WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 28th day of November, 2012, at the hour of 9:00 a.m., in the Chambers of the Board for the purpose of hearing the application of West Hill N Park, Inc., c/o Elmer Lundvall and John Schupe, 2015 Clubhouse Drive, Greeley, Colorado 80634, for a Resubdivision, RES12-0001, for a lot line adjustment between lots 4, 5, and 6 of MJF-1062 (Replat of Lot "B" Hill-N-Park Subdivision) on the following described real estate, to-wit: Lots 4, 5, and 6 of MJF-1062 (Replat of Lot "B" Hill-N-Park Subdivision); located in part of the SW1/4 of Section 26, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the applicant was represented by John Clarkson, Benchmark Custom Homes, 1705 32nd Street, Evans Colorado 80620 and WHEREAS, Section 24-3-50 of the Weld County Code provides standards for review of said Minor Subdivision Final Plan, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24-5-40.6 of the Weld County Code. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24-5-30.C of the Weld County Code, including specifically: A. Section 24-5-30.C - The plot line revision complies with the approved recorded MJF-1062 plat. B. Section 24-4-30 - The lot line revision complies with the Weld County Code and regulations in force and affecting the subdivision. PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of West Hill N Park, Inc., for a Resubdivision, RES12-0001, for a lot line adjustment between lots 4, 5, and 6 of MJF-1062 (Replat of Lot "B" Hill-N-Park Subdivision) on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to Recording the Resubdivision Plat: A. The plat shall be amended to include the following: 1) All plats shall be labeled RES12-0001. B. The following notes shall be placed on the plat: 1) This Resubdivision is a for a lot line adjustment between Lots 4, 5, and 6 of MJF-1062 (Replat of Lot "B" Hill-N-Park Subdivision). 2) Pursuant to Chapter 15, Articles I and II, of the Weld County Code, if noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of twelve (12) inches until the area is completely developed. C. The applicant shall submit three (3) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services D. The Department of Planning Services respectfully requests a digital copy of this Resubdivision, as appropriate. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles or ArcGIS Personal GeoDataBase (MDB). The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This digital file may be sent to maps@co.weld.co.us. 2. Upon completion of Condition of Approval #1 above, the applicant shall submit a Mylar plat, along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Sections 24-4-40.D.6 through D.8 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners Resolution. This will ensure that the single-family residence being constructed on Lot 5 will meet the minimum offset from the south property line. There is an existing ten (10) foot utility easement along the boundary of Lot 5 and Lot 6. The lot line adjustment will not affect any existing utilities as the utility easement along the lot line between Lots 5 and 6 will remain in the same location and has been widened by two-feet on Lot 5 to account for the lot line adjustment. THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 24-5-40.B of the Weld County Code. 2. It is the opinion of the Department of Planning Services' Staff that the application has shown compliance with Section 24-5-30.C of the Weld County Code, as follows: A. Section 24-5-30.C -- Which the lot line revision complies with the approved recorded final plat. The plot line revision complies with the approved recorded MJF-1062 plat. B. Section 24-4-30 — That the lot line revision complies with the adopted rules, regulations and ordinances currently in force and affecting the subdivision. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral agencies. During construction of a house on Lot 5, several problems were encountered: 1 -there was a scrivener's error involving mislabeling of the common line between Lots 4 and 5 2 -due to the error on the plat and a misunderstanding regarding set back distances; the structure was laid out such that it does not meet the setback as required by Weld County Code. As provided by Weld County Code, a correction plat was submitted to the Department of Planning Services to deal with the scrivener's errors and this Lot Line Adjustment application is being submitted to deal with the setback issues. The following adjustments have been made to Lots 4, 5, and 6: I - The line common to Lots 4 and 5 has been offset north 2.00 feet 2 - The line common to Lots 5 and 6 has been offset south 2.00 feet 3 - The easement along the common line to Lots 5 and 6 has been adjusted to 7 feet on the north side(Lot 5) and 5 feet on the south side(Lot 6). This assures that any infrastructure that may have been constructed in the original will still be covered by the easement 4 - Areas and dimensions for all lines have been recalculated for Lots 4, 5, and 6 as necessitated by the moving of the 2 lot lines. Weld County Code provides for corrections for scrivener's errors and a Lot Line Adjustment process. Lots 4, 5. and 6, will meet or exceed minimum requirements for frontage and area.
