RE: APPROVAL OF AMENDED TWO-LOT RECORDED EXEMPTION, RECX12-0044
(FORMERLY LOT 2 OF MS-6) - ROBERT WARNER AND KERR-MCGEE
GATHERING, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Amended Two-Lot Recorded Exemption, RECX12-0044,
(formerly Lot 2 of MS-6) was submitted by Robert Warner, P.O. Box 9, Brighton, Colorado
80601, and Kerr-McGee Gathering, LLC, 1099 18th Street, Suite 1800, Denver, Colorado
80202, for property which is located on the following described real estate, to-wit:
Lot 2 of Minor Subdivision 9 - MS-6; being part of
the NW1/4, NE1/4, and W1/2SE1/4 of Section 14,
Township 2 North, Range 66 West of the 6th P.M.,
Weld County, Colorado
being more particularly described in the plat which shall be provided by the applicant and known
as Exhibit "A," said plat to be recorded, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the
Board, that a certain parcel of land, to be amended, as shown on the plat known as Recorded
Exemption, RECX12-0044, does not come within the purview of the definition of the terms
"subdivision" and "subdivided land," and
WHEREAS, this request is to amend Lot 2 of MS-6 to reduce the size from 392 acres, to
approximately 151 acres, and to legally divide the remaining acreage into four parcels through
subsequent review of a separate application for Four-Lot Recorded Exemption, RECX12-0045.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is,
exempt from the definition of the terms "subdivision" and "subdivided land."
BE IT FURTHER RESOLVED by the Board that the application of Robert Warner and
Kerr-McGee Gathering, LLC, for Amended Two-Lot Recorded Exemption, RECX12-0044, be,
and hereby is, approved subject to the following conditions:
1. Prior to recording the plat:
A. The applicant shall attempt to address the requirements of Colorado
Parks and Wildlife, as stated in the referral dated April 11, 2012.
B. The applicant shall address the requirements of the Department of Public
Works, as stated in the referral dated April 4, 2012, and submit a revised
access permit application.

C. The applicant shall provide the Weld County Department of Planning
Services with a Statement of Taxes from the Weld County Treasurer
showing no delinquent taxes exist for the original parcel.
2. Items to be included on the plat:
A. The plat shall be titled: Recorded Exemption No. 1309-14-2
RECX12-0044.
B. Show the approved accesses and label them with the Access Permit
number (will be provided upon submittal of a revised road access permit
application and approval by the Department of Public Works).
C. County Road 22 is designated on the Weld County Road Classification
Plan as an arterial road, which requires 140 feet of right-of-way at full
buildout. There is currently 60 feet of right-of-way. An additional 40 feet
from the centerline of County Road 22 shall be delineated on the plat as
future County Road 22 right-of-way. The applicant shall verify the
existing right-of-way and the documents creating the right-of-way and this
information shall be noted on the plat. All setbacks shall be measured
from the edge of future right-of-way. If the right-of-way cannot be verified,
it shall be dedicated. This road is maintained by Weld County.
D. The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback
and offset requirements for the Zone District in which the property
is located. Pursuant to the definition of setback in the Weld
County Code, the required setback is measured from the future
right-of-way line. No building or structure, as defined and limited
to those occupancies listed as Groups A, B, E, F,H, I, M, and R in
Section 302.1 of the 2006 International Building Code, shall be
constructed within a 200-foot radius of any tank battery, or within a
150-foot radius of any wellhead. Any construction within a
200-foot radius of any tank battery, or a 150-foot radius of any
wellhead, shall require a variance from the terms of the
Section 23-3-10 of the Weld County Code.
2) Any future structures or uses on the site must obtain the
appropriate zoning and building permits.
3) Prior to the release of building permits, the applicant shall submit
a recorded deed describing the Lot upon which the building permit
is requested with the building permit applications. The legal
description on such deed shall include the Lot designation and
Recorded Exemption number.

4) Prior to the release of building permit, the applicant shall submit
evidence of approval from the Fort Lupton Fire Protection District
to the Weld County Department of Building Inspection.
5) Should noxious weeds exist on the property, or become
established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II, of the
Weld County Code.
6) Building permits shall be obtained prior to the construction of any
building. Buildings that meet the definition of an Agricultural
Exempt Building, per the requirements of Sections 29-1-20
and 29-3-20.6.13 of the Weld County Code, do not need building
permits; however, a Certificate of Compliance must be filed with
the Department of Planning Services and an electrical and/or
plumbing permit is required for any electrical service to the
building or water for watering or washing of livestock or poultry.
7) Effective April 25, 2011, building permits issued on the proposed
lots will be required to adhere to the fee structure of the
County-Wide Road Impact Fee Program.
8) Effective April 25, 2011, building permits issued on the proposed
lots will be required to adhere to the fee structure of the County
Facility Fee and Drainage Impact Fee Programs.
9) The largest Lot, or Lot B of a Two-lot Recorded Exemption, may
not be less than thirty-five (35) acres net, in accordance with
Section 24-8-40.P of the Weld County Code.
10) The Weld County Right to Farm Statement, as it appears in
Section 22-2-20.J.2 of the Weld County Code, shall be placed on
the plat and recognized at all times.
5. The applicant shall submit two (2) paper copies of the plat for preliminary
approval to the Weld County Department of Planning Services. Upon approval of
the paper copies, the applicant shall submit a Mylar plat, along with all other
documentation required as Conditions of Approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by the Department
of Planning Services. The plat shall be prepared in accordance with the
requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and
additional requirements shall be submitted within one hundred twenty (120) days
from the date of the Board of County Commissioners Resolution. The applicant
shall be responsible for paying the recording fee.

