RESOLUTION -�

WHEREAS, a public hearing was held on Atnil= 28 , 1975, in
the chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing a petition of Harlow Leeper, 3781 East 64th Avenue,
Commerce City, Colorado, requesting a change of zone from "A" Agricultural
District to "I" Industrial District - Planned Unit Development, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the change of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request of petitioner and studied the recommendations of the Weld County
Planning Commission as submitted, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petition of Harlow Leeper, 3781 East 64th Avenue,
Commerce City, Colorado, for a change of zone from "A" Agricultural
District to "I" Industrial District - Planned Unit Development, said area
being more particularly described as follows:
That part of the Southeast one-quarter of Section 31, Township
1 North, Range 66 West of the 6th Principal Meridian, Weld
County, Colorado, described as:
Beginning at the Southeast Corner of said Section 31; thence
South 90400'00" West on an assumed bearing along the South
line said Section 31 a distance of 1804. 55 feet to a point on
the West R. O. W. line of the Union Pacific Railroad Company;
thence North 13°47'30" East along said West R. O. W. line a
distance of 1205, 60 feet to the true point of beginning; thence
continuing North 13°47'30" East along said West R. O. W.
line a distance of 718. 46 feet to the Southeast corner of a
parcel of land described in Book 1598 Page 377, Weld County
records; thence South 90°00'00" West along the South line said
described parcel a distance of 182. 30 feet to the Southwest cor-
ner said parcel; thence North 00°00'00" West along the West
line said parcel a distance of 120. 00 feet; thence North 13°
47'30" East a distance of 627. 06 feet to a point 40. 00 feet South
of the North line said Southeast one-quarter Section 31; thence
South 89°52'30" West parallel with said North line a distance
of 316, 58 feet to the beginning of a curve to the right, the delta
of said curve is 17°18'55", the radius of said curve is 717. 38
feet, the chord of said curve bears South 08°31 '57" West 215. 97
feet; thence along the arc of said curve a distance of 216. 80 feet
to the end of said curve; thence South 17°11 '25" West a distance
of 332, 191 feet; thence South 90°00'00" West a distance of 721 . 733
feet to a point on the Easterly R. O. W. line of U. S. Highway No.
85; thence South 16°34'30" West along said Easterly R. O. W.
line a distance of 1065. 034 feet to a point 1045. 20 feet North
of the South line said Section 31; thence North 90°00'00" East
parallel with said South line a distance of 1004. 15 feet; thence
North 13°47'30" East a distance of 129, 41 feet; thence North
90°00'00" East a distance of 298. 90 feet to the true point of
beginning, containing 31 . 8376 acres more or less,

is hereby granted under the conditions following:
1. That any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2. All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the zoning resolutions
of Weld County, Colorado.
3. Subject to a minimum setback of 50 feet from Great Western
Road and a minimum of 100 feet from Old Highway No. 85.
4, Subject to providing allowance for proper semi-trailer movement
at the southwest corner of Lot 4 of said subdivision.
5, That said change of zone herein granted is conditional only for a
period of twelve months from date hereof, on condition that developer proceed
with due diligence to begin development of the area rezoned and submit plans
for such development for the approval of the Weld County Planning Commis-
sion and subsequent recording of said plans in the Office of the County Clerk
and Recorder of Weld County, Colorado; otherwise, the County may take
action to rezone the property to its present classification.

Gentlemen:
The Colorado Division of Highways, District IV, has reviewed the
Preliminary Plat for IDA Industrial Park Southeast Quarter, Section 31,
Township 1 North, Range 66 West, in Weld County. Comments on the above
are as follows:
1) The Division has controlled access by deed along present high-
way U.S. 85, thus, the developer will not be allowed access to
U.S. 85 directly from the lots. Access from U.S. 85 will have
to be made to Great Western Road at the proper intersections,
which seem to be adequate to handle the increase of traffic
caused -by this development.
2) As contour sheets were not submitted to the Division, it was
difficult to ascertain the amount of drainage which will flow
from the Industrial Park into the culverts under U.S. 85. The .
developer will be responsible for any increase in drainage into
our system. It is recommended that, if an increase is antici-
pated, the developer provide retention ponds to retain the in-
crease.
3) As air and noise pollution from highways are becoming an ever
increasing problem to dwellings and businesses which abut high-
way right of way, the Division is asking that buildings be set
back a minimum of 50 feet from the edge of the nearest roadway,
in this case Great Western Road, and 100 feet from old High-
way 85.
4)) Developer should make some provision for proper radii for turn-
\__ ." ing movements of semi-trailer trucks, especially at the south-
west corner of Lot 4.

The Brighton Planning Commission has reviewed your
referral notice dated May 20, 1975, in regard to a request
by Mr, Leeper, for a zone change from agriculture to
Industrial PUD and a preliminary plat for IDA Subdivision
in Pt. SE' Section 31, TIN, R66W.
The Brighton Planning Commission is in agreement with
the proposed zone change and preliminary plat.
The Brighton Planning Commission is also in agreement
with the City Council to make available water and sewer
service to the development contingent upon the conditions

Dear Harlow:
The City Council at its April 15 , 1975 meeting,
voted unanimously to make available water and sewer
service to the Ida Industrial Park, contingent on
the following considerations which are listed below:
1. All wells and surface water rights on the
property must be deeded to the City, which
shall represent a minimum three acre feet
per acre of land.
2. A 12" waterline would have to be installed to
your tract from the 12" line on Countyline Road.
3. Reimbursement would have to be made to Public
Service Company for connecting onto the line
installed by Public Service Company in 1968 as
provided in the agreement.
4. In City water and sewer rates as required by
City Ordinance, shall be charged.
5. Payment of a "City Service Fee" equal to in City
property taxes would be required until annexation
is completed.
6. A full review of all land development projects will
be made in advance by City staff, with authority to
deny water service to a given facility, in the
event water demand would be overly "excessive" .
All City Codes would have to be met during
construction of said land and structures.
