SUBJECT: USR12-0060, Jana Birdwell/Dahl Kennel
A Use by Special Review permit for a kennel (max 40 dogs).
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 55 is a local road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County.
A detailed site plan is required following the checklist provided by the planning department. Additional
Public Works items that must be shown are: parking, circulation, road right-of-way, easements, drainage
flow arrows showing the direction of stormwater flows across the property, water quality area.
Expected traffic is minimal with a maximum of 6-10 vehicles per day.
The applicant will utilize the existing recorded access easement. Please show and label this easement
with the recording number (Rec#3340723).
Please show on the site plan where the water quality area will be located and how the drainage from the
business area reaches the water quality depression. The water quality area must be completely on the
USR property and capture stormwater runoff from the business/kennel area so that it does not run onto
neighboring properties.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Provide a detailed site plan per the planning checklist and including the following Public Works
items: parking, circulation, road right-of-way, easements, drainage flow arrows showing the
direction of stormwater flows across the property, water quality area.
2. Show and label the existing access easement with the recording number (Rec#3340723).
3. Show and label the Water Quality Area on the Plat.
4. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
c. Weld County is not responsible for the maintenance of onsite drainage related features.

Environmental Health Services has reviewed this proposal for a kennel (40 dog non-
profit rescue and boarding kennel for an unspecified breed) in the A (agricultural) zone
district.
Water will be supplied by a commercial well which allows for kennel usage. (permit
75930-F)
There is an existing septic permit on file for this property. Septic permit SP-0800157
was issued for a 3 home which correlates to 6 people. The application states there will
be a maximum of 6 employees, 4 to 5 volunteers and a limited amount of public who
would come to the site. All personal on site must have access to potable water,
restroom and hand washing facilities. Either an approved septic system will need to be
installed for employee, volunteer and public usage or the existing permitted septic
system must be made available for use. In either instance, an engineer's review is
required.
The application states that a new septic tank will be installed to contain waste water
which will be used in the daily sanitation of the kennel and/or supplies (bowls, bedding
ect). This is acceptable for kennel sanitation only and a vault permit is required from
Environmental Health Services.
An on site dust abatement plan is required. The application states that the access will
be gravel but does not indicate what the dog runs will be constructed of and how the
runs will be maintained.
The application states that waste will be put in a dumpster and picked up by a local
trash company. A revised waste handling plan shall state the frequency of waste
removal and how often the disposal company will service the dumpster.
Noise will be restricted to the level allowed in the non-specified zone district.
A Pet Animal Care Facilities Act license (PACFA) is required according to the
Department of Agriculture.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
The following requirements are recommended to be met prior to allowing the plat to be
recorded:
1 . The applicant shall submit a dust abatement plan, detailing on site dust control
measures, for review and approval, to the Environmental Health Services, Weld
County Department of Public Health & Environment.
2. In the event the applicant intends to utilize the existing septic system for kennel
personnel (includes employees, volunteers and public), the septic system shall
be reviewed by a Colorado Registered Professional Engineer. The review shall
consist of observation of the system and a technical review describing the
system's ability to handle the proposed hydraulic load. The review shall be
submitted to the Environmental Health Services Division of the Weld County
Department of Public Health and Environment. In the event the system is found
to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
3. Alternately to item #2 above, an individual sewage disposal system is required
for the kennel personnel and shall be installed according to the Weld County
Individual Sewage Disposal Regulations. The septic system is required to be
designed by a Colorado Registered Professional Engineer according to the Weld
County Individual Sewage Disposal Regulations.
4. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
5. The applicant shall provide a copy of the current license from the Pet Animal
Care Facilities Act (PACFA) to the Weld County Department of Public Health and
Environment.

We recommend that the following requirement be incorporated into the permit as a
condition that must be met prior to the issuance of the Certificate of Occupancy for the
kennel building:
1 . An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations. (A vault is acceptable for daily sanitation of the
kennel and/or supplies)
We recommend that the following requirements be incorporated into the permit as
development standards:
1 . Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed weekly from the facility and
disposed of by a commercial hauler.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
5. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
6. The applicant shall comply with the Colorado Department of Agriculture (CDA),
Division of Animal Industry.
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Non-specified Zone as delineated in Section 14-9-30 of the Weld County Code.

9. Adequate drinking, handwashing and toilet facilities shall be provided for public,
employees and volunteers of the facility, at all times.
10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes, at all times.
11.This application is proposing a well as its source of water. Groundwater may not
meet all drinking water standards as defined by the Colorado Department of
Public Health and Environment. We strongly encourage the applicant to test
their drinking water prior to consumption and periodically test it over time.
12.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
13.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

After reviewing the application and documents submitted the Building Department has the following comments:
Any structures proposed to have changes uses will require commercial building permit for change of use.
A code analysis, floor plan an complete set of plans for any alteration and a structural analysis may be
required by a professional engineer will be required.
A building permit will be required for any new construction, alteration, or addition to any buildings or
structures on the property. It is required that a code analysis be done on the project by a design
professional with experience in this area. A building permit application must be completed and two
complete sets of engineered plans including engineered foundation plans bearing the wet stamp of a
Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report
performed by a registered State of Colorado engineer shall be required or a open hole inspection..
Buildings and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006 International Building
Code; 2006 International Mechanical Code; 2006 International Plumbing Code: 2006 International Energy
Code; 2006 International Fuel Gas Code; 2011 National Electrical Code; 2003 ANSI 117.1 Accessibility
Code and Chapter 29 of the Weld County Code.
A plan review shall be approved and a permit must be issued prior to the start of construction.

Dear Mr. Ogle:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011
memorandums to county planning directors, this office will only perform a cursory review of the referral
information and provide informal comments. The comments do not address the adequacy of the water
supply plan for this project or the ability of the water supply plan to satisfy any County regulations or
requirements. In addition, the comments provided herein cannot be used to guarantee a viable water
supply plan or infrastructure, the issuance of a well permit, or physical availability of water.
The application is a Site Specific Development Plan and Use by Special Review Permit for a
kennel (40 dog nonprofit rescue and boarding kennel for an unspecified breed). The Applicant has
secured a well permit, no. 75930-F, which allows uses of water in a kennel, consistent with the
application. Therefore, this office has no objection to the proposal.
