The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 55 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant stated that there will be 37 employees with proposed traffic including 31 roundtrip trucks per day (62 truck trips/day). The applicant will utilize the existing access to the property. Additional accesses will not be granted. Please show the approved access point on the plat and label it with the Access Permit number (will be provided). Access improvements are required and shall include 60' radiuses to accommodate turning trucks and tracking control to prevent the tracking of mud onto the gravel roadway. Standard tracking control for accesses onto gravel roads includes double cattle guards at the access point. An improvements and road maintenance agreement is required for this site. Public Works will provide a draft of the agreement after the Board of County Commissioners hearing for this project. An example Improvements Agreement is available on the County Planning website under Application Assistance. Dust Control will be required along the specified haul route. A Water Quality design has been submitted and is acceptable. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Show the approved access point on the plat and label it with the Access Permit number (will be provided). 2. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. b. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. c. Weld County is not responsible for the maintenance of onsite drainage related features. There will up to 37 employees using the site, with the majority drivers, 1 mechanic stationed at the site and 1-2 laborers who will also work in the storage yard and shop along with off-site duties. There is a domestic well that serves the facility (Permit No. 279207), and is approved for household purposes only. The applicant will need to re-permit the well for the proposed commercial use through the Colorado Division of Water Resources. The applicant is proposing to use a portable toilet for sewage disposal for the employees. Since there will be both employees stationed onsite and drivers accessing the site, permanent sewer is required. The dust abatement plan indicates that the access drive, yard and parking areas are covered with 3/4" road base, speeds are limited to 10 mph, and water or mag chloride will be utilized to mitigate onsite dust. The waste handling plan stipulates that a dumpster will be provided for refuse and will be serviced by Northern Colorado Disposal. Waste vehicle fluids will be removed by Raptor Used Oil Co. Scrap metal is taken to Anderson Salvage. Used batteries are exchanged at Hensley Battery. The waste handling plan needs to be revised to include the telephone numbers and addresses of the waste handlers and disposal companies. If tires are changed in the shop, include name, address and phone number where tires are disposed/recycled. The applicant is proposing to install a used oil burner for heating the shop and the majority of the waste oil generated onsite will be used in the heater. The applicant will need to submit the manufacturer's specifications on the used oil heating unit to Environmental Health Services to determine if it is APEN exempt. There is a concrete fueling pad and fuel containment area depicted on the site plan. No information on the types and quantities of fuels was provided in the application. Depending on the quantities of fuels stored, the applicant may be required to register the fuel tank(s) with the Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section. In addition, a Spill Prevention, Control and Countermeasure Plan may be required. The fuel containment area should be of sufficient capacity to contain the volume of the largest single tank including sufficient freeboard for precipitation. The applicant shall submit a containment plan to include capacity of containment area and the construction material (e.g. concrete). We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1 . The applicant shall submit manufacturer specifications on the proposed used oil heater to Environmental Health Division of the Weld County Department of Public Health & Environment. 2. In the event washing of vehicles will occur on site the applicant shall ensure that any vehicle washing area(s) shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. Vehicle washing areas should be designated on the plat. 3. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 4. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. 5. The applicant shall submit evidence of an Aboveground Storage Tank permit from the Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section for any aboveground storage tanks located on the site. Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection Section that they are not subject to these requirements. 2 6. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be provided to Environmental Health Services Division of the Weld County Department of Public Health & Environment. In accordance with Section 3-6-1 of the Colorado Department of Labor and Employment Division of Oil and Public Safety Storage Tank Regulations (7 C.C.R. 1101-14) as well as EPA regulations (40 CFR Part 112). 7. The applicant shall submit a containment plan for the fuel storage area to include capacity of containment area and the construction material (e.g. concrete). 8. The applicant shall submit written evidence from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the commercial use. 9. The waste handling plan needs to be revised to include the telephone numbers and addresses of the waste handlers and disposal or recycling facilities. If tires are changed in the shop, include the name, address and phone number where tires are disposed or recycled. 10. If there are floor drains in the maintenance shop, the applicant shall submit documentation that floor drain waste is captured in a watertight vault and hauled off for proper disposal. Include the name, address and phone number of the waste hauler and disposal facility. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. The applicant shall comply with all provisions of the State Underground and 3 Above Ground Storage Tank Regulations. 6. In accordance with the Underground and Above Ground Storage Tank Regulations (7 CCR 1101-14) a spillage retention berm shall be constructed around the aboveground fuel tanks. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. Alternative protective measures may be allowed provided they comply with the Above Ground Storage Tank Regulations. 7. Any vehicle washing area(s) shall capture all effluent and prevent discharges from drum washing and the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 8. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 9. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 10. Adequate hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 11 .Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 12. In the event the facility's water system serves more than 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld County Department of Public Health and Environment that the system complies with the Regulations. 13.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 14. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. 15.The Spill Prevention, Control and Countermeasure Plan shall be available on 4 site, at all times. 16.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 17.This application is proposing a well(s) as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. 5 MEMORANDUM WI`Dc COLORADO To: Chris Gathman, Planner December 14, 2012 From: Bethany Salzman, Zoning Compliance Officer Subject: USR12-0054 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV12-00098)was noted. This violation was initiated due to the operation of an oil & gas Support and Services business without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual court date being scheduled, no investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. This application if approved by the Board of County Commissioners and once a plat is recorded will correct the violation. If this application is denied, all oil &gas operations and associated activities and/or storage shall be removed from the property within 30 (thirty)days of denial or the violation will proceed in court accordingly. A code analysis, floor plan an complete set of plans for any alteration and a structural analysis may be required by a professional engineer will be required. A building permit will be required for any new construction, alteration, or addition to any buildings or structures on the property. It is required that a code analysis be done on the project by a design professional with experience in this area. A building permit application must be completed and two complete sets of engineered plans including engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report performed by a registered State of Colorado engineer shall be required or a open hole inspection.. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The proposal is to use this 20 acre parcel for oil and gas support services, specifically, parking trucks, dispatching drivers, and maintenance on trucks. The proposed water supply is an existing well with permit no. 279207. The well permit was issued on November 6, 2008 for household purposes inside one single family dwelling. We require that the well with permit no. 279207 be re-permitted consistent with the use on the property. Exempt-commercial well permits can be issued for drinking and sanitation purposes inside a business, with no outside uses. The ability of the applicant to obtain a new well permit will be evaluated at the time the well permit application is received by the State Engineer's Office.
