LINE TO CONNECT THE XCEL HUDSON-FORT LUPTON TRANSMISSION LINE INTO
THE PROPOSED SUBSTATION) IN THE A (AGRICULTURAL) ZONE DISTRICT -
KERR-MCGEE GATHERING, LLC/ROBERT WARNER/ANADARKO E&P COMPANY,
LP, C/O TRI-STATE GENERATION AND TRANSMISSION ASSOCIATION, INC.
A public hearing was conducted on August 22, 2012, at 10:00 a.m., with the following present:

The following business was transacted:
le I hereby certify that pursuant to a notice dated July 20, 2012, and duly published July 25,
2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of
Kerr-McGee Gathering, LLC/Robert Warner/Anadarko E&P Company, LP, c/o Tri-State
Generation and Transmission Association, Inc., for a Site Specific Development Plan and Use
by Special Review Permit, USR12-0033, for a Major Facility of a Public Utility (115-kV
Substation and an approximately 1.5-mile long 115-kV transmission line to connect the XCEL
Hudson-Fort Lupton transmission line into the proposed substation) in the A (Agricultural) Zone
District. Brad Yatabe, Assistant County Attorney, made this a matter of record.
IA Chair Conway advised the applicant's representative, Steve Gray, that he has the option
of continuing this matter to a date when the full Board will be present. However, if he decides to
proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner
Kirkmeyer will listen to the record and make the determining vote. Mr. Gray indicated he would
like to proceed today.
Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the
record as written. He reviewed the location of the site and proposed transmission line route,
and explained the cryogenic site was previously approved in July 2012. He gave an overview of
the surrounding land uses, reviewed the referral responses, and stated staff received no

correspondence from surrounding property owners, although the applicant did have some prior
contact with area residents. He displayed maps and photographs of the site and surrounding
area. Mr. Gathman responded to questions from the Board regarding the referral response
from the Colorado Division of Wildlife (CDOW) and stated the requested items are not required
through the USR permit.
El Don Carroll, Department of Public Works, provided a brief overview of the existing
roadway conditions, access, grading and drainage plans, transportation plans, and permitting
requirements. He also addressed questions from the Board concerning the vegetation height in
Development Standard#16.
Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions, dust control, and trash containment requirements, and stated she has no
concerns with the proposal.
IE Mr. Gray stated this application will provide electric service to the previously approved
Lancaster Cryogenic facility. He reviewed the applicant's prior contact with the area residents
and how they determined the site selection along an existing power source corridor. Fl
Mr. Gray addressed questions from the Board concerning operation timing restrictions as a
result of the CDOW requests, weed control, and ongoing grazing and agricultural operations.
Fl No public testimony was offered concerning this matter. Mr. Gray indicated no concern
with the proposed Conditions of Approval and Development Standards. Commissioner
Rademacher suggested deleting the last sentence of Development Standard #16, and the
Board and applicant agreed. Responding to Chair Conway, Mr. Gray stated he and the
applicant have reviewed, and agree to abide by, the Conditions of Approval and Development
Standards, as proposed and modified.
Fl Commissioner Rademacher moved to approve the request of Kerr-McGee Gathering,
LLC/Robert Warner/Anadarko E&P Company, LP, c/o Tri-State Generation and Transmission
Association, Inc., for a Site Specific Development Plan and Use by Special Review Permit,
USR12-0033, for a Major Facility of a Public Utility (115-kV Substation and an approximately
1.5-mile long 115-kV transmission line to connect the XCEL Hudson-Fort Lupton transmission
line into the proposed substation) in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. His motion included deleting
the last sentence of Development Standard #16. The motion was seconded by Commissioner
Long, and it carried unanimously. There being no further discussion, the hearing was
completed at 11:19 a.m.
