Dear Chris:
This letter is to address the Conditions of Approval for USR-11-0031as noted in the Administrative
Review. The following conditions have been met as shown with the submitted documentation. Please
forward the information to the corresponding departments for their review.
Condition 1B.Building Inspection—1 did not receive a Building Inspection referral
Condition 1D.Septic—There is not an existing home on the USR property,therefore,a
home septic will not be used for business use.
Condition 1 E. Dust Abatement—The Dust Abatement plan was acceptable in the
submittal package as noted in the January 24, 2012 Health Department Referral
Memorandum from Mary Even.
Condition 11.Colorado Division of Water Resources-Attached is a copy of the
approved Commercial Well Permit#287450.
I am requesting that these conditions be removed from the Review prior to the Planning
Commission hearing as they have been met.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from
seeking relief in a civil court action.
2) Construction details for this existing well have not been provided to this office;therefore, it is not known if the construction
of this well is in compliance with the Water Well Construction Rules, 2 CCR 402-2. The issuance of this permit does not
relieve the well owner of responsibility or liability in the event contamination of the groundwater source results from the
construction or use of this well, nor does the State Engineer assume any responsibility or liability should contamination
IWO occur.
Recorded pursuant to CRS 37-92-602(5), and the policy of the State Engineer,for historical use as indicated herein. This
well produces 15 GPM,and is used for drinking and sanitary facilities as described in CRS 37-92-602(1)(c), in an individual
commercial business, Water from this well shall not be used for any uses outside the business building structure(s),
including lawn or landscape irrigation,or animal watering.
4) Approved as the only well providing water to this business,which is on a 160 acre parcel, described as the W 1/2 of the E
1/2 of Section 32, Twp 4 North, Rng. 64 West,6th P.M.,Weld County, reference attached exhibit A.
5) The average annual amount of ground water to be appropriated shall not exceed one (1) acre-foot (325,850 gallons).
6) The date of first beneficial use, as claimed by the applicant, is September 30, 1969.
7) The return flow from the use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.
8) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon
request.
NOTE:The uses identified in condition#3 above are based on the Applicant's written claim regarding the historical use of
this well prior to May 8, 1972. These uses have not been verified or confirmed by field inspection from DWR staff. Any
expanded use of this well occurring on or after May 8, 1972, or any use that had been abandoned by 10 or mar- ,3(. 2
consecutive years of non-use, shall not be covered by this permit.

• Ladies and Gentlemen:
This Notice of Mineral Interests ("Notice") is submitted to the members of the Planning
Commission and the Board of County Commissioners for Weld County regarding an application
for a site specific development plan and use by special review permit that has been submitted to
the County by Dave's Oil Field Construction ("Applicant") that covers property in the W/2E/2 of
Section 32, Township 4 North, Range 64 West("Property").
This letter is notice to the County that Kerr-McGee Oil & Gas Onshore LP ("Kerr-
McGee") owns mineral interests, including the oil and gas, for the Property. Kerr-McGee is giving
notice of the mineral interests it owns in the Property and of its continuing rights to develop its
mineral interests in accordance with applicable law and regulations.
1. The Kerr-McGee Oil and Gas Interests.
Kerr-McGee's recorded oil and gas leases and mineral rights are a real property interest
that entitle it to develop, operate and maintain oil and gas wells on the leased lands in accordance
with applicable local and Colorado Oil and Gas Conservation Commission ("COGCC")
regulations.
Kerr-McGee operates three wells in the W/2E/2 of Section 32, one in the NW/4NE/4,
another in the SW/4NE/4 and a third in the NE/4SE/4. COGCC records further reflect that Noble
• Energy, Inc. operates a well in the SW/4SE/4 of Section 32.

2. Site Specific Development Plan.
Kerr-McGee has no objection to the Application or the site plan that the Applicant currently
proposes. The locations for existing oil and gas wells and for the access routes that Kerr-McGee
utilizes to access the wells are depicted on the Applicant's site plan, a copy of which is attached to
this Notice.
The Applicant has requested that Kerr-McGee discontinue its use of one of two roads that
Kerr-McGee currently utilizes to access the well in the NW/4NE/4 ("NW/4NE/4 Location") on the
west and identified on the Site Plan as "Exist. Oil & Gas, AG Access to be Closed" and that Kerr-
McGee use only the access road to the east identified on the Site Plan as "Exist. Oil & Gas, AG
Access Proposed" ("Proposed Access Road") to access the NW/4NE/4 Location. Kerr-McGee and
the Applicant have agreed that Kerr-McGee will access the NW/4NE/4 Location from the Proposed
Access Road.
Please make this Notice and the comments in it a part of the record in the proceedings.
