RE: ACTION OF THE BOARD CONCERNING FINAL DETERMINATION HEARING TO
RESCIND RESOLUTION #2007-0218, DATED MARCH 14, 2007, AND DENY
APPLICATION FOR USE BY SPECIAL REVIEW PERMIT #1580 - JUSTIN AND
ANDREA DAVIS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on March 14, 2007, the Board approved the application of Justin and
Andrea Davis, 65898 Weld County Road 99, Grover, Colorado 80729, for a Site Specific
Development Plan and Use by Special Review Permit #1580 for a Home Business
(manufacturing steel frames for steel washers) in the A (Agricultural) Zone District on the
following described real estate, being more particularly described as follows:
Part of the SW1/4 of Section 32, Township 12
North, Range 60 West of the 6th P.M., Weld
County, Colorado
WHEREAS, on December 5, 2011, and then January 9, 2012, the Board held an Initial
Hearing and determined that the applicant had not demonstrated a willingness or ability to
complete the necessary Conditions of Approval and record the plat, and set a Final
Determination Hearing date for February 13, 2012, to consider Rescission of approval of Use by
Special Review Permit#1580 and Denial of the application, and
WHEREAS, on February 13, 2012, the Board deemed it advisable to continue the matter
to March 5, 2012, in order to grant staff additional time to attempt to contact the applicants, and
WHEREAS, on March 5, 2012, the Board of County Commissioners heard all of the
testimony and statements of those present, and all of the exhibits and evidence presented in
this matter, and having been fully informed, deems it advisable to Rescind Resolution
#2007-0218 and deny the application for Use by Special Review Permit#1580.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Resolution #2007-0218, dated March 14, 2007, for a Site Specific
Development Plan and Use by Special Review Permit#1580 for a Home Business
(manufacturing steel frames for steel washers) in the A (Agricultural) Zone District, issued to
Justin and Andrea Davis, on the parcel of land described above be, and hereby is, rescinded.
BE IT FURTHER RESOLVED by the Board that the application for Use by Special
Review Permit#1580 be, and hereby is, denied.

All conditions of approval stipulated on the USR-1580 resolution are still outstanding.
Staff Recommendation:
Staff has had not been able to contact the applicants or received a direct response from the applicant's
since the 2007 hearing. Staff has however received two(2)certified mail receipts signed by two different
individuals who are not the applicant.
Since the initial hearing 12/5/2012 hearing, staff has posted the property with a notice sign for the
1/9/2012 hearing. No operations were occurring in the building when the sign was posted—however the
residence on the property behind the building is lived in. It is hard to tell if the business was simply not
occurring that day or if business has ceased since its original approval. No response has been received
from the applicant/property owner. Staff has coordinated with Bethany Salzman to come up with another
potential contact address (in Cheyenne Wyoming).
Staff sent an updated letter to a potential contact address for the applicant.A receipt was returned
indicating that the letter had been received. Staff has not received any phone calls or e-mails since
the receipt of the letter. Staff recommends that this USR be rescinded.

Subject: 3rd Letter - Outstanding Conditions of Approval and Items to be Completed Prior to Recording
the Plat for Use by Special Review, USR-1580.
Dear Applicant:
The Planning Department is working through our historical case files in an effort to resolve unrecorded
and outstanding land use permits. You are receiving this letter because you have applied for a Use by
Special Review (USR) permit with Weld County but have never followed through the steps to complete
the process. You should have received two other letters from me in August and September concerning
the same topic.
On February 27, 2007, your application for an Use by Special Review was approved by the Weld County
Board of County Commissioners with specific Conditions of Approval. At this time the conditions of
approval have not been satisfied and a Mylar Plat has not been recorded with Weld County Clerk and
Recorder.
One of the required Conditions of Approval in the Board of County Commissioners resolution grants the
applicants thirty (30) days to submit a Mylar Plat, and provide written evidence that all conditions outlined
in the resolution have been completed. Should you choose not to complete the Use by Special Review
process and provide the required Mylar Plat, the Department of Planning Services requests written
notification of your decision to withdraw the application and that the use is not active on the property.
If you are unable to meet the Conditions of Approval and record the plat by December 5, 2011, 2011 an
initial hearing is scheduled with the Board of County Commissioners. The hearing will take place at the
Weld County Administration Building, located at 1150 0 Street, at 9:00 am on December 5, 2011. It is
strongly encouraged that you attend this hearing. At this hearing the Board of County Commissioners
has the authority to grant additional time to meet all the conditions/requirements of approval and record
the plat or schedule a final determination hearing to rescind approval of Use by Special Review, USR-
1580 and deny the application.

Dear Applicant:
On February 27, 2007, your application for a Use by Special Review was approved by the Weld County
Board of County Commissioners with specific Conditions of Approval. At this time the conditions of
approval have not been satisfied and a Mylar Plat has not been recorded with Weld County Clerk and
Recording.
One of the required Conditions of Approval in the resolution grants the applicants thirty (30) days to
submit a Mylar Plat, and provide written evidence that all conditions outlined in the resolution have been
completed. Should you choose not to complete the Use by Special Review process and provide the
required Mylar Plat, the Department of Planning Services requests written notification of your decision to
withdraw the application and that the use is not active on the property.
Planning Services Staff is aware of the difficulty and associated delays in meeting the Conditions of
Approval normally associated with land use cases, and is willing to work with you in completing your
request. Please notify the Department of Planning Services, in writing, within 10 working days of your
decision to complete the Use by Special Review within the next 60 days or withdraw the application.
If you chose to withdraw the application please sign and date the enclosed form and return to the Weld

Subject: Use by Special Review# 1580
Dear Justin and Andrea Davis:
The Department of Planning Services is contacting you regarding the approval of USR#1580
through action of the Weld County Board of County Commissioners on February 14, 2007. This
case was continued at your request to March 7, 2007 and again to March 14, 2007 at which time
your presence was recorded. This land use permit was conditionally approved pending action
by the applicant.
Review of the case file finds little activity after the March 14, 2007public hearing. It is important
to state that Section 23-2-200.E provides timelines for completing the requirements associated
with this case. For reference, the citation is as follows:
"If the Use by Special Review has not commenced within three (3)years from the date of
approval or is discontinued for a period of three (3) consecutive years, it shall be
presumed inactive. The COUNTY shall initiate an administrative hearing to consider
whether to grant an extension of time to commence the use or revoke the Use by Special
Review. If the Use by Special Review is revoked, it shall be necessary to follow the
procedures and requirements of this Section in order to reestablish any Use by Special
Review."
At the Commissioners hearing, by agreement to the Conditions of Approval, you stated
that 60 days to record the USR#1580 plat was acceptable. The date for providing the
required documents and submitting the Improvement Agreement, Collateral and
recording the plat has passed.
Given this condition, staff will impose Weld County Code Ordinance 2005-7 approved June 1,2005,
should the plat not be recorded within the required sixty(60) days from the date the Board of County
Commissioners Resolution was approved a$50.00 recording continuance charge may be added for
each additional 3 month period.
The Department of Planning Services is aware of the difficulty and associated delays in meeting
the Conditions of Approval normally associated with land use cases; and this office is willing to
work with you. At this juncture, this office is requesting a letter from you indicating that the
project has not been abandoned and that it is the intention of Justin and Andrea Davis
to complete this project, addressing and meeting all of the conditions of approval in a timely
manner. Should a written response on letterhead not be received by September 10, 2010, this
office will take the appropriate action.
