This letter is in response to a request for water service to serve the following property described as
follows:
Part of Lot B of Recorded Exemption No. 1057-23-2-RE4914 being a part of the bV V of
Section 23,Township 4 North, Range 66 West, Weld County, Colorado
Water service can be made available to the above described property provided all requirements of
Central Weld County Water District, Northern Colorado Water Conservancy District and the U. S.
Bureau of Reclamation are satisfied. Central .Weld County Water District will require that Tap
Assignments be consummated prior to the setting of a tap or this letter shall become null and void unless
extended in writing by the District. Subdivisions requiring 10 or more taps will be required to purchase
and transfer raw water prior to District approval. Please note that you are responsible for confirming
that this property has met the requirements of Northern Colorado Water Conservancy District
and the Bureau of Reclamation. To do this, you may contact Marilyn Conley with Northern
Colorado Water Conservancy District at 970332/700. Central Weld cannot issue'a tap until all
requirements are satisfied. A review of the e District's system in this water service area will need to be
done prior to water taps being sold.
• Due to the rapid cost increase of raw water, existing tap fees may not apply for water service to this
property. The District will not notify, by separate letter,any prospective landowners or land purchasers
of tap fee or line extension cost increases. The cost ofa tap fee and/or line extension will have to be paid
in advance to the District by the prospective customer in accordance with District policy within one (1)
year from the date of this letter
It is your responsibility to confirm with your local Fire Protection Authority if fire flow water capacity is
required for your project.

Atmos Energy Corporation is willing and able to construct the necessary distribution infrastructure to serve
natural gas to the proposed/planned property listed above. Per Atmos Energy's CPUC tariff filing, the cost of
any natural gas distribution main extension(s) and/or service lines and easements shall be borne by the
developer/owner. Atmos does have an existing gas tap at 20595 WCR 33 that may be utilized. The allowable
capacity currently from this tap is anticipated to be a total of 15 MCF per hour including the existing connected
load. To serve any industrial natural gas load from that existing tap would require a significant capacity
increase.
The developer/owner will be responsible for providing utility easements necessary for the installation of the
infrastructure. At the time of installation, the utility easements for this main extension and/or service line should
be to final grade and allow clear access to the easements. Property pins should be visible and clearly marked.
All sleeves for crossing should be installed prior to the main extension installation as per drawings and
specifications provided by Atmos Energy Corporation.
The construction and installation of all natural gas infrastructures will adhere to Atmos Energy Corporation's
specifications and Tariff on file with the Colorado Public Utility Commission and are subject to the State and
Federal Regulatory and Pipeline Safety oversight.

and/or electric facilities can be made available to serve your project at Big Thompson Investment
Holdings Industrial Subdivision at 20860 \VCR 33 in La Salle CO.

service(s) will be designed. Once the design has been approved, applicable costs have been paid and

We have reviewed the additional information provided by the Applicant regarding the above
referenced proposal to subdivide approximately 92 acres into 8 industrial lots.
According to a letter dated August 6, 2012 from AgProfessionals, LLC, the anticipated water
demand for the subdivision at full build-out is 66 acre-feet per year.
The proposed water supplier is the Central Weld County Water District("District'). A letter of
commitment of service dated October 24, 2011 was provided with the submitted materials, contingent upon
the applicant meeting the requirements of the Central Weld County Water District, Northern Colorado
Water Conservancy District and the Bureau.
Based on a report last updated on June 30, 2012, the District owns 5,370 units of Colorado-Big
Thompson project shares with a firm annual yield of 3,222 acre-feet, and 0.33 shares of Greeley Loveland
Mutual Irrigation Company with a firm annual yield of 4 acre-feet. An additional 7,100 acre-feet of water was
transferred to the District by multiple towns for treatment and delivery. The District's demands for 2010-
2011 were 3908.5 acre-feet. The proposed project will increase the District's demands to 3974.5 acre-feet
per year.
Based on the above, and pursuant to Section 30-28-136(1)(h)(II), C.R.S., it is our opinion that the
proposed water supply can be provided without causing material injury to decreed water rights, and is

We have reviewed the above referenced proposal to subdivide approximately 92 acres into 8
industrial lots. The lots will rarge in size from 5 acres to 18 acres. Average lot size will be 10.3 acres.
Estimated water requirements were net provided for this development. Prior to further review a
water supply plan must be submitted.
The proposed water supplier is the Central Weld County Water District("District"). A letter of
commitment of service dated October 24, 2011 was provided with the submitted materials, contingent upon
the applicant meeting the requirements of the Central Weld County Water District, Northern Colorado
Water Conservancy District and the Bureau,
As outlined in the statutes,Section 30-28-136(1)(h)(II), C.R.S.,a municipality or quasi-municipality
is required to file a report with the county and the State Engineer documenting the amount of water which
can be supplied to the proposed development without causing Injury to existing water rights. This office has
not received any Information from the District since November 12, 1998. To expedite the evaluation of the
water supply for the subdivision, the water supply report or statement should include a summary of water
rights owned or controlled by the District,the anticipated yields of these rights both in an average year and
dry year,the present demand on the system,the anticipated demand due to commitments for service
entered into by tha District and the amount of uncommitted firm supply the District has available for the
future.
Additional information regarding necessary information to be included in the subdivision water
supply plan can be found on Attachment A of the Updated Memorandum Regarding Subdivisions, available
online at httpillwater.state,co.us/oroundwater/GWAdmin/Pages(subdivisionwsRaspx.
Since insufficient Information was provided, we cannot comment on the potential for injury to
existing water rights or the adequacy of the proposed water supply under the provisions of Section 30-28-

V. System Analysis
A. Raw Water Supply
The current raw water supply for the District is through the Colorado Big Thompson(CBT) system with
the water delivery to the treatment plant from Carter Lake. The District obtains shares in the CBT system
through purchase:; from other shareholders and through transfer of shares to the District by developers
and new tap holders. Raw water for the towns is owned by the towns, and the annual CBT allotment is
transferred to the District for treatment and delivery.
1. Rural Customers
The current water rights owned by the District are summarized in the following table. As indicated,
nearly all of the water resources are in the form of CBT shares.

next figure. As indicated, the District currently has adequate supplies for its existing customers; however,
1 additional supplies will be required if the demand projections materialize.

