DIRECTOR REGARDING ASSESSMENT OF A ROAD IMPACT FEE IN RELATION TO
BUILDING PERMIT FOR EXPANSION OF EXISTING WAREHOUSE FACILITY -
NORFOLK IRON AND METAL
WHEREAS,the Board of County Commissioners of Weld County,Colorado,pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County,Colorado,and
WHEREAS,pursuant to Section 20-1-80.H of the Weld County Code,the Board of County
Commissioners has received an appeal from Norfolk Iron and Metal,do Ron Wildeman,concerning
the decision by the Department of Planning Services Director regarding the assessment of a Road
Impact Fee in relation to Building Permit,BCR12-00484,for the expansion of an existing warehouse
facility,located at 31181 County Road 39.5,Greeley,Colorado 80631,and
WHEREAS, upon consideration of such appeal, including a review of all information
submitted by Norfolk Iron and Metal and the Department of Planning Services,the Board deems it
advisable to affirm the decision of the Director of Department of Planning Services concerning the
assessed Road Impact Fee in relation to said building permit.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the decision of the Director of the Department of Planning Services be,and
here by is,affirmed and the appeal of Norfolk Iron and Metal be,and hereby is dismissed.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 11th day of June,A.D.,2012.

Study Decision for Road Impact Fee

Norfolk Iron & Metal (NIM) has appealed (attachment #1) my decision of an Independent Fee Calculation
Study for their assessed road impact fee. The appeal was filed in accordance with 20-1-80.H. of the Weld
County Code.
It is my recommendation that the Board of County Commissioners uphold the fee assessed in my letter to NIM
dated May 17, 2012 (attachment#2). The fee assessed is $59,480.
Background:
NIM is an existing business located at 31181 Weld County Road 39-1/2. The business is located in the 1-3
zone and is permitted via a Site Plan Review with the County. The general nature of the business is the
warehousing and distribution of steel products. The site currently consists of a 110,000 square foot warehouse
and an ancillary building. They currently employ 75 people. At build out, the warehouse will be approximately
250,000 square feet. Additionally, NIM anticipates adding 30 employees for a total employee count of 105.
A road impact fee (RIF) of $142,699 was originally assessed to NIM for their approximate 140,000 sq. ft.
expansion to their existing facility. The expansion will be used to warehouse steel products. The fee was
assessed per section 20-1-60 of the Weld County Code (WCC) using the Land Use Category, identified as a
"warehouse". NIM notified me of their intent to conduct an Independent Fee Calculation Study because of their
belief that there are unique and permanent features to their development that would reduce traffic impacts over
the long term. NIM submitted an Independent Fee Calculation Study (attachment #3) that was conducted by
Drexell, BarrelI, and Co. The Drexel) study was provided to our Public Works Department for their review,
consideration, and recommendation.
After receiving and reviewing the recommendation (attachment#4) from Janet Carter of our Public Works staff
I determined that the Road Impact Fee assessed to NIM's building permit should be assessed using the Land
Use Category of "mini-warehouse". This determination was based upon the fact that the number of vehicle
trips associated with a "mini-warehouse" most closely aligned with the anticipated vehicle trips associated with
the addition to the Norfolk facility. This determination resulted in an assessed fee of $59,480, as opposed to
the "warehouse" fee of$142,699 (which was originally assessed).

Dear Ron:
Please accept this letter as my determination of the Road Impact Fee (RIF)for building permit BCR12-
00484.As you are aware,this building permit was submitted earlier this week. This determination was
made, and is being provided to you, in accordance with Section 20-1-80 of the Weld County Code (WCC)
following staff review of your submitted Independent Fee Calculation Study. Your study, submitted April
5, 2012,was conducted by Paul Moreau, P.E.,of Drexel Barrel!.
In short, it is my determination that the RIF for your building permit should be calculated as a "mini-
warehouse" rather than a "warehouse" per the WCC. This determination results in a Road Impact Fee of
$59,480, as opposed to the warehouse fee of$142,699. I have attached the summary of the technical
review conducted by Janet Carter of the Weld County Public Works Department.
As we have discussed,Section 20-1-80.E.1.of the WCC provides you an opportunity to appeal my
decision should you choose to do so. If you intend to appeal my decision I suggest you review this
section at your earliest convenience as there are certain timing requirements that must be adhered to.

Norfolk Iron & Metal Co. (NIM) believes that they currently operate below industry standard in
regard to trip generation. The purpose of this study is to prove this assertion and project future
trip generation with the proposed expansion of their facility.
Background
NIM is an existing business located at 31181 Weld County Road 39-1/2 in unincorporated
Weld County. The general nature of the business is the warehousing and distribution of steel
products. The site currently contains an 110,000 square foot warehouse building with a
smaller ancillary office building on 25.82 acres. NIM currently employs 75 people and is
operating 5 days a week. There are office 15 employees and 15 delivery drivers that typically
work 7:30 am to 4:30 pm, Monday thru Friday. The remaining 45 employees are warehouse
employees that work the three shifts per weekday. The shift times are 7 AM-3PM, 3 PM-11
PM, and 11 PM-7 AM. The warehouse staff starts work Sunday night at 11 PM and ends
Friday night at 11 pm. The existing driveway peak hours occurred during the following
periods: 6:30-7:30 AM, 2:30-3:30 PM, and 10:30-11:30 PM. This is as expected given the shift
hours.
Access to the site consists of a single driveway on the county road and a single railroad spur.
The proposed expansion of the operation calls for an additional 130,000 square feet of
warehouse space and a new rail spur/switch with no change to the site size. At buildout, this
will bring the total warehouse size to 240,000 square feet. NIM anticipates adding 30
employees by the time the project is complete and the warehouse is functioning. This will
bring the total employee count to 105. No change in the office staff number is anticipated.

