Comments made during this stage of the review process will not be all inclusive; as revised materials are submitted other concerns or issues may arise. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: This USR is for an injection well for use by Noble Energy. It is located in the future Galeton Reservoir. Traffic: Weld County Public Works has received a Traffic Narrative for USR12-0014 prepared by Eugene G. Coppola. After reviewing the submitted narrative the following comments were prepared: The submitted Traffic Narrative appears to be acceptable. • •he applicant has indicated that this site will produce up to 2 round trips per day or 4 trips per day. The applicant will be responsible excavate, repair, or patch any damage on the haul route to mitigate for heavy truck traffic volumes created by the construction of the facility. The type and method of repair will be determined by the Department Public Works. The applicant will also be required to provide dust abatement during the construction of the facility. The proposed access width (minimum 20' for emergency vehicles) and the turning radiuses into the site (45'- 60' radiuses required to accommodate trucks). No parking or staging of vehicles on county roadways is allowed. Use on-site parking area. Weld County Functional Classification Map: (Revised Feb. 9, 2011 — Amended 10/2011)- CR 80 and 55 are the intersecting gravel roads that require a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Starting from the County maintained intersection of CR 80/55 North on CR 55 alignment; Section 16 is a State Section with no right-of-way, Section 15 is a Railroad Section with no right-of-way, and continuing North on the CR 55 alignment between Sections 9 & 10, the right-of-way has been vacated 5-5-1941. On the Weld County Road 84 alignment, the County has retained 60 feet of right-of-way located between sections 3 & 10. The road was not build by the County. •rom the maintained County intersection of CR 80 & 55 North, Noble would have to obtain Lease Road greements with adjacent landowners to reach the alignment of CR 84 where the County has 60 feet of right- of way available to access their injection well site. The applicant shall indicate specifically on the plat the type of (lease road) easement and indicate whether it is dedicated, private, or deeded to provide adequate access to the parcel. Section line accesses are considered private lanes with no county maintenance. Flood Hazard Development Standards: This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). Drainage: A preliminary drainage report dated February 2012 was submitted for review. The preliminary drainage report was stamped by Steve Sciscione, P.E. No. 45051. The preliminary drainage report was reviewed and comments are provided below: 1. A final drainage report following the Final Report Checklist will be required. The appendix of the Final Drainage Report shall contain calculations for all drainage features including but not limited to: the spillway, all swales (north, east, between communications tower and detention pond, between detention pond and level spreader, etc), level spreaders, riprap, detention pond outlet, culverts, and any other drainage related feature. The Final Drainage Report and associated drawings must be stamped, signed, and dated by a registered Professional Engineer licensed in the State of Colorado. 2. The drainage report and associated drawings indicate that the detention pond is to be used for secondary containment for oil spills. The intent of the detention pond is to provide storage and a regulated release rate for stormwater runoff. The detention pond cannot be utilized for secondary containment. A separate pond with no outlet shall be designed in accordance with State requirements • and shall be separate from the detention pond. 3. On the appropriate drawings, please show the flow path, flow path slope, and flow path length. 4. It is not possible from the spreadsheets provided in the Preliminary Drainage Report to review the time of concentration calculations. In the Final Drainage Report, please include calculations for the time of concentration. 5. The Preliminary Drainage Report did not contain a discussion regarding the validity of using CUHP in a rural area that is not in the Denver Metro Area. If CUHP is to be used to determine the offsite flows, its use in the proposed project area must be validated in the Final Drainage Report. A discussion of all the various model parameters must be included in the Final Drainage Report. The electronic model files must be included in the Final Drainage Report. 6. The culvert calculations in the Preliminary Drainage Report indicate that the velocity coming out of the culverts will be erosive on the downstream channel. In the Final Drainage Report please provide calculations for the appropriate erosion control devices to be installed. 7. In the Final Drainage Report, the ditch/swale calculations must be analyzed for both stability and capacity as indicated in Table MD-2 of the Drainage Manual. 8. Please note that the Final Drainage Report must be a standalone document. As such, the appendix of the report must contain copies of all tables and charts utilized in the calculations. Please provide electronic copies of the spreadsheets and CUHP model for review. 9. Please provide a complete set of construction drawings with the Final Drainage Report. Once the construction drawings are reviewed and found to be acceptable, the applicant will need to submit 3 complete sets (1 24x36 and 2 11x17) for the County's use. All sets must be stamped, signed, and dated by a registered Professional Engineer licensed in the State of Colorado. REQUIREMENTS: Please add the following development standards to the plat: 1. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. • 2. A final drainage report stamped, signed, and dated by a professional engineer licensed in the State of Colorado is required and shall conform to Weld County CODE 24-7-130.D and Ordinance 2006-7. 3. Weld County will not maintain on-site drainage related areas or medians. 4. Final drainage construction and erosion controls plans (conforming to the final drainage report) stamped, signed, and dated by a professional engineer licensed in the State of Colorado shall be submitted with each plan (phase). These plans (storm water management plans) shall be based upon Urban Storm Drainage Criteria Manual methodology as modified by Weld County Ordinance 2006-7. 5. In the event that 1 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and Environment. 6. