When completed, this system will allow ICE to respond to emergent situations more rapidly, thereby improving national safety and security. In accordance with Section 106 of the National Historic Preservation Act of 1966, as codified and amended at 16 U.S.C. § 470f, and the implementing regulation, 36 C.F.R. pt. 800, ICE is required to take into account the effects of its undertakings upon historic properties, and this requires consulting with local government and tribal organizations which might be impacted by our undertakings. ICE proposes to place an antenna upon a pre-existing communications tower on the outskirts of Greeley, Colorado in Weld County. Detailed information regarding this site and the proposed action is provided in Exhibit A. Based upon our delineation of the area potentially affected by our proposed undertaking and our review of publically available information, our initial assessment is that our undertaking does not affect historic properties or resources. We recognize, however, that you may have information that indicates otherwise. As a consulting party, we wish to afford you the opportunity to review and comment upon the proposed action including substantive input regarding historic resources within the Area of Potential Effect (APE) as well as the APE's scope. Space required is 6' dipole element, 51 lbs.). long x 6' wide x 8' high. Technical Review: • Since the existing aboveground cable trays, tower railings, and equipment compound will be used for this collocation, no construction or ground disturbance will occur. • The proposed antenna will be mounted on the tower at 145 feet, resulting in no increase to the tower's overall height. • ICE examined the visual impacts to historic properties based on a '/-mile"Area of Potential Effects" (APE) for a newly introduced visual element to an existing tower with a height ranging between 200 and 400 feet.1 • There are no sites on the National Register of Historic Places (NRHP) in the vicinity of the proposed collocation site. For purposes of establishing an APE,ICE assessed an APE for visual impacts consistent with the Federal Communications Commission(FCC),National Programmatic Agreement for Review of Effects on Historic Properties for Certain Undertakings approved by the Federal Communication Commission, FCC 04-222 (Sept. 2004).Following the Advisory Council on Historic Preservation's guidance to U.S. Customs and Border Protection regarding collocation of communications equipment,ICE recognizes that the programmatic agreement is not applicable to its collocation actions.
