SUBJECT: USR11-0017, Scott Lawrence
Amendment to Use by Special Review 671 (farm equipment repair shop) for the expansion of
outdoor storage of vehicles, materials and parts associated with the farm equipment repair
shop, along with a Towing service, and an impound lot.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state
highways. (State Highway 52) The email from Gloria Hice-Idler stated that CDOT has no concerns with
this use as it will not increase the existing amount of traffic from the site.
The site plan shows employee and customer parking. Please show where individual spaces will be
located and how many spaces will be available. Parking also appears to be shown on top of the new
leach field, please clarify this on the drawing as nothing can be parked or stored on top of the septic leach
• field.
A water quality feature design has been provided and is acceptable. Please show the boundaries of the
Water Quality Area on the plat and label as "Water Quality— No Build or Storage Area". The water quality
area may need to be split into multiple areas to ensure that the stormwater runoff from the business as
well as storage areas is caught.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Show the individual parking spaces for employees and customers and ensure that the parking
spaces are not located on top of the septic leach field
2. Show the boundary of the Water Quality Area and label as "Water Quality — No Build or Storage
Area". The water quality area may need to be split into two to ensure that the runoff from the
business/shop area and the storage area is caught.
3. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
• property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
c. Weld County is not responsible for the maintenance of onsite drainage related features.

Environmental Health Services has reviewed this proposal for a diesel and farm
equipment repair and fabrication shop, heavy vehicle towing business, and impound for
storing wrecked vehicles and vehicles waiting repairs. There are a total of 4 employees
who have access to the site, which includes the applicants.
There is an existing septic system on the property that the applicant is proposing to
upgrade. The septic system upgrade has been designed by an engineer and Septic
Repair Permit SP-1100141 was approved by the Board of Health on September 27,
2011. Septic Repair Permit SP-1100141 will require final approval through this
• Department.
Water is provided by a commercial well (Permit No. 140143). The commercial well is
restricted to drinking and sanitary purposes, and water used inside the shop building for
steam cleaning diesel engines, truck and farm equipment. Water from the well must not
be used for lawn or landscape irrigation or any other purposes outside the shop
building.
The applicant submitted a dust abatement plan which indicates that dust will be
controlled by applying water on outside surfaces from the commercial well. Since the
commercial well is restricted to uses inside the shop, the applicant will need to propose
an alternate means of dust control and revise their dust abatement plan.
The existing shop building on the property is used for repairs of the vehicles and
equipment. Repairs of large farm machinery occur outside. Oil pans and absorbent
mats are used under the vehicles when performing repairs and maintenance. Any spills
of vehicle fluids are cleaned up using an absorbent, and the waste absorbent is
contained for off-site disposal. The applicant has a contract with Barron's Oilfield
Service of Ft. Lupton to remove waste spilled materials and assist with cleanup of any
large vehicle fluid spills.
There was no mention of washing or steam cleaning of diesel engines, truck and farm
equipment in the application. If washing of vehicles and equipment is performed onsite
the applicant will need to ensure that the effluent is contained and discharges are •
prevented. The applicant informed that there are no floor drains inside the shop. And, as
mentioned above, water from the commercial well is restricted to inside the shop
building. The vehicle and equipment areas and containment should be designated on
the plat.
The applicant submitted a waste handling plan and was found to be acceptable. Trash
and garbage is removed by Gator Rubbish Removal, Inc. Any used vehicle fluids, such
as oils, antifreeze and diesel, is stored in 2-275 gallon bulk storage containers for
removal by Tri-County Oil Reclaimers of Cheyenne, Wyoming.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall revise their dust abatement plan, for review and approval, to
the Environmental Health Services, Weld County Department of Public Health &
Environment.
2. In the event washing of vehicles and equipment will occur on site the applicant
shall ensure that any vehicle and equipment washing area(s) shall capture all •
effluent and prevent discharges from the washing of vehicles in accordance with
the Rules and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency. Vehicle and equipment washing areas should
be designated on the plat.
3. All Weld County Individual Sewage Disposal System (ISDS) regulations and
policies apply. Septic Repair Permit SP-1100141 must receive a final inspection
through the Weld County Department of Public Health and Environment,
Environmental Health Services.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.

• 3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Any vehicle and equipment washing area(s) shall capture all effluent and
prevent discharges from the washing of vehicles and equipment in accordance
with the Rules and Regulations of the Water Quality Control Commission, and
the Environmental Protection Agency.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
8. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
• 9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
10.All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
11. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
12.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.
Additionally, please note the following:
1. This application is proposing a well(s) as its source of water.The applicant should
be made aware that groundwater may not meet all drinking water standards as
defined by the Colorado Department of Public Health and Environment. We
strongly encourage the applicant to test their drinking water prior to consumption

Subject: USR11-0017 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV10-00121)was noted. This
violation was initiated due to the expansion of a Use by Special Review(USR-671)permitted area without
the necessary Weld County Zoning Permits and the presence of non-permitted mobile homes and
Noncommercial Junkyard. This case was presented to the Board of County Commissioners through the
Violation Hearing process on February 8, 2011. At that hearing,the Board referred this case to the County
Attorney's office, but delayed legal action for 30 days. Since this is an active violation,an investigation fee
is required.
This complaint was from a private citizen.
This application if approved by the Board of County Commissioners and once a plat is recorded will
correct a portion of the violation. If this application is denied, the commercial use shall be reduced to fall
back within the guidelines as established through USR-671. Additionally, if denied by the Board of County
• Commissioners this case will proceed with legal action accordingly.

Comments:
1. The address must be placed on the business and in a position that is clearly visible from
the street fronting the business. Address numbers need to be a minimum of 4 inches high,
have a% inch stoke, and they need to be on a contrasting backboard. In the case of
utilizing the same address as another business, a suite # or at least the business name
needs to be posted on the structure along with the address.
2. Fire apparatus access roads shall be designed and maintained to support the imposed
loads of fire apparatus. All fire apparatus access roads must have a surface to provide all-
weather driving capabilities. The fire department will need to have access that goes
around all areas of parking and the office.

Dear Mr. Gathman:
We have reviewed the above referenced request for use by special review on a 5.25-acre parcel.
The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28-101(10)(a),
C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments will not address the adequacy of the water supply plan for this
property or the ability of the water supply plan to satisfy any County regulations or requirements.
The applicants propose to operate a diesel equipment repair shop, heavy towing and recovery
• service, and impound lot on the subject property. The site will be utilized by the two applicants and their two
employees, and approximately ten customers per week. A delivery driver is also anticipated to visit the site
three times per week. The estimated water demands were not provided for this proposal.
The current and proposed water supply for the property is an existing well, operating under permit
no. 140143. The withdrawal of ground water from the well is limited to 1/3 of an acre-foot(108,600 gallons)
per year for use in drinking and sanitary facilities inside a commercial business. Water from the well may
not be used for irrigation or any other purpose outside the building. The applicants have signed a
Statement of Well Usage indicating that they will use water from the well only in accordance with the
terms of its permit.
So long as the well with permit no. 140143 is used in accordance with its permitted conditions this
office has no objection to the proposed repair shop, towing service, and impound lot. If you or the