6. In accordance with Weld County Code Ordinance #2005-7, approved June 1,
2005, should the plat not be recorded within the required one hundred twenty
(120) days from the date of the Board of County Commissioners Resolution, a
$50.00 recording continuance charge may be added for each additional three(3)
month period.
7. The Department of Planning Services respectfully requests a digital copy of this
Use by Special Review, as appropriate. Acceptable CAD formats are.dwg, .dxf,
and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles or
ArcGIS Personal GeoDataBase (MDB). The preferred format for Images is .tif
(Group 4). (Group 6 is not acceptable). This digital file may be sent to
maps@co.weld.co.us.

Description: Minor Subdivision MS-6 was approved the Board of County Commissioners in October of
1972. This divided an existing parcel into Lot 1 (approximately 10 acres) and Lot 2
(approximately 392 acres). Since this approval, Lot 2 has been divided off into five (5)
different parcels without amending the MS-6 plat. Three of these parcels are owned by
Kerr-McGee LLC and two of these parcels are owned by Robert Warner. Kerr McGee has
two existing Use by Special Review Permits for oil and gas support facilities (USR-1291 &
AMUSR-1353) within the boundaries of Lot 2. The purpose of this amended recorded
exemption is to amend the NE4 and W2SE4 out of Lot 2 and recombine the remaining
parcels into a single parcel (Lot 2). The applicant has applied to legally divide out these
Use by Special Review Permits through a four-lot recorded exemption (RECX11-0045) in
conjunction with this application.
Staff Recommendation: The proposed amendment is in compliance with Section 24-8-40 of the Weld
County Code and the Department of Planning Services recommends approval of this application.

Should the Board of County Commissioners approve this request, the Department of Planning
Services staff recommends the following conditions be attached:
1. Prior to recording the plat:
A. The applicant shall attempt to address the requirements of Colorado Parks & Wildlife as
stated in their referral dated April 11, 2012.

the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County
Code.

that meet the definition of an Ag Exempt Building per the requirements of Section 29-
1-20 and Section 29-3-20.B.13 of the Weld County Code do not need building
permits, however, a Certificate of Compliance must be filed with the Planning
Department and an electrical and/or plumbing permit is required for any electrical
service to the building or water for watering or washing of livestock or poultry.
7) Effective April 25, 2011, Building Permits issued on the proposed lots will be required

five (35) acres net, in accordance with Section 24-8-40.P of the Weld County Code.
10) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, typically ranking in the top ten counties in
the country in total market value of agricultural products sold. The rural areas of
Weld County may be open and spacious, but they are intensively used for
agriculture. Persons moving into a rural area must recognize and accept there are
drawbacks, including conflicts with long-standing agricultural practices and a lower
level of services than in town. Along with the drawbacks come the incentives which
attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife,
lack of city noise and congestion, and the rural atmosphere and way of life. Without
neighboring farms, those features which attract urban dwellers to rural Weld County
would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well-run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens, field work, harvest and gravel roads; odor from animal confinement, silage and
manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping
activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides
and fertilizers in the fields, including the use of aerial spraying. It is common practice
for agricultural producers to utilize an accumulation of agricultural machinery and
supplies to assist in their agricultural operations. A concentration of miscellaneous

agricultural materials often produces a visual disparity between rural and urban areas
of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation
shall not be found to be a public or private nuisance if the agricultural operation
alleged to be a nuisance employs methods or practices that are commonly or
reasonably associated with agricultural production.
Water has been, and continues to be, the lifeline for the agricultural community. It is
unrealistic to assume that ditches and reservoirs may simply be moved "out of the
way" of residential development. When moving to the County, property owners and
residents must realize they cannot take water from irrigation ditches, lakes, or other
structures, unless they have an adjudicated right to the water.
Weld County covers a land area of approximately four thousand (4,000) square miles
in size (twice the size of the State of Delaware) with more than three thousand seven
hundred (3,700) miles of state and County roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources. Law enforcement
is based on responses to complaints more than on patrols of the County, and the
distances which must be traveled may delay all emergency responses, including law
enforcement, ambulance, and fire. Fire protection is usually provided by volunteers
who must leave their jobs and families to respond to emergencies. County gravel
roads, no matter how often they are bladed, will not provide the same kind of surface
expected from a paved road. Snow removal priorities mean that roads from
subdivisions to arterials may not be cleared for several days after a major snowstorm.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
People are exposed to different hazards in the County than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches,
electrical power for pumps and center pivot operations, high speed traffic, sand burs,
puncture vines, territorial farm dogs and livestock, and open burning present real
threats. Controlling children's activities is important, not only for their safety, but also
for the protection of the farmer's livelihood.
5. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld
County Department of Planning Services. Upon approval of the paper copies the applicant shall

each additional 3 month period.

