The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: The Town of Mead has jurisdiction over CR 7 and CR 32. Access and right-of-way requirements shall be determined by the Town. The application states that the recreational traffic to the lake will utilize the existing access from CR 7 and the maintenance/ditch company traffic will utilize the existing access from CR 32. The town must approve the access from CR 7 since the recreational traffic use will be increased with this application. Please show and label the recorded access easements used for access to the lake. • Please show a blow up of the recreational area with the existing and future improvements (existing club house and vault, proposed beach, ramp and dock, etc.). Please show and label all camping and parking spaces on the plat. A portion of the site, is located within the FEMA mapped Mulligan Reservoir Floodplain. The floodplain area is generally within the lake and not on the shoreline, however, FEMA can update the floodplain boundaries at any time so prior to the start of any development activities (new construction or the placing of fill, etc.) the owner should contact Weld County Public Works to determine if the activities are within the floodplain boundaries. At such time as the owner proposes to construct improvements (ramp, dock) or place fill (beach) within the FEMA designated floodplain, a Flood Hazard Development Permit(FHDP) will be required. REQUIREMENTS: 1. Provide approval from the Town of Mead for the increased recreational traffic utilizing the existing access from CR 7. 2. On the Plat, provide a blow-up of the recreational area with existing and future improvements shown and labeled as well as all parking and camping areas. 3. Our comments and requirements are as follows: COMMENTS AND REQUIREMENTS: WCR 7 is a major arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. WCR 32 is under the jurisdiction and maintenance of the Town of Mead. The applicant shall indicate specifically on the plat the type of right-of-way/easement that exists on the property. Oilize the existing access to this parcel. There is an existing privy on the site that has been utilized for sewage disposal and there is no water service on the site. There are 30 members of the ski club and no employees. Section 30-2-10 of the Individual Sewage Disposal System Regulations state "The owner of any structure where people live, work, or congregate shall ensure that the • structure contains an adequate, convenient, sanitary toilet and sewage disposal system in good working order." It is the policy of this department that portable toilets are allowed when a use is temporary or seasonal. The definition of temporary is six months or less. The applicant states the on-site activities will occur from April through October. Even though the time period exceeds 6 months in duration, the use of portable toilets can be allowed as this proposal is a seasonal use. Bottled water will also be allowed for the seasonal use. The applicants can either permit the existing privy or bring in portable toilets. If the applicant decides to utilize portable toilets, a minimum of two units will be required based upon 30 people utilizing the facility. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. All septic systems (which includes vault privies) located on the property shall have appropriate permits from the Weld County Department of Public Health & Environment. The Environmental Health Division of the Weld County Department of Public Health & Environment was unable to locate a septic permit for the existing vault privy. Any existing septic system which is not currently permitted through the Weld County Department of Public Health & Environment 1111 will require an evaluation by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review • describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 2. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and • Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 6. Adequate drinking (bottled water), handwashing and toilet facilities shall be provided for personnel using the facility. 7. Any septic system, including a vault privy, located on the property must comply • 2 • with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 8. If portable toilets are utilized, a minimum of two are required. 9. This violation was initiated due to the commercial ski component without first obtaining the necessary Weld County Zoning Permits. This case has not yet been presented to the Board of County Commissioners through the Violation Hearing process. Since this case has not been presented to the Board of County Commissioners, no investigation fee is required as this time. Please be aware that we have not received any complaints on regarding this parcel for at least 2 years. The only reason this violation case was kept active was to ensure that prior to any skiing activities a Use by Special Review (USR) permit was obtained. The initial complaint was received from several private citizens. This application if approved by the Board of County Commissioners and once a plat is recorded will correct the violation. As the proposed site is wholly inside the boundaries of the Town of Mead, and given the adjacent existing and proposed development, the applicants should be directed to submit a request to annex into Mead. Given the time of year, this should not impact their schedule or interests in the proposed use. It is our understanding this application is the result of neighbors in the area complaining about the noise • and other nuisance factors. It appears that the request would allow up to 37 members and, presumably, their family members to create a boat ramp, dock, and beach area immediately adjacent to a proposed low density residential area. Usage is stated in the application as,"from sunup to sunset, seven days a week." It is our understanding that these applicants are separate from the membership of the Mulligan Fishing and Hunt Club. In recent testimony before the Mead Board of Trustees, the Hunt Club claimed they have rights to hunt and use firearms on and around the reservoir. We cannot imagine a more dangerous, incompatible set of uses than that of water skiing and firearms. Notwithstanding the illegal use and incompatibility of the water skiing activity with the existing and proposed residential uses, the County should clearly prohibit this non-conformity as a direct health and safety hazard. Further, the applicants have indicated three access points are available. It is our understanding that at least one of these access points would violate a surface use agreement, and,therefore, would not satisfy