Please accept and approve this Technical Revision ('FRI to revise the original permit stipulation
#1 of 7 July 2011. Since an 'existing'FR". addressing a 11ood anal�'sis and flood control plan is
presently under review and nearing approval. circumstances ark-cling on•going operations ha%e
reached a critical point.
On-going extraction has exhausted all available aggregate in Tract B. mostly attributed to the
unexpected shallow depth of the deposit. We must ha'e access as immediately as practical to a
portion of Tract (' to continue our aelix ities uninterrupted.
Since the impacts addressed in the "existing TR' in bract (' are many years from the protection
of the financial warranty: a benign revision to Stipulation #1. allowing extraction within a
limited portion of Tract C to occur until final approval and submittal of financial warranty for the
-existing TR.' has become essential. This request a ill not impair the purposes of the 'existing
TR.' and anticipates its approxal and submittal of the attending warranty within the next 3(1 dux..
To this end we propose under this '1-R. operating south of the established I'looduav boundary.
generally moving extraction from the south andl cast boundaries where they occur south of the
flooduay boundary. then northerly and westerlx. hurt not within It1(1 feet of the west boundary of
Tract C. as shown in the attached map of the area of interest within Tract C. This 'R and its
limitation \\mild remain in effect until such a time that the 'existing TR' is ;appro'ed and
warranty submitted.