Dear Chris:
Baseline Corporation is representing Robert Warner, Anadarko Petroleum Corporation, and its
subsidiary Kerr-McGee Gathering, LLC to amend MS-6, a minor subdivision in Section 14,
Township 2 North, Range 66 West. You may find HS Gathering, LLC on some assessor records
and such references should be eliminated as this entity is now Kerr-McGee Gathering, LLC. The
amendment to this minor subdivision can be processed with a recorded exemption amendment
application. This amendment adjusts the boundaries of Lot 2 of MS-6 so that they are entirely
within the NW 1/4 of Section 14. The amendment will ensure that all applicable USRs are
contained to a single lot.
Existing Lot 2 currently consists of five parcels with various owners. After amendment, two
parcels owned by Robert L. Warner will no longer be a part of Lot 2 of MS-6.

1. Water Supply Statements
a. Domestic Use:
i. Domestic water on the remaining Lot 2 parcels will come from two
sources. At the existing Ft. Lupton Station, water is and will continue to
be delivered to the site via truck. The proposed Lancaster Cryogenic Plant
will be served by a new well. The permit for this well is forthcoming and
will be provided during the USR process. The proposed substation will
need no water.
ii. An existing domestic well (permit #25888 dated November 19, 1965) will
stay with the Warner lots.
b. Irrigation Water: Irrigation will continue on the Warner lots.
2. Adequate Means for the Disposal of Sewage
a. The Ft. Lupton Station currently does, and will continue to, utilize portable
toilets.
b. The proposed substation will need no sewage disposal system.
c. At the proposed Lancaster Cryogenic Plant an engineered septic system will be
designed, constructed, and permitted according to Weld County ISDS
requirements. This will be coordinated during the USR process.
d. The remainder Warner lots are vacant and have no sewage disposal needs.
3. Current Use of Property
a. Currently amended Lot 2 has a variety of uses. Parcels 1309-14-0-00-019 and -
023 are part of Anadarko's Ft. Lupton Compressor Station. This site has various
oil and gas support facilities. USR-1291 and USR-1352AM apply to these parcels.
b. Parcel -024 was recently (January 27, 2012) purchased by Kerr-McGee Gathering,
LLC from Robert L. Warner for use as a future cryogenic plant and electrical
substation. This parcel is currently vacant with three oil and gas wells. Two wells
are located in the northeast quarter of the quarter section and the other well is
located in the southwest quarter of the quarter section. These wells will be
capped prior to construction of the cryogenic plant. A large cattle waterer is
located on the eastern most edge of the property approximately % mile south of
County Road 22.
c. Parcels -010 and -011 are fields owned by Robert L. Warner. These parcels have
several oil and gas wells as well as cattle waterers.
4. Location, Size, Present and Future Use
a. The amended Lot 2 is located along WCR 22 approximately 1.2 miles east of WCR
31. The amended Lot 2 will be approximately 151 acres is size. Amending the lot
will allow for a future recorded exemption to further divide the site into four
lots, assuring USRs are contained to single lots. The present use is outlined in
item three, above. Future use will include the continued operation of the existing

b. The remaining Warner parcels are located in the east half of Section 14. These

The Weld County Public Works Department has reviewed this proposal. Staff comments made during this
phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining
application process. Issues of concern must be resolved with the Public Works Department. Our comments
and requirements are as follows
COMMENTS:
Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011)
CR 22 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant
shall delineate or dedicate an additional 40-foot of right-of-way parallel to the CR 22 right-of-way for full build-
out.
Section Line Access: (right-of-way) CR 35
CR 35 section line has 30 feet of right-of-way in section 14 only.
REQUIREMENTS:
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum
height of 12 inches until the area is completely developed.
The applicant shall place on the plat drawing: 30-foot access easement across Lot B for the benefit of Lot A on
case RECX12-0044.
Show the approved access on the plat and label it with the approved access permit number (AP#). This will be
provided when a revised application form is received.
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).

processing facility and a United Power substation. Recorded Exemption RECX12-0045
is also being processed in conjunction with this application. The Department of Public
Health and Environment will review environmental requirements, such as permanent
sewer and water, when referrals for the uses are received. We have no objections to the
