RE: APPROVAL OF LETTER OF AGREEMENT BETWEEN BOARD OF COUNTY
COMMISSIONERS OF WELD COUNTY, COLORADO AND DOWNTOWN MER-
CHANTS ASSOCIATION CONCERNING USE OF CENTENNIAL CENTER
PARKING GARAGE.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Downtown Merchants Association has submitted
a request to the Board of County Commissioners of Weld County,
Colorado concerning the use of the Centennial Center parking
garage for public parking during the Christmas season, and
WHEREAS, a Letter of Agreement has been prepared between
the Board of County Commissioners of Weld County, Colorado and the
Downtown Merchants Association stating the provisions agreed upon
by said parties. A copy of said Letter of Agreement is attached
hereto and incorporated herein by reference at this point, and
WHEREAS, the Board of County Commissioners of Weld County
deems it advisable and in the best interests of Weld County to
approve said Letter of Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Letter of Agreement
between the Board of County Commissioners of Weld County, Colorado
and the Downtown Merchants Association concerning the use of the
Centennial Center parking garage for public parking during the
Christmas season be, and hereby is , approved.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 4th day of
December, A.D. , 1978 .

RE: Letter of Agreement between Board of Weld County
Commissioners and Downtown Merchants Association
for use of Centennial Center parking garage.
The Board of Weld County Commissioners agrees to the request
made by the Downtown Merchants Association for use of the
Centennial Center parking garage for public parking during
the Christmas season.
The following provisions represent the Board' s understanding
of items verbally agreed to between the Board and the
Merchants Association.
1) Dates of usage are: December 7, 8, 11, 12, 13, 14,
15, 18, 19, 20, 21, and 22nd, from 5:30 PM to 12:00 PM.
2) The Merchants Association agrees to pay the cost of an
additional security guard to be stationed in the parking
garage during those hours; the rate of pay will be
$4.00 per hour for a period of 78 hours.
3) The Merchants Association may place a sign outside the
garage entrance stating the times the lot is open to
the public.
4) No trucks, campers, pickups with camper shells higher
than the cab of the pickup, or other similar vehicles •
will be permitted in the garage. The Board requests
that the Merchants Association include in their sign
a prohibition of such vehicles.
5) Should it become apparent that the security of the
building cannot be assured under this arrangement,
the Board retains the right to cancel this agreement
prior to the expiration date of the stated time
period. The Merchants Association retains the right
to cancel this agreement should it determine that the
need for the additional parking does not exist.

Concerning your request for use of the parking lot on the corner
of 7th Street and 8th Avenue, the County does not lease that lot
after regular business hours; we would usggest that you contact
the owner of that property to request after-hours usage.
If the Merchants Association is in agreement with the stated
provisions, please return a signed copy of this agreement to
the Commissioners' Office. Mr. Adny Petruzzi , Buildings and
Grounds Superintendent, will act as the County's contact person
concerning this arrangement. Please get in touch with him as
soon as possible to work out specific details.

Subject: Parking for Christmas Shoppers
Per your request I contacted Don Franks concerning our general liability if
shoppers used our parking area at nights from now until December 30, 1978.
He in turn contacted the underwriters. They see no problem with our coverage
in that there is no way for the insurance company to exclude any activity on
County property, and our policy covers any and all activities.
If we had this arrangement year around, they would have to rate the parking
area as a commercial parking area, which would raise our premiums. However,
on a temporary basis it will have no rate or premium impact.
In short, we are covered from a liability point-of-view and have a clearance
to use the area as requested by the downtown merchants.

With the Christmas season rapidly approaching, and the busiest: time
of the year for the Downtown merchants upon us, we find that there is
again an evident parking problem.
We would therefore like to ask the cooperation of the County Commissioners
in checking on the feasibility of the following:
1. Allowing the Chuckwagon Dinner Playhouse, and other Downtown customers
�y�✓ the option of parking in the County parking lot each evening from
\l, \ J 5:30 p.m. , to 12:00 p.m. beginning November 27, through December 30,
