HomeMy WebLinkAbout20120611 RESOLUTION RE: ACTION OF THE BOARD CONCERNING FINAL DETERMINATION HEARING TO RESCIND RESOLUTION #2007-0218, DATED MARCH 14, 2007, AND DENY APPLICATION FOR USE BY SPECIAL REVIEW PERMIT #1580 - JUSTIN AND ANDREA DAVIS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on March 14, 2007, the Board approved the application of Justin and Andrea Davis, 65898 Weld County Road 99, Grover, Colorado 80729, for a Site Specific Development Plan and Use by Special Review Permit #1580 for a Home Business (manufacturing steel frames for steel washers) in the A (Agricultural) Zone District on the following described real estate, being more particularly described as follows: Part of the SW1/4 of Section 32, Township 12 North, Range 60 West of the 6th P.M., Weld County, Colorado WHEREAS, on December 5, 2011, and then January 9, 2012, the Board held an Initial Hearing and determined that the applicant had not demonstrated a willingness or ability to complete the necessary Conditions of Approval and record the plat, and set a Final Determination Hearing date for February 13, 2012, to consider Rescission of approval of Use by Special Review Permit#1580 and Denial of the application, and WHEREAS, on February 13, 2012, the Board deemed it advisable to continue the matter to March 5, 2012, in order to grant staff additional time to attempt to contact the applicants, and WHEREAS, on March 5, 2012, the Board of County Commissioners heard all of the testimony and statements of those present, and all of the exhibits and evidence presented in this matter, and having been fully informed, deems it advisable to Rescind Resolution #2007-0218 and deny the application for Use by Special Review Permit#1580. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Resolution #2007-0218, dated March 14, 2007, for a Site Specific Development Plan and Use by Special Review Permit#1580 for a Home Business (manufacturing steel frames for steel washers) in the A (Agricultural) Zone District, issued to Justin and Andrea Davis, on the parcel of land described above be, and hereby is, rescinded. Staff Recommendation: Staff has had not been able to contact the applicants or received a direct response from the applicant's since the 2007 hearing. Staff has however received two(2)certified mail receipts signed by two different individuals who are not the applicant. Since the initial hearing 12/5/2012 hearing, staff has posted the property with a notice sign for the 1/9/2012 hearing. No operations were occurring in the building when the sign was posted—however the residence on the property behind the building is lived in. It is hard to tell if the business was simply not occurring that day or if business has ceased since its original approval. No response has been received from the applicant/property owner. Staff has coordinated with Bethany Salzman to come up with another potential contact address (in Cheyenne Wyoming). Staff sent an updated letter to a potential contact address for the applicant.A receipt was returned indicating that the letter had been received. This case was continued at your request to March 7, 2007 and again to March 14, 2007 at which time your presence was recorded. This land use permit was conditionally approved pending action by the applicant. Review of the case file finds little activity after the March 14, 2007public hearing. It is important to state that Section 23-2-200.E provides timelines for completing the requirements associated with this case. For reference, the citation is as follows: "If the Use by Special Review has not commenced within three (3)years from the date of approval or is discontinued for a period of three (3) consecutive years, it shall be presumed inactive. The COUNTY shall initiate an administrative hearing to consider whether to grant an extension of time to commence the use or revoke the Use by Special Review. If the Use by Special Review is revoked, it shall be necessary to follow the procedures and requirements of this Section in order to reestablish any Use by Special Review." At the Commissioners hearing, by agreement to the Conditions of Approval, you stated that 60 days to record the USR#1580 plat was acceptable. The date for providing the required documents and submitting the Improvement Agreement, Collateral and recording the plat has passed. Given this condition, staff will impose Weld County Code Ordinance 2005-7 approved June 1,2005, should the plat not be recorded within the required sixty(60) days from the date the Board of County Commissioners Resolution was approved a$50.00 recording continuance charge may be added for each additional 3 month period. The Department of Planning Services is aware of the difficulty and associated delays in meeting the Conditions of Approval normally associated with land use cases; and this office is willing to work with you. At this juncture, this office is requesting a letter from you indicating that the project has not been abandoned and that it is the intention of Justin and Andrea Davis to complete this project, addressing and meeting all of the conditions of approval in a timely manner.
