Comments made during this stage of the review process will not be all inclusive; as revised materials are submitted other concerns or issues may arise. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011) CR 54 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by the City Of Evans. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate or dedicate an additional 40-foot of right-of-way parallel to the CR 54 right-of-way for full build- out. Storm Water Drainage: The applicant has provided calculations for a water quality control feature. These calculations appear to be acceptable to Public Works. REQUIREMENTS: Access: The City of Evans has jurisdiction over all accesses to CR 54 & CR 27.5. Please contact the City of Evans (970-339-5344) to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. Weld County Department of Public Works is requiring a fence to be placed at the corner to prevent cars/pickups from accessing the site at this location. Utilize only approved access points from the City of Evans. A vehicle tracking control pad consisting of recycled gravel or asphalt will be required to prevent tracking of material from your site in the way of mud or debris on to Weld County Roads. This needs to be placed and shown on the plat drawing across both lanes. A stop sign shall be installed at the approved City of Evans access point as a safety item. Please add the following development standards to the plat: 1. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. 2. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. 3. Weld County will not maintain on-site drainage related areas or medians. This must be addressed by the homeowner's association or owner. 4. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction. The grading permit application must contain: an erosion and sediment control plan, a grading plan, installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be utilized, and a copy of the approved CDPHE stormwater permit. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. There is currently a house and several outbuildings located on the parcel. The application indicates there will be 4 full time employees and up to 6 drivers. No information was provided whether there will be painting or welding on site. An air emissions permit from the State may be required. Permanent drinking water and sewage disposal facilities are required. There is an individual sewage disposal system that serves both the house and a shop (SP- 0500106). The system is sized for 3 bedrooms which corresponds to 6 people. If the usage exceeds 6 people an engineer's review is required. The parcel is served by City of Greeley water. A waste handling plan was submitted but did not include the names of the companies that will provide recycling services for oil, batteries and tires. Northern Colorado Disposal will provide trash service. A dust abatement plan was submitted which states the onsite traffic area is graveled and magnesium chloride will be applied if necessary. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. Alternately, the applicant can provide evidence from the APCD that they are not • subject to these requir • 2. The applicant shall submit an updated waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: The waste handler and facility where the oil, batteries and tires will be disposed of (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential • nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, hand washing and toilet facilities shall be provided for employees of the facility, at all times. 8. Sewage disposal for the facility shall be by septic system. As the applicant intends to utilize the existing septic system for employees, the septic system shall be reviewed by a Colorado Registered Professional Engineer if the usage exceeds 6 people. If the system is found to be inadequately sized or constructed the system shall be brought into compliance with current regulations. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. • 9 • 9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the existing public water supply. (City of Greeley) 10.All hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 11.Floor drain wastes shall be captured in a watertight vault and hauled off for proper disposal. The City recommends that landscaping be installed in two locations on site, first, along the Two Rivers Parkway future right-of-way from the existing vegetation northward to the southern edge of the 37th Street right-of-way. The City recommends planting the vegetation so as to not interfere with the eventual cross-section or sight-distance areas of Two Rivers Parkway. Second, along the western border of the site to suppliment the existing fence on the property. ❑ Existing The provided plans indicate the existing home on the site will be removed. This memo traffic study shall detail how many trips, distribution, types of vehicles, time of day trips, existing access points, etc. This traffic memo will be used to determine if roadway improvements are necessary to handle the large vehicles at the intersection of 37th Street and WCR54 (Two Rivers Parkway). The City has roadway maintenance responsibilities for 37th Street. Upon receipt of the TIS the City will determine if a maintenance agreement will be required between the City of Greeley and the developer. Water/Sewer Page ❑ Code At this time the site is required to install appropriate backflow prevention devices on the domestic service line and lawn sprinkler system, if applicable. Please install an A.S.S.E. approved backflow prevention assembly(reduced pressure principle assembly) on the water service line after it first enters the building and where a floor drain of adequate size exists. This assembly shall be tested by a certified tester upon installation. This water tap in the past was charged as an outside city residential tap but with the proposed use it will change to an outside commercial tap. The gallonage rate will go from $7.68 per 1,000 gallons used to $7.49 per 1,000 gallons used, it will also be subject to the annual raw water surcharge. The base annual allotment will be 244,000 gallons based on a letter of understanding with a previous property owner. Any annual consumption over the base will be surcharged annually. We realize that while in Weld County, this parcel does have a strong connection to the City of Evans and that area is bordered on the east by land within the growth boundary of the City of Evans. It is not within the Evans Fire Protection District although we have an automatic aid agreement to respond to that area in case of a structure fire or a wreck. We appreciate the ability to give our feedback on the use, especially since the site is located at a major intersection of two roads (Two Rivers Parkway and 37th Street) that are major entrances to the City of Evans. The City has some significant concerns regarding access, road improvements, right of way, and compatibility of the site.
