FROM: Heidi Hansen, P.E., Public Works Department SUBJECT: USR12-0023, Kerr-McGee Gathering, LLC A Use by Special Review permit for a cryogenic facility for the processing of natural gas products. The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 22 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. There is 60 feet of unmaintained section line right-of-way along the CR 33 section line (30 feet on either side of the section line). Please show and label this right of way on the Plat. • The traffic memo states that there will be up to 56 vehicle trips/day with 4 roundtrip semi-trucks per day as part of that count. The tracking control stated in the application as 100 feet of pavement plus double cattle guards is acceptable as are the turning radiuses of 65 feet. Please show and label these items on the Plat. An improvements and road maintenance agreement is required for this site. Public Works will provide a draft of the agreement after the Board of County Commissioners hearing for this project. Items to be expected in the agreement include, but are not limited to, a proportional share of haul route maintenance (from the site access to Hwy 85). An example Improvements Agreement is available on the County Planning website under Application Assistance. The application proposes two accesses to the site, an existing and a proposed new access. Please submit access photos at the proposed accesses (looking up and down the roadway and into the site). Secondary accesses onto an arterial roadway are not normally granted. Please contact Janet Carter, Traffic Engineer, at 970-304-6496 x3750 to discuss possible options for closing an access in order to open the new one. Please show the approved access(es) on the Plat and label with the approved access permit number(will be provided when the new access is worked out). The applicant provided a "Sketch Plan Drainage Report" dated March 14, 2012 and signed and stamped by Mark A Skelskey PE 39396 with Samuel Engineering. This preliminary report is acceptable. Please submit a Final Drainage Report following the checklist available on the Public Works website prepared by a Professional Engineer registered in the State of Colorado. Additional comments may follow when the Final Drainage Report has been reviewed. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. b. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. c. There will be eight permanent employees on site as well as various contractors. A commercial well will provide water and an engineered individual sewage disposal system will provide sewer. On site dust will be controlled by having the access drive and circulation area graveled and parts of the site will be planted with native vegetation. A water truck will be utilized if necessary. The waste handling section of the application indicates a Spill Prevention, Control and • Countermeasure Plan (SPCC Plan) will be developed for this site. A copy of the plan shall be kept on the site at all times and be provided to the Department of Public Health & Environment. The waste handling section also states that additional waste generation and disposal information was provided in the waste handling plan included in the appendix, however no appendix was attached. Noise may be regulated by the Colorado Oil and Gas Conservation Commission. The use of berms, sound walls and enclosing equipment in a sound proof building could be utilized to limit noise impacts if necessary. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment to Environmental Health Services Division of the Weld County Department of Public Health & Environment. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. • • 2. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be provided to Environmental Health Services Division of the Weld County Department of Public Health & Environment. 3. The applicant shall submit written evidence from the Colorado Division of Water Resources, demonstrating that a well can be appropriately permitted for the industrial use. 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 2) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 3) A list of the type and volume of chemicals expected to be stored on site. 4) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). • 5) A copy of the SPCC plan. We recommend that the following requirement be incorporated into the permit as a condition that must be met prior to the issuance of a Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards. 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid • 2 waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., • as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code, or with all applicable State noise statutes and/or regulations. 7. The operation shall comply with all applicable rules and policies regulated by the Colorado Oil and Gas Conservation Commission. 8. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All • chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 9. The Spill Prevention, Control and Countermeasure Plan shall be available on site, at all times. 10.Adequate drinking, handwashing and toilet facilities shall be provided for employees and contractors of the facility, at all times. 11.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 12.This application is proposing a well as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. • 3 13.Any septic system located on the property must comply with all provisions of the • Weld County Code, pertaining to Individual Sewage Disposal Systems. 14.The applicant shall obtain a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, as applicable. 15.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. • • 4 18. It is recommended that a code analysis be done on the project by a design professional with experience in this area. • A building permit application must be completed and two complete sets of engineered plans including engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report performed by a registered State of Colorado engineer shall be required. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. I have attached your referral sheet, my comment sheet and I have sent as an attachment the resolution from Weld County approving our adoption of the 2003 IFC. In this adoption and resolution, all cryogenic storage is prohibited within the boundaries of the Fort Lupton Fire Protection District unless a special use/storage permit is issued by the Fort Lupton Fire Protection District Board of Directors. I am asking that we collect more information from Kerr-McGee/Anadarko and have a formal plan review and when everything is up to par it can be taken to the Board of Directors and await their review and decision. The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28-101(10)(a), C.R.S. Therefore. pursuant to the State Engineer's March 4. 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water • supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. This referral is related to a letter we provided on April 6. 2012 for RECX12-0044 and 45. This use by special review referral is for a cryogenic facility for processing natural gas on 110 acres. The proposed water source is a well. The proposal did not include water use requirements. There are several options for a commercial well on the site including a commercial exempt well, which can be issued for drinking and sanitation purposes only, or a non-exempt well withdrawing water from a nontributary source. which could be issued for uses beyond drinking and sanitation. Based on the submitted information, this office has not identified any concerns with the proposal. Well permits will be evaluated when they are submitted.