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction. We have no objections to the proposal. The Department recommends that the following proposed conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall file an Air Pollution Emission Notice(APEN)with the Colorado Department of Health and Environment's(CDPHE)Air Pollution Control Division. 2. A Ground Water Monitoring Plan shall be submitted to and approved by the Weld County Department of Public Health & Environment(WCDPHE). • 3. If required, Stormwater Discharge Permit coverage shall be obtained from the CDPHE Water Quality Control Division for construction activities. We recommend that the following requirements be met prior to receiving final approval of building permits: 1. Detailed plans for the concrete secondary containment structures for all storage and processing tanks shall be submitted. Secondary containment volume shall provide containment for the entire contents of the largest single tank plus sufficient freeboard to allow for precipitation. 2. The applicant shall submit evidence to the Weld County Department of Public Health and Environment(WCDPHE), Weld County Department of Planning Services and the Colorado Oil and Gas Conservation Commission (COGCC)that the facility was constructed in accordance with application materials. 3. A detailed closure plan shall be submitted to the WCDPHE and the COGCC. The plan shall include a description of the manner in which the well will be plugged and abandoned, as well as specific details regarding reclamation of the property. No structures or equipment associated with the facility shall remain on the property following closure. 4. The facility shall post financial assurance with the COGCC. The financial assurance shall be adequate to cover a third-party closure of the facility, including the plugging and abandonment of the well, in accordance with industry standards, and the removal of all structures (including • concrete)on the facility. The site shall be returned to its original grade. The facility shall submit evidence to the WCDPHE that the appropriate financial assurance has been obtained. We recommend that the following requirements be incorporated into the permit as development standards: 1. The facility shall be constructed and operated to ensure that contamination of soil and groundwater does not occur. • 2. No disposal of waste, other than produced water piped from nearby wells operated by the injection well operator is permitted. Any changes from this approved use would require an amendment to this Special Use Permit. 3. Recovered crude/condensate loadout operations shall be conducted in a manner, which prevents leakage or discharge onto the ground outside the concrete containment area. Spill prevention measures shall be employed when making connections and during loadout operations. Portable containment, such as drip pans, shall be utilized when working outside the containment area. 4. Liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored, treated, and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. This facility shall adhere to the maximum permissible noise levels allowed in the non-specified zone as delineated in Section 14-9-30 of the Weld County Code. 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 7. All chemicals must be stored secure, on an impervious surface, and in accordance with the manufacturer recommendations. 8. The facility shall comply with Colorado Air Quality Control Commission Regulations and any air permits issued by the CDPHE Air Pollution Control Division. • 9. Analytical data on wastes and environmental monitoring data shall be made available to WCDPHE, who reserves the right to require additional more extensive monitoring. 10. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored, treated, and removed for final disposal in a manner that protects against surface and groundwater contamination. 11. Any contaminated soils on the facility shall be removed, treated or disposed of in accordance with all applicable rules and regulations. 12. The facility shall comply with the approved groundwater monitoring plan. 13. All storm water, which has come into contact with waste materials on the site, shall be confined on the site. 14. Portable toilets may be utilized and shall be maintained in a sanitary condition. Upon construction of the office building, an adequate permanent source of water and commercial Individual Sewage Disposal System I.S.D.S. will be required. 15. Any I.S.D.S. on the property shall be permitted, installed, maintained and operated in compliance with all provisions of the Weld County Code, pertaining to I.S.D.S. 16. Any required Spill Prevention Control and Countermeasures Plan (SPCC)Plans shall be prepared and maintained on-site per 40 CFR 112. • 17. Water Division 1, Water District 1 Dear Mr. Ogle: This referral does not appear to qualify as a"subdivision" as defined in Section 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition,the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure,the issuance of a well permit, or physical availability of water. The proposal is to create a produced water injection facility, referred to as the Cummins • Injection Facility, on a parcel of 27.9 acres. The 27.9 acres is currently part of a 160-acre parcel and is proposed to be created via a recorded exemption process. There are no wells or water rights on the entire 160 acre parcel. The injection facility will handle produced water from Noble Energy Inc. which will be delivered to the site by pipeline. It will operate as an unmanned facility visited by staff on a daily basis, at most. The proposal includes a future office building which is proposed to be served by a "domestic"well and septic system. Use in an office building would be considered commercial use by this office and therefore would not qualify for a domestic well permit. It is anticipated that a commercial exempt well permit could be obtained for the site upon approval of the recorded exemption. This type of well may be used for drinking and sanitary purposes inside a commercial building, with no outside irrigation or other use allowed. The amount of water allowed to be withdrawn would be limited to one-third of an acre-foot(108,600 gallons) per year. This office's final determination regarding if a well permit can be issued for the site will be made at the time a well permit application is submitted to this office. The Division of Water Resources does not regulate the injection of water; therefore our office has no comment on the potential injection at the site.
