To whom it may concern:
I am writing in regards to case number USRI 1-0017 in which Lawrence and Therese Scott have proposed
to expand their current storage lot to include a towing service and impound lot off highway 52 near about 1
mile west of Ft.Lupton. As the owner of the lot directly east of the Scott's there are several reason for my
concerns and objections to this proposed project,including previous land issues with the Scotts,the Scott's
lack of compliance with county and state regulations,and the value of my property.
To begin I have already had several legal issues with the Scoffs pertaining to their existing lot. I have
allowed access to the Scotts to use my entrance solely in order for them to be able to harvest their hay;
however,this access has been misused.The letter is in file with my lawyer. In the past my fence,leading
into my property,has been removed to place equipment and trucks being worked on by the Scotts on my
property. I am concerned that if this project is approved the Scotts will continue to unrightfully misuse my
lot for their own storage and access;the expansion of their lot could also decrease the value of my property.
There is also an issue with the lack of compliance in regards to state and county regulations with their
current Diesel and Farm Service.This includes the construction of a privacy fence surrounding the trash
• area as well as the county's limit of one faulty piece of equipment being allowed to sit on a site that is not
being worked on.This is a concern due certain state statues and zoning laws that pertain to this proposed
project.The first being title 43-1-503 which states no person shall establish,operate,and maintain a
junkyard which is within one thousand feet of the nearest edge of the right-of-way of the highway and
visible from the main-traveled way thereof unless a permit is first obtained from the department.There are
also concerns with hazardous materials.There is a high risk of contamination of the water table because
there is no containment system set up to handle such vehicles,which will be stored on the property.His
property is possibly also within the flood plain and there is a potential of hazardous materials leaking into
the water table if a flood were to occur.

Dear Mr. Scott:
I represent your neighbor, Freda Dreiling, as well as D&S Mining. Freda owns the 30
acre parcel in between Highway 52 and the area where LaFarge has a gravel mining operation.
The current LaFarge gravel mining operation is on 40 acres that is owned by D&S Mining and is
presently leased to I aFarge. The access road from Highway 52 to the gravel pit is on Freda's
property.
The purpose of this letter is to formally advise you that Ms. Dreiling does not have any
objection to your use of the private roadway across her property, but wants to make it clear that
your use of the roadway is because of her permission and that your use is not creating any sort of
legal interest or right to use this road on her property. She knows that you sometimes remove
sand and gravel material that is stockpiled at LaFarge's operation, but that is a matter between
you and LaFarge. LaFarge has mined and processed that sand and gravel and they own or have
the right to control it as long as they are current on their lease obligations with D&S Mining.
If you have any questions about this matter, please feel free to give me a call. I'd
appreciate it if you would sign a copy of this letter and return it to me in the enclosed envelope.
