RE: APPROVAL OF RECORDED EXEMPTION NO. 385 - DAVID DUELL, ET AL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado at a public hearing held on
the 11th day of April, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 385 , being the property of
David Duell, et al, described as Part of the Southeast Quarter
of the Southeast Quarter of Section 10 and Part of the Northeast
Quarter of the Northeast Quarter of Section 15, Township 5 North,
Range 65 West of the 6th P.M. , Weld County, Colorado, being more
particularly described as follows :
A tract of land being a part of lots 1, 2, 5, and 6
and all of Lots 7 and 8 of the Southeast Quarter of
the Southeast Quarter of Section 10 and a part of
Lot 2 and all of tots 1, 3, 4, and 5 of the North-
east Quarter of the Northeast Quarter of Section 15,
all in Township 5 North, Range 65 West of the Sixth
Principal Meridian, Weld County, Colorado according
to the subdivision of lands made by the Union Colony
of Colorado and being more particularly described as
follows:
Beginning at the Southeast corner of said Section 10
and considering the Fast line of the Northeast Quar-
ter of said Section 15 to bear South 00°29'20" West
and with all other hearings contained herein being
relative thereto:
Thence South 00°29'20" West, along the East line of
the Northeast Quarter of said Section 15, 1331.40
feet to the Southeast corner of the Northeast Quar-
t-Pr of the Northeast Quarter of said Section 15;
Thence South 89°51'53" West, along the South line of
the Northeast Quarter of the Northeast Quarter of said
Section 15, 1157.67 feet;

Thence South 89°51'53" West, 161.60 feet to a point
on the West line of the Northeast Quarter of the
Northeast Quarter of said Section 15;
Thence North 00°25'49" Fast, along the West line of
the Northeast Quarter of the Northeast Quarter of
said Section 15, 1020.42 feet to the Southwest Corner
of the Southeast Quarter of the Southeast Quarter of
said Section 10;
Thence North 00°06'11" West, along the West line of the
Southeast Quarter of the Southeast Quarter of said
Section 10, 648.08 feet;
Thence North 89°01'10" East, 447.88 feet;

on the East line of lot 6 of the Southeast Quarter

east Quarter of the Southeast Quarter of said Section
10, 242.48 feet to a point on the South right-of-way
line of an existing county road;
Thence along the South right-of-way line of said
county road by the following two courses:
North 87°17'45" Past, 174.76 feet;
North 79°00'45" Past, 493.91 feet to a point on the
Fast line of the Southeast Quarter of the Southeast
Quarter of said Section 10;
Thence South 00°11'19" Fast, along the East line of
the Southeast Quarter of the Southeast Quarter of
said Section 10, 864.68 feet to the Point of Beginning.
Said tract of land contains 60.611 acres and is sub-
ject to any right-of-way or other easements as granted
or reserved by instruments of record or as now existing
on said tract of land.
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-lA(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by David Duell, et al, be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973 , as amended provided that 50 feet of right-of-
way be reserved for Fern Avenue and 22nd Street and also 40 feet
of right-of-way along East 18th Street and further that the
recorded exemption plat be amended to show the rights-of-way
as requested by the City of Greeley prior to recording the recorded
exemption plat.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 11th day of
April, A.D. , 1979 .

RE : Recorded Exemption #385
Dear Commissioners :
The attached application, plat and related items are in reference to
a request from Mr. David Duell , et al , for a recorded exemption. The
parcel of land on which this request has been made is described as
Pt. SE4SEw Section 10 and Pt. NE4NE4 Section 15, T5N, R65W of the
6th P. M. , Weld County, Colorado. This property is located approxi-
mately 1-1/2 miles east of the City of Greeley at the southwest corner
of the intersection of East 18th Street and Fern Avenue. The property
contains approximately 60. 6 acres of Class III and VI irrigated soils .
The request is to split the property into parcels of 2.8 and 57 . 7
acres .
Prior to making the application for a recorded exemption, David Duell,
along with his father, Harvey Duell, decided to divide this property
which was held together in a corporation of Duell Brothers , Inc . The
corporation has owned this property for approximately 10 years . They
made the decision to divide David' s home with 2 .8 acres from the
balance of the property. Subsequent to this division, Harvey Duell
sold the 57 . 7 acre parcel of land to another son, John Duell . The
reason for this request as stated in the applicant ' s letter dated
February 1, 1979, is "to put everything in order. "
Based upon the submitted information and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :

1 . The request is in compliance with the policies of the Weld County
Comprehensive Plan in that to minimize conflicting land uses ,
residential development will be encouraged to locate adjacent to
existing towns and in accordance with the comprehensive plans and
stated wishes of each community. The parcel of land is located
within 1-1/2 miles of the City of Greeley and is inside the Greeley
Comprehensive Plan. The City of Greeley Planning Commission has no
objections to this request .
2. This request is in compliance with the intent clause, Section 9-2
of the Weld County Subdivision Regulations , in that each resulting
parcel does have an existing set of improvements . The residential
uses would appear to be compatible with the surrounding agricultural
uses .
3 . This request complies with Section 9-4 A. of the Weld County Sub-
division Regulations .
The City of Greeley Planning Commission has requested that 50 feet of
right-of-way be dedicated for Fern Avenue and 22nd Street, which are
designated as arterial streets in the City of Greeley Comprehensive
Plan. Arterial streets require 100 feet of total right-of-way. In
addition, they have requested 40 feet of right-of-way along East 18th
Street which is dedicated as a collector street . The Department of
Planning Services Staff recommends that the recorded exemption plat be
amended to show the right-of-way as requested by the City of Greeley
prior to recording the recorded exemption plat.
It should also be noted that the Weld County Engineering Department has
recommended that the access to Lot A be defined and recorded. The
Department of Planning Services Staff concurs with that recommendation
// and recommends that the applicant provide a recorded access easement
V for Lot A. This would provide for an access to Lot A in the event Lot
B would ever be sold in the future.

February 1, 1979
David Duell, along with his father Earvey Duell, decided to divide
the land they held together in a corporation of Duell Brothers, Inc. ,
which they owned for approximately ten years . They made a decision
to divide Dave' s home with 2.8 acres from the rest of the land.
This was done and then Earvey Duell sold his parcel of land to
another son, John.
The purpose of this division of land is to put everything in order.

Re : Recorded Exemption #0961-10- 4-RE385, Fern Avenue $ 18th Street
At its March 27 meeting the Planning Commission considered the
requested recorded exemption for John Duell . It was found that
the land is located in compliance with the Comprehensive Plan
for residential development. It was also found that land should
be reserved on the recorded exemption plat to provide for a fifty
foot right- of-way for the Fern Avenue arterial and fifty fefor
the 22nd Street arterial and forty feet for a collector street along
East 18th Street. The Commission voted to recommend no objections
subject to dedication of additional street right-of-way.
The Planning Commission appreciates the opportunity for comment.