The above figure indicates District's retail customers are projected to require an additional 1,600 to 3,300
acre-feet by 2050 depending on which projection is used. The projected additional usage by 2050 as
documented in the NISP report is 3,300 acre-feet. This compares to the District's current share of the
N1SP project of 3,300 acre-feet.
As indicated in the above figure, a significant portion of the future water supply is projected to be
supplied from the NISP project. NISP (Northern Integrated Supply Projcct) is a regional supply and
storage project which will provide approximately 34,400 acre-feet of new yield water rights and 47,000
acre-feet of finning storage for the 14 participants, The second phase of the project, which is the
environmental assessment and permitting, is currently underway. Once the permitting is completed the
final phase is design and construction, which is expected to extend from 2015 through 2023. NISP will
give the District more flexibility with raw water rights because they will be ahle to transfer rights from the
NISP project to Carter Lake and divert them into the existing filter plants. Current estimates project
CWCWD and the Towns of Frederick, Firestone, and Dacono will be committing approximately 5103
million to the constmction of the NZSP project.
The Central Weld and Little Thompson Water Districts completed the construction of the 10,000 acre-
foot Dry Creek Reservoir near LCR 44 and 25 in 2007. The reservoir is jointly owned and operated by

CWC«D and Little Thompson Water District (LT WD). The location is next to CWCWD 20-inch steel
waterline, which has been converted for use to transport raw water from Carter Lake and back to the
Carter Lake Filter Plant. The main purpose of Dry Creek Reservoir is to allow CWC1,VD and LTWD to
store more CRT water. Since the NCWCD allows only a small percentage of carryover within the CDT
• system, water can be delivered to Dry Creek Reservoir and stored, and then delivered back to the
treatment plants as needed. The reservoir currently does not generate any additional annual yield of
water.
In addition to NISP and the Dry Creek Reservoir Project, there are other potential opportunities to secure
and utilize native water rights to supply the District customers. The District has previously examined two
_ sites in the tri-town area for alternate treatment plant sites. The sites include Milavec Lake located in
Frederick and a site near the Varra Gravel Pit. Due to the lower water quality of this water additional
treatment processes and/or blending will be required. Based on that analysis it was recommended other
sources be investigated. To determine whether any of the native raw water within the District boundary is
1 worth treating will require a feasibility study on the water quality, water quantity, and the bent treatment
plant location. A study of this type is a project in itself and is beyond the scope of this study.
1. Wholesale Customers
As indicated above, the individual towns are responsible for obtaining their own raw water resources.
However, the projected annual use for the towns is shown in the following figure as a point of reference
on the magnitude of the projected demands on the system.• -r

A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday.
September 27.2012 at 10:00 a.m.,in the Hearing Room of the Weld eld County Planning Department at 1555 N

Tom Parke.Planning Services.stated thattha requests for a Final Plat of S lots in an Industrial Subdivision.
He added thatthe applicant is proposingthe utility and drainage easements follon property lines on each side.
In addition.there are some oil and gas improvements on site.
JerryAdarrs inquired lithe final plat!abet the lot numbers and outlet. Mr.Parke said thatthere a atotal of
lot and2 outlets. Mr.Adams notedsome labels regarding easementuddths andwantedto clarifythat each of
the utility easement are labeled and consistent with Section 247-80. On the far northeast corner.Lot7.it
appears that the perimeter easement squeezes dawn from 20 foot to 10 foot. Mr.Naylor said that he will
correctthat on the map.
Mr.Adams noted that Robert Fleck with St.Vrain Sanitation D thief couldn't be here buthe noted that each of
the existing well heads identified on the draping has a 150foot building setback and a concerned thatthere
are proposed utility easement running through those building setbacks. The concern a thatwe may not be
able to use those easement without approval ofthewellhead owner. Mr.Parke said that it may be included
in the Surface Use Agreement between the owner and the mineral interest. Mr.Naylor said that it s not
specifically covered but that they are aware of the lot lines and easement and have not expressed any
concerns. The majority of the utilities will run along the road and then branch off to the individual users. He
added thatAtmos Energywill only be usingtheside easement and is willingtowolk withthem to have a layout
that will not encroach any of those. Mr.Adams suggested that easement skid those setbacks or have
clarification thattherewould not be a conflict between those setbacks and the use of the utility easements with
the wellhead owner. Mr.Naylorsaidthattheywould bewilling to create an easement outside ofthesetbacks
following that setback line. Mr.Adams said that we need a resolution if underground utilities can be placed
within these setback areas or not
Mr.Adams said that iftime needs to made to mice this resolution we could meet at the October 11.2012
meeting. Mr.Adarrs moved to continue this case to the October 11.2012 UtilityBoard meeting sothatwe will
have clarification on hcw these setbacks will work with utility easements as well as the correction to the
easement width on the north side of Lot 7. Richard Hastings seconded the motion. Motion carried
unanimously.
