, I'm attaching a
copy of the State Historical Society letter as a an example for you to see. Email suffices, but if you want to
send a letter that works also.