the Mountain View Fire Protection District comment letter of August 22, 2008. We seriously question the authority and rights of the applicants to use the proposed access points for this non- conforming use and would ask for clear documentation to that end. As for the application,there seem to be a number of errors that make it difficult to fully assess the application. Drawings show improvements right on the southwest property line with no setbacks but the narrative talks about some building activities on the north end of the reservoir.There are also conflicting numbers regarding the total number of members/people that would be allowed and no specific number of people that might be using the facilities at any one time. • • Before the County takes any further action, the application should be revised to correct the inconsistencies; clarify users and usage; and provide a more detailed site plan with dimensions. In addition, should the County consider allowing the ski operation on Mulligan Lake over the objections of the Town of Mead,the Town requests you place these operating conditions upon the ski use. 1. There must be access to sanitary facilities. The Town recommends commercial portable sanitation facilities be required and regularly maintained, pumped and cleaned. Other sanitation facilities or options should not be allowed. 2. Trash and waste must be addressed, whether by dumpsters emptied weekly or by a limitation stating no trash or waste be left on site. If dumpsters are allowed, they must be placed so as not to be seen from any Town road or by homeowners. 3. Boats, tents, campers and motor homes should not be allowed to be parked overnight. This area is surrounded by low density home sites whose owners are not enamored with the thought of sharing their home sites with boat and camper storage areas. 4. Access roads should be maintained in a passable condition for use by emergency vehicles at all times. 5. Access permits must be obtained to access Town of Mead roadways. 6. Signs must be placed and constructed to the Town of Mead standards. 7. As has been found with other lakes and reservoirs, there is a limit to the number of boats that can operate safely at any time and the County should place a limit for usage on the reservoir. This would also assist in limiting the noise factor. 8. Hazardous waste spills occur regularly from boating activities. All spills should be reported to • the Mountain View Fire Protection District immediately. 9. Noise should be more limited than stating from "sunup to sundown." Noise issues tend to originate from engine motors, music and the "party atmosphere." Consideration must be given to the adjacent homeowners. The noise should be limited to the current Town of Mead standards for operating equipment in residential areas. Limitations as stated in Article 13, Section 10 of the Town of Mead Code: 7 a.m. to 7 p.m. and not to exceed 55 decibels within 25' of the noise source. 10. All operations should cease between sundown and 8 a.m. This is interpreted to mean all persons, animals, cars, boats, campers,tents and motor homes should not be located upon the premises after sundown until 8 a.m. the following morning. 11. Temporary structures, including shade structures, are not allowed, with the exception of portable sanitation facilities. 12. Permanent structures are limited to one dock with no storage or shade facilities,one boat ramp with no storage or shade facilities and one sanitary facility not to exceed 250 sq. feet. 13. No buoys or rafts may be placed in the reservoir. 14. No camping allowed. 15. No generators allowed. 16. No fires allowed. 17. No fireworks allowed. 18. No animals allowed except on a leash. All droppings must be removed immediately. 19. No commercial or retail sales allowed on the site. 20. Weeds must be kept to a maximum height of 5 inches. According to the CDOW maps for Weld County,this general area provides winter forage and winter range for bald eagles; a foraging area for great blue heron; a production area,winter concentration,and winter range and foraging area for ducks and geese;and is within the overall range for pheasant and white-tailed deer. Coyote, fox, raccoon, skunks, songbirds, other raptors . and herptofauna may also occur in this area. The plan calls for expansion and development of existing water-skiing facilities. To protect essential wildlife habitat and minimize impacts to wetlands on site to the extent possible,the applicant should consult with the United States Fish and Wildlife Service to determine the need for surveys for Preble's meadow jumping mouse where potential PMJM habitat exists. The applicant may wish to consult with the United States Army Corp of Engineers to determine whether an application for a 404 permit is needed for any proposed dredging, filling and berming associated with the project. Preserve native trees and shrubs as well as dead trees on the property to provide essential habitat for wildlife. Reclaim sites disturbed by construction promptly to promote establishment of desirable plant species and to discourage invasion by noxious weeds. Aquatic invasive species are a risk with any construction in wet areas. If heavy equipment to be used for the project has previously been used in another stream,river, lake,pond, or wetland, one of the following disinfection practices is necessary prior to construction to prevent the spread of New Zealand mud snails,zebra mussels,quagga mussels, whirling disease,and any other aquatic invasive species into this drainage. These practices are also necessary after project completion, prior to this equipment being used in another stream, river, lake, pond,or wetland: • Remove all mud and debris from equipment(tracks,turrets,buckets,drags,teeth,etc.)and spray/soak equipment a 1:15 solution of Sparquat institutional cleaner and water. Keep equipment moist for at least 10 minutes OR • Remove all mud and debris from equipment(tracks,turrets, buckets,drags,teeth,etc.)and spray/soak equipment with water greater than 140 degrees F for at least 10 minutes. Clean hand tools,boots,and any other equipment that will be used in the water with one of the above options as 4, well. These activities provide wholesome recreation for friends and family,and provide economic benefit to local retailers. Hunting in this area is also an • essential tool for balancing wildlife populations,especially Canada geese, with available habitat as well as reducing potential damage by wildlife on agricultural operations. For these reasons it would be beneficial to continue these traditional activities in the vicinity until safety or future development precludes it.
