RESOLUTION
RE: SUBDIVISION EXEMPTION NO. 39 -- EXEMPTION OF LAND TRANSFERRED TO
WELDON C. BAILEY and MARY L. BAILEY FROM DEFINITION OF "SUBDIVISION"
AND "SUBDIVIDED LAND".
WHEREAS, the Board of County Commissioners of Weld County, Colorado
has reviewed the request of the Lazy D.Grazing Corporation for an
exemption of land to be transferred by it to Weldon C. and Mary L. Bailey
from the defintion of "subdivision" and "subdivided land' in Section
30-28-101 (10), CRS 1973, as amended, and in Section 2-1 of the Weld County
Subdivision Regulations, and
WHEREAS, the Board finds that the contemplated transfer does not con-
flict with the intent of the Weld County Comprehensive Plan and will not
have an adverse impact on the existing use of the land, and
WHEREAS, the Board has considered the recommendation of the Depart-
ment of Planning Services on this matter and has reviewed information
submitted by the applicant, and
WHEREAS, the Board of County Commissioners has the power pursuant
to Section 30-28-101 (10) (d) to exempt from the definition of the terms
"subdivision" and "subdivided land", and division of land, if the Board
of County Commissioners determines that such division is not within the
purposes of Part I of Title 30, Article 28, CRS 1973, and the Board has
so found;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Weld County, Colorado that the transfer of certain lands located in
Part of Lot 2, Section 21 , Township 12 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as follows:
Beginning at a point on the Colorado-Wyoming boundary line
at a point from which Mile Post 38, a grader blade set in concrete
bears S 89°02'45" W, a distance of 435 feet; thence N 89°02'45" E
along the Colorado-Wyoming boundary line, 187.5 feet to a point
where the Colorado-Wyoming boundary line intersects the East line
of said Lot 2; thence S 0°51 ' W along the East line of said Lot 2
a distance of 143.9 feet; thence N 87031 ' W, 141 .9 feet; thence
N 24°13'15" W, 110.8 feet; thence N 3°10'30" E, 33.6 feet to the
point of beginning. Containing .55 acre, more or less,
to be added to a Parcel described as all that Portion of the NEa of the NEa
of Section 21 , Township 12 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows:

N 88°04' W, 319 feet to the point of beginning. Containing 7.54
acres, more or less
Be, and hereby is exempt from the definition of "subdivision" and "sub-
divided land" found in Section 30-28-101 (10) , CRS 1973, as amended, and
Section 2-1 of the Weld County Subdivision Regulations.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 2nd day of February, A.D. , 1977.

on the 7th day of February, A.D. , 1977.

Gentlemen:
We are requesting a Subdivision Exemption on Parcels "F" and "E"
located in the above mentioned is section for the following reasons:
1. The transfer of Parcel. "F" in Colorado from the Lazy D Crazing;
Corp. , to Weldon C. & teary L. bailey for the purpose of
straightening out boundries of land used by the Baileys for
the last 30 years. The Lazy 1) people and the prior owners
kept up the fences around the outside of the property used by
the Baileys and were unaware the property belonged: to them.
2. In July of 1976 our firm sold the Bailey property to Steve
Caldwell who owns the adjacent property in Colorado. We have
been unable to get the title cleared until now. The Baileys
traded all of their property in Section 20 for Parcel "F" in
Colorado and "B" in Wyoming. There was no problem in filing
that deed.
Therefore, we request that a Subdivision Exemption be granted so that
the Baileys may transfer Parcels A, B, D, E and F to the Caldwells to
become one piece of property.