Trip Generation
In support of this study, the existing site driveway was surveyed for 24-hours starting at
midnight Wednesday, March 28th until midnight Thursday, March 29th. The results of this
survey show the number and type of vehicle per hour and direction of travel throughout the
survey period. A copy of this study is enclosed. NIM's operations do not vary substantially
from day-to-day or seasonally so this study will serve as the basis for existing site trip
generation.
Typically, peak hour and daily trips are estimated using calculated rates published in the Trip
Generation manual. This manual is currently in its 8`h edition and is an industry accepted
informational report published by the Institute of Transportation Engineers. As a comparison,
the existing site information will be compared to various standard parameters in the manual. In
this case, the comparable parameters are KSF or thousand square feet of building area,
Employee, and Acre. See Table 1, enclosed. The upper part of the table shows the number
of expected trips for both the existing site and buildout usage expected using the ITE trip rates.
The lower part of the table shows the actual driveway counted information and resultant trip
rates for the existing and buildout site. The existing site operation generated 272 vehicles
(129 in & 143 out)for the counted 24-hour period. There were 11 vehicles entering and 19
vehicles exiting during the AM peak hour and 2 vehicles entering and 19 vehicles exiting
during the PM peak hour. As one can see, the NIM site is operating at a significantly lower
rate than the industry expected standard. For the KSF variable, NIM operates at 69% of the
industry standard for an average weekday. For the EMP variable, NIM operates at 93% of the
industry expected standard for an average weekday. For the AC variable, NIM operates at
18% of the industry expected standard for an average weekday. Similar results occur for the
AM and PM peak hours as also shown on Table 1.
Truck&Rail Discussion
In 2011 NIM sold and delivered 82,917 tons of material by delivery truck. The loads averaged
20 ton each which equates to approximately 4,146 loads or about 16 truck loads per day.
(There are 260 working days in a year.)
NIM received 370 rail cars, or about 7 cars per week with the average of 75 tons of delivery
stock each for about 27,750 tons by rail in 2011.
With 82,917 tons sold and 27,750 tons received via rail car plus a carryover inventory of 365
tons means the remainder of the material arriving at NIM by commercial inbound truck was
54,802 tons. The inbound truck loads average 20 tons each as well. The approximate
number of commercial inbound loads last year was 2,740 trucks which equates to
approximately 11 loads per working day.
With the anticipated growth (post buildout) of an additional 6 truck loads to be sold and
delivered per day, NIM's annual tons sold will increase to 114,500 tons.
With the additional rail spur and switch, plus the additional warehouse square footage, NIM
anticipates the number of rail cars will increase from 370 to 1,180 cars per year or about 23
cars per week. ((1,180 rail cars x 75 tons = 88,500 tons/yr) + (5 trucks/day x 20 tons/truck x
260 working days/yr = 26,000 tons/yr) = 114,500 tons/yr)
By increasing the number of rail cars, the anticipated number of commercial inbound trucks
will decrease by about 6 loads a day. In regard to truck deliveries, the net difference is
anticipated to be zero or no additional truck trips to and from the site.

Conclusion
Given the analysis above, it has been shown that this development currently generates less
traffic than the industry standard and will continue to do so into the future even with the
expansion of the NIM site operations. I believe a reduction in the road impact fee is
warranted.

SUBJECT: Norfolk Independent Fee Calculation Review
Weld County Public Works has received an Independent Fee Calculation Study for the Norfolk Iron& Metal Expansion at
31181 Weld County Road 39-1/2;the study was prepared by Paul Moreau, P.E.The study appears to be acceptable. I
agree with study's conclusion that the road impact fee schedule should be reduced. I recommend that the fee should be
based upon a land use of Mini-warehouse($434 per 1,000 sq.ft.) instead of Manufacturing/Industrial ($2,043 per 1,000
sq.ft.) or Warehouse($1,041 per 1,000 sq.ft.).
The applicant is proposing an increase of 30 employees due to the facility expansion.This is an increase of 60 single trips
per day or 30 round trips to the facility. Due to the use of a railroad spur there will be no increase of truck traffic to the
facility. Utilizing the trip generation curve equation the average trips for Manufacturing/Industrial would be 496 trips.
Utilizing the trip generation curve equation the average trips for Warehouse would be 644 trips. Utilizing the trip
generation curve equation the average trips for a mini-warehouse would be 325 trips. The proposed trip generation
presented within the study is closer to the trip generation for the mini-warehouse than the warehouse and the
manufacturing/industrial use.
