RE: APPROVAL OF LOT SIZE VARIANCE NO. 51 - VIRGINIA LESH.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 14th day of November, 1977, in
the Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain parcel of land is owned by Virginia
Lesh, which land is more particularly described as follows ,
to-wit:
Lots One (1) and TWo (2) , and the South Half (S1)
of the Northeast Quarter (NEa) of Section six (6) ,
Township Eight (8) North, Range Sixty-six (66) West
of the Sixth P.M. , Weld County, Colorado
WHEREAS, the owners of said tract of land desire to obtain
a variance from the minimum lot size requirement so that
Virginia Lesh may make application to the Board of County Com-
missioners to apply for a recorded exemption, as set forth in
Section 9-4 .A. (6) of the Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, based upon the recommendations of the Department of
Planning Services , feels thatthe applicant has shown good cause
for granting a lot size variance under Section 9-4.A. (6) of the
Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that a variance from lot
size requirements, be, and hereby is, granted to Virginia Lesh
for the above described parcel of land, subject to the condition
that a proper sewer system must be installed prior to the time
application is made for a recorded exemption.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of

RE: Lot Size Variance #51
Dear Commissioners:
The attached letter and related materials are in reference to a request by
Virginia Lesh for a lot size variance. The property is described as Pt . of
the NE* of Section 6, T8N, R66W of the 6th P.M. , Weld County, Colorado.
Said property is located lo miles west of Nunn. The property in question
contains approximately 140 acres of Class VII nonirrigated soils. The
request is to obtain a variance from the minimum lot size requirement ,
Section 9-4(a) (6) , so that Ms. Lesh may make application to apply for a
recorded exemption. Section 9-4(a) (6) states;
"that the original tract or parcel of land to be divided
under this section meets the minimum lot size requirements
established by the Weld County Zoning Resolution; variance
from this requirement being allowed only upon good cause
being shown to the Board of County Commissioners or where
said tract or parcel of land lies within the Comprehensive
Plan area of an existing incorporated town of Weld County ,
(Revised 4-17-74)"
If this lot size variance is granted, Ms. Lesh will proceed with her appli-
cation for a recorded exemption to divide the property into two lots . One
lot is proposed to contain approximately 2 acres with an existing set of
improvements. The second lot is proposed to contain approximately 138 acres
would be unimproved, nonirrigated agricultural land.
In a letter dated November 3, 1977, the Weld County Health Department recom-
mended the lot size variance request be denied for the following reasons.
1 . The domestic well is inoperative and they were unable to determine the
potability of the water.
2. The property does not have an adequate sewage disposal system.

In subsequent discussions with the Weld County Health Department , they indi-
cated they did take water samples from the well and have indicated that the
water is adequate in quality. However, the problem still exists that the
existing set of improvements _on the proposed 2 acre parcel does not have an
adequate sewage disposal system.
Based upon the information submitted and the adopted policies in the County,
the Planning Commission Staff recommends the request be denied until the pro-
posed 2 acre lot with the existing set of improvements is adequately served
by a sewage disposal system.

Colorado containing 140 acres more or less
Dear Ms. Lesh:
I have been contacted by John Hall , acting Director of the
Environmental Health Services with the Weld County Health
Department , who indicated the Health Department could not
approve your request for a Lot Size Variance at this point
due to the fact that the well is out of commission and there
is no septic system on the 2 acre parcel which you desire to
sever from the remaining part of the property in question.
It is highly unlikely that the Board of County Commissioners
will approve your request until these health problems are
corrected.
If you have any questions with regards to this matter, please
do not hesitate to contact our office.
