RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION #4546 - ELAINE
BRASWELL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on November 28, 2006, the Department of Planning Services administratively
approved the request of Elaine Braswell, P.O. Box 26, Lafayette, Colorado 80026, for Recorded
Exemption#4546, to divide the property into parcels estimated to be approximately 25 acres and 6
acres, for property which is located on the following described real estate, to-wit:
Lot A of Recorded Exemption #1820; being part of
the E1/2 NW1/4 of Section 8, Township 4 North,
Range 64 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Department of Planning Services staff notified the applicant, by certified
letters dated October 11, 2007; July 22, 2009; and April 1, and April 29, 2011, that certain
outstanding Conditions of Approval had not been completed and that the matter would be scheduled
for a hearing before the Board of Weld County Commissioners unless written documentation was
received requesting a withdrawal of the case, or the outstanding items were completed and the
mylar plat recorded, and
WHEREAS, on June 13, 2011, the applicant, Elaine Braswell, was present, and
WHEREAS, after reviewing Department of Planning Services concerns and hearing the
testimony presented, the Board determined that said request shall be continued until January 16,
2012, to allow the applicant additional time to record the mylar plat.
WHEREAS, at said hearing on January 16, 2012, staff indicated the applicant submitted a
letter requesting to withdraw the application, and
WHEREAS, after reviewing the matter and hearing the testimony presented on January 16,
2012, the Board determined the matter shall be continued to January 23, 2012, to allow the
applicant additional time to reconsider her request for withdrawal of the application, and
WHEREAS, on January 23, 2012, Ms. Braswell was represented by her husband, John
Braswell, and he requested a one year continuance on her behalf, and
WHEREAS, after reviewing the matter and hearing the testimony presented on January 23,
2012, the Board determines the matter shall be continued to February 18, 2013, to allow the
applicant additional time to record the mylar plat.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request for Recorded Exemption#4546, submitted by Elaine Braswell,
be, and hereby is, continued to February 18, 2013, to allow the applicant additional time to record
the mylar plat.
