RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR12-0041, FOR AN AGRICULTURAL SERVICE ESTABLISHMENT, PRIMARILY
ENGAGED IN PERFORMING AGRICULTURAL, ANIMAL HUSBANDRY OR
HORTICULTURAL SERVICES, ON A FEE OR CONTRACT BASIS (A MIXED ANIMAL
VETERINARY CLINIC) IN THE A (AGRICULTURAL) ZONE DISTRICT - LARRY D.
JOHNSON LIVING TRUST
A public hearing was conducted on September 19, 2012, at 10:00 a.m., with the following
present:
Commissioner Sean P. Conway, Chair
Commissioner William F. Garcia, Pro-Tem
Commissioner Barbara Kirkmeyer
Commissioner David E. Long
Commissioner Douglas Rademacher
Also present:

Public Works representative, Heidi Hansen
Health Department representative, Lauren Light
The following business was transacted:
El I hereby certify that pursuant to a notice dated August 1, 2012, and duly published
August 8, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the
request of the Larry D. Johnson Living Trust, for a Site Specific Development Plan and Use by
Special Review Permit, USR12-0041, for an Agricultural Service Establishment, primarily
engaged in performing agricultural, animal husbandry or horticultural services, on a fee or
contract basis (a mixed animal veterinary clinic) in the A (Agricultural) Zone District. Brad
Yatabe, Assistant County Attorney, made this a matter of record.
Fl Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal, location, surrounding land uses, and referral responses. He also referenced two
letters expressing concern regarding appropriate zoning, increased traffic and dust, and
landscaping. He noted the applicant did provide a response to the concerns. Mr. Gathman
entered the favorable recommendation of the Planning Commission into the record, as written,
and displayed photographs of the site and surrounding area.
Fl Heidi Hansen, Department of Public Works, provided a brief overview of the transportation
plans and access requirements. She stated a water quality feature will not be required, since
there will be no storage or parking of commercial vehicles.

le Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions, as well as the Dust Abatement and Waste Handling plans.
El Dana Johnson, applicant, stated she intends to treat primarily horses, dogs and cats, and
she addressed questions from the Board regarding the Landscaping Plan.
El No public testimony was offered concerning this matter. In response to Chair Conway,
Ms. Johnson indicated she had no concerns with the requirements, as proposed. Following
discussion, Ms. Johnson agreed to the following revisions: amend Development Standard #3 to
allow up to ten (10) employees; modify Development Standard #4 to allow operations
from 7:00 a.m., until 7:00 p.m., Monday through Saturday; amend Development Standards #19
and #20 to add a second sentence to state, "Fees may, or may not, be required." and delete
Conditions of Approval #1.A.11 and #1.C. In response to Chair Conway, Ms. Johnson stated
she has reviewed, and agrees to abide by, the Conditions of Approval and Development
Standards, as proposed and modified.
El Commissioner Rademacher moved to approve the request of the Larry D. Johnson Living
Trust, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0041,
for an Agricultural Service Establishment, primarily engaged in performing agricultural, animal
husbandry or horticultural services, on a fee or contract basis (a mixed animal veterinary clinic)
in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the
Planning Commission, with the Conditions of Approval and Development Standards as entered
into the record. His motion included the revisions listed above. The motion was seconded by
Commissioner Kirkmeyer. The Board thanked Ms. Johnson for corresponding with the
neighbors to answer their questions and address their concerns. There being no further
discussion, the motion carried unanimously and the hearing was completed at 10:40 a.m.
This Certification was approved on the 24th day of September, 2012.
