Conway, Chair Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Chris Gathman Public Works representative, Heidi Hansen Health Department representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated June 1, 2012, and duly published June 6, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0023, for any Use Permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (control room, carbon beds, amine units, utility buildings, PDC buildings, dehydration units, cryogenic units, refrigeration units, residue compressors, vessels, tanks, towers, and flare stacks), provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. El Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He indicated the location of the site, reviewed the surrounding land uses and explained the Four-lot Recorded Exemption application was reviewed by the Board last month, and once the plat is recorded, then the legal description for this case will need to be modified prior to signing the finalized Resolution. Mr. Gathman reviewed the referral responses, fit- UR, ?L i t-44- 2012-2146 �_ �I-I PL2171 HEARING CERTIFICATION - KERR-MCGEE GATHERING, LLC (USR12-0023) PAGE 2 displayed a site map and photographs of the site and surrounding area, and responded to questions from the Board regarding the comments from the Fort Lupton Fire Protection District. Commissioner Kirkmeyer requested Development Standard #12 be modified to state, "The operation shall comply with all applicable rules, policies, and regulations of the Colorado Oil and Gas Conservation Commission." El Heidi Hansen, Department of Public Works, reviewed the roadway classification, average daily traffic count, and the proposed site improvements. She stated the access permit has been approved, and the applicant will be required to submit a Final Drainage Report and Grading Permit. EI Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions for the property and on-site dust mitigation plans. She requested Condition of Approval #1.D be deleted, stated Condition #1.C addresses the APEN requirement, and Development Standards #5 through #19 are typical requirements for this type of facility. Mr. Gathman addressed the Board's previous question and indicated the applicant completed a follow-up report and the Fort Lupton Fire Protection District approved the permit with comments. El Vince Harris, Baseline Corporation, represented the applicant and introduced Rick Benning, Baseline Greeley Office Manager, and Jay Allen, Anadarko representative. He reviewed the proposed operations, displayed a photograph of a similar site in Utah, reviewed various slides from the PowerPoint presentation, marked Exhibit C, and provided an overview of the site layout. He also confirmed the comments and requirements of the Fort Lupton Fire Protection District have been satisfied. EI Jay Allen, Anadarko Petroleum, explained the facility is intended to provide additional processing capacity, which is very necessary for the company to meet the increased production demands created through the drilling program. He stated they have made a very large financial commitment, in the amount of more than $100 million, for Phase 1, which they plan to have operational by January, 2014. He responded to questions from the Board on the anticipated processing capacity and the timing for Phase 2, and explained they will be closing the far west access to gain approval from the Department of Public Works for the requested primary access. El No public testimony was offered concerning this matter. In response to Chair Conway, Mr. Allen stated the applicant has no concerns with the Conditions of Approval or Development Standards, as proposed. Following discussion, the Board agreed to consolidate the language in Conditions #1.A.10 and #1.A.11 to state, "Setbacks from oil and gas wells and wellheads." In response to Commissioner Kirkmeyer, Mr. Allen reviewed the screening of the tower and stated the applicant is in agreement with staffs requirements. The Board also agreed to delete Conditions of Approval #1.A.13 regarding screening and #1.D, as recommended by staff. E Commissioner Long moved to approve the request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0023, for any Use Permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (control room, carbon beds, amine units, utility buildings, PDC 2012-2146 PL2171 HEARING CERTIFICATION - KERR-MCGEE GATHERING, LLC (USR12-0023) PAGE 3 buildings, dehydration units, cryogenic units, refrigeration units, residue compressors, vessels, tanks, towers, and flare stacks), provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included consolidating the language in Conditions #1.A.10 and #1.A.11 to state, "Setbacks from oil and gas wells and wellheads.", deleting Conditions of Approval #1.A.13 and #1.D, and modifying Development Standard #12 to state, "The operation shall comply with all applicable rules, policies, and regulations of the Colorado Oil and Gas Conservation Commission." The motion was seconded by Commissioner Garcia, and it carried unanimously. (Clerk's Note: Condition of Approval #5 was also deleted for consistency with the Board's intent to eliminate the screening requirement) The Board expressed its appreciation for the applicant's investment into Weld County and indicated they are looking forward to the completed project. There being no further discussion, the hearing was completed at 3:35 p.m. This Certification was approved on the 23rd day of July, 2012.
