EXHIBIT r7. 6 co1Jl'•co, i(i7/J • Weld County Department of Planning Services Case COZ11-0001 To whom it may concern: We are writing you today in adamant opposition to the proposed zoning change from agriculture to industrial. As a neighbor to this land we would like to see it remain agriculture. From our home and farm we have a beautiful view of the Rocky Mountains and enjoy the country life. We moved here in 1968 and have seen many changes in our land, but none more discouraging then this. This is an agricultural area that has already lost too much land to pavement and housing. One thing we do know is that once it is zoned industrial,it will never return to agriculture. Weld County supports agriculture, right? At least that's what I have always heard. We are concerned about the water runoff that this will create. Our land borders to the east of the land that is asking for zoning change. Currently the land drains toward our land and runs off into the Gilcrest/LaSalle drainage ditch. When the rain comes hard and fast,the drainage runs over our road and into our fields. We understand they want to build a pond to catch the drainage, but we feel that this is not good enough. We have aerial pictures that were taken this fall that show the difficulty that we had this year growing and harvesting a field due to wet seepy conditions. We feel with the pond being proposed will only add to our current conditions. We also realize that the current owners have • stopped paying their dues into the drainage ditch, and expect the rest of the farmers to take care their run off for them. This ditch needs to be maintained by all that drain into it. We are also concerned for the traffic that this will create. Road 44 is already a very busy road and this will only add to the congestion and noise. In our opinion there is no room to add an access to this land from road 44 without creating a safety issue. A few years ago we fought to have to speed limit reduced to 45mph on road 44 from highway 85 east to road 35. The county did reduce the speed but does a very poor job on enforcing it. The traffic is usually travelling about 60 to 65 mph though this area creating a very unsafe road for us to enter onto. Also road 44 has many rolling hills from highway 85 to road 49 and it is very difficult to enter onto road with the blind spots behind the hills. Extra traffic from the zoning change will only magnify this problem. We are also concerned about the safety of the farmers moving their equipment from farm to farm. The tractors travel with their safety lights flashing but little regard is given to them. Our family is very aware of this problem since we have lost a family member to a traffic accident were the tractor was hit from the back by a driver going too fast and not paying attention on a Weld county road . We are also concerned that once the land is rezoned we will have no control over the use of the land. Our family okayed the building of Nix's onion shed, but then they sold and now we have many businesses there. We also opposed the building of the Immigrant housing on the corner of Highway 85 and 44 but lost. At this location we also challenged the under sized septic system being allowed, but lost again. The system failed and has been rebuilt at least twice, and now is being venting directly to the • atmosphere. Will the county enforce the required codes for more building? If the zoning goes 2012-0315 • through as industrial zoning with promises of certain guide lines we know this is only as good as the first owner. When it sells again we start over and then it is harder,since it is already established as industrial. Also you state that there is already industrial property built around this property of question. Yes that is correct but these businesses are here to support the local farmers. Migrant housing for field labors, Dirty Dan's Repair to fix our tractors and farm trucks, and Martins Produce to market local crops. These developments support agriculture. We are also concerned that we are agriculture area with no existing infrastructure to support this type of development. No fire hydrants or professional fire response except volunteer departments in La Salle and Gilcrest. No law enforcement except county sheriffs. We are also not convinced that there will be enough water to support the business. We acknowledge that the industrial zoning thinks that being located adjacent to the railroad is a positive. Not sure why since the trains only stops in La Salle. Are you trying to get the trains to stop at Peckham also? Currently when the train does get stopped in LaSalle,the next train going north,is sometimes backed up between roads 44 and 35,this already creates a traffic problem coming from both directions of the rails. When the train blocks 44 then some drivers already think they can cut though our land on the road that goes along the Western ditch as they enter from road 33 going east. This is not acceptable now and would not be acceptable in the future. What are the rules of the county and the Western Ditch company for a bridge to go over the top • of it? Will the ditch remain okay? Is there enough clearance for large trucks to make the turns needed? And will the sounds of trucks shifting drive our neighbors out? This will defiantly change the value of our homes in a negative way. Please conceder our request to keep the zoning as agriculture.
