RE: APPROVAL OF SPECIAL USE PERMIT FOR A DAIRY OPERATION FOR
PAT CANTRELL, ROUTE 1, BOX 66A, GILL, COLORADO 80624.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, held a public hearing on the 18th day of January, 1978 ,
at the hour of 2 : 00 o 'clock p.m. , in the Chambers of the Board
of County Commissioners, for the purpose of hearing the applica-
tion of Pat Cantrell, Route 1, Box 66A, Gill, Colorado 80624 , for
the granting of a Special Use Permit for a dairy operation on the
following described real estate, to-wit:
Part of the South Half (S1) of Section 22, Township 4
North, Range 64 West of the 6th P.M. , Weld County, Colorado,
being more particularly described as follows:
Beginning at the Southwest Corner (SW Cor) of said Section
22, and considering the west line of said Section 22, as
bearing North 00°00'00" East, with all other bearings con-
tained herein relative thereto;
Thence North 00°00'00" East, along said West line, 1,709.79
feet to the True Point of Beginning;
Thence continuing North 00°00'00" East, along said West line,
505.43 feet;
Thence South 89°28'31" East, 737.79 feet;
Thence South 01°02'51" West, 479.50 feet;
Thence South 88°29'14" West, 729.25 feet to the True Point
of Beginning.
Said described parcel of land contains 8.290 acres, more or
less, including a strip of ground 30 feet in width along the
West line of said described parcel reserved for County Road
ROW purposes and is subject to any rights-of-way or other
easements as recorded by instruments of record or as now existing
on said described parcel of land.
WHEREAS, the petitioner was present, and
WHEREAS, evidence was presented in support of the grant of
the Special Use Permit for a dairy operation on the above-described
real estate, and
WHEREAS, Section 3.3.E.4.d. of the Weld County Zoning Resolution
authorizes such a use in an Agricultural. District upon approval by
the Board of County Commissioners, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, heard all the testimony and statements of those present,

has studied the request of the petitioner and the recommendations
of the Weld County Planning Commission and all of the exhibits and
evidence presented in this matter, and having been fully informed
and satisfied that the request for a Special Use Permit for a
dairy operation on the hereinabove described real estate, conforms
to the purposes of Section 3. 3 .E. 4 .d. of the Weld County Zoning
Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application of the
petitioner for a Special Use Permit for a dairy operation on the
hereinabove described tract of land, be, and hereby is , granted
subject to the Development Standards contained in the Special
Use Permit.
BE IT FURTHER RESOLVED by the Board that the reasons for
apporval contained in the Planning Commission recommendations
dated December 6, 1977, be, and hereby are, incorporated as the
findings of fact of the Board of County Commissioners in this matter.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 18th day of
January, A.D. , 1978.

Be it Resolved by the Weld County Planning Commission that the
application for site approval of Dairy
covering the following described property in Weld County ,
Colorado , to-wit :

be recommended ( favorably ) ( ►K1 OT ) to the Board of County
Commissioners for the following reasons :
1. The proposed dairy agrees with the Weld County Comprehensive
Plan. Said plan states: "Expansion and development of agri-
business and agriculturally oriented industry will be encouraged,
provided the enterprises do not adversely affect the total
economy or environment. " It is felt that with the design of this
operation, there is little chance of adverse impact on the
surrounding environment .
2. It is the opinion of the Planning Commission that this proposed
operation is in compliance with the provisions of Section 3.3(E) (2)
of the Feld County Zoning Resolution, The proposed use will be
compatible with the surrounding area, in

agricultural uses, compatible with the future development in
the area and will not adversely affect the health, safety,
and welfare of the inhabitants of the area and the county.
This determination is based upon the following:
A. The management practices for the dairy operation as
outlined and controlled in the Development Standards
will make this operation compatible with the surrounding
area by minimizing the potential adverse impacts.
B. The proposal is for an agri-business in an agriculturally
zoned area, with existing land uses being predominantly
agricultural.
C. The Weld County Extension Agent has indicated the
facilities will provide adequate space for proposed number
of animals.
D. The Weld County Health Department has indicated the
proposed operation does not conflict with Weld County
and State Health Standards and Regulations.
E. The Weld County Engineering Department indicated no
engineering problems could be identified with the
proposed operation.
F. The applicant has submitted a petition form in support
of this application which has been signed by the
surrounding property owners within 500 feet.
Comment:
1. No response has been received from the Platte Valley Fire
District.

1. The dairy operation on the hereon described parcel shall
be limited to the facilities shown which are designed to
handle a total of approximately 500 total head of dairy
cows.
2. The Special Use Permit area shall be maintained in such a
manner so as to prevent soil erosion, fugitive dust , and
the growth of noxious weeds.
3. There shall be no discharge of wastes into any streams,
other bodies of water, or adjacent drainage systems with-
out obtaining a Wastewater Discharge Permit from the
Colorado Department of Health.
4. All sewage disposal facilities installed on the site and
management practices for the dairy shall conform with all
applicable Weld County and State Health Standards and
Regulations.

5. Any new access onto County Road 55 needsAapproved by the
County Engineer prior to installation.
6. The Special Use Permit shall be limited to the plans sub-
mitted and governed by the Development Standards stated
above. Any changes to the plans and/or Development
Standards shall require approval of another Special Use
Permit before such changes shallibe allowed.

I hereby certify that pursuant to a notice dated December 12,
1977, duly published December 14, 1977 and January 4 , 1978
in the Greeley Journal, a public hearing was held on the request
of Pat Cantrell for a special use permit for a dairy. Mr.
Cantrell was present at the meeting and made his request. There
was no one in the audience in opposition to the granting of the
SUP. After discussion, Commissioner Steinmark made a motion to
grant the SUP with the development Standards as recommended by
the Weld County Planning Commission. Commissioner Carlson seconded
the motion and it carried unanimously. All five Commissioners
were present at the hearing.

This is to acknowledge your request for soils information for 100 acres
located in the NZ of the Szj Sec. 22, Twp. 4N, Range 64W. Specific
request was made for information regarding construction of a dairy barn.
It is assumed the construction would be made in the area of the present
farmstead location.
The farmstead area is comprised of Vona loamy sand, 0 to 3 percent slope.
This is a deep, somewhat excessively drained soil on gentle plains and
high terraces. Typically the surface layer is a loamy sand about 6 inches
thick. The subsoil is a fine sandy loam about 22 inches thick. The sub-
stratum, to a depth of 60 inches is a sandy loam or loamy sand. Perme-
ability is moderately rapid. Available water capacity is moderate.
Effective rooting depth is 60 inches or more. Surface runoff is slow and
erosion hazard is low.
The soil exhibits only slight limitation for building which should allow
for standard design footings to be adequate for construction. This
interpretation indicates there is only a slight chance of finding special
physical hazards and only a slight chance that special design requirements
will be necessary. However, the soil descriptions and interpretations are
of a general nature and does not preclude the necessity of an on-site
investigation or tests by a competant soils engineer if special physical
hazards are encountered.
Other soil types located within the 100 acres area are: Olney fine sandy
loam, 0 to 1 percent slope; Vona sandy loam, 0 to 1 percent slope; Haverson
loam, 0 to 1 percent slope; Colombo clay loam, 0 to 1 percent slope. The
descriptions and soils map for all the mentioned soils are attached to
this report.
